    3. Hello sister/brother researchers -- I am sending out this inquiry to several lists -- please forgive if you receive a duplicate. In researching my ancestors, I have found many that served in the various militias from NYS in the Revolution. However, some of that information has left me with a few questions, namely: (1) One of my ancestors, born in NYS but died in Ontario, Canada, is listed as a "Butler's Ranger" -- so I assume he was a "Tory" -- anyone have more info on Butler's Rangers? (2) A second ancestor, number #1's cousin in fact, is listed as serving in the Tryon militia "Battalion of Minute Men" -- as in Paul Revere/Minutemen --?? (3) Does anyone have a list of forts that were located along the Mohawk River at this period of history -- I know Fort Stanwyck (becomes Rome, NY) and then Fort Dayton (which is now what--??) Fort Herkimer and a fort at Cherry Valley (named--??) Were there others as well? Supposedly my gggggmother was taken by the Mohawk Indians in one of the latest raid made by the Mohawks (which would be what year(s) - 1780-ish, maybe--??) but released "to the fort" by Joseph Brant. She lived in the Springfield/Jordanville area of NYS. (4) What was Utica called before it was Utica and when did it become Utica? I *know* I should probably KNOW a lot of this stuff already--- why oh why didn't I listen more closely to my 8th grade NYS history teacher, Margaret Gwise?? I'm sure her Spirit is laughing at me know for having to be asking questions she knows *I* should know! :-) Thanks for you help nonetheless! Marsha Strong Gainesville, FL

    3. Mary, Utica is located in the New York Archdiocese, which is the whole state. I believe Utica's local diocese is Syracuse. Hi again Ed (and listmembers) -- In this post are some more www sites that might help you and others on the list to understand these issues more fully when it comes to using genealogical research publications .... OR for protecting your own writings. ... and yes, I saw Marc Nozell's posting to the effect that the matter has been referred to RootsWeb. It would be worthwhile for the RootsWeb folks to eventually post something about their "official" position/policies vis-a-vis copyright in relation to genealogical information posted on or found on any Rootsweb page. I read further back in my "copyright" e-files and located the following helpful sites (I rechecked all urls today and all but one [as noted] are alive and working: (1) Library of Congress copyright "homepage" -- check it out at http://lcweb.loc.gov/copyright You'll need Adobe Acrobat reader to view PDF files there. --- see in particular, from the Copyright Basics link, (i) Circular#1 Copyright Basics -- defines who can claim copyright, how & when it is created etc etc and more. This material validates many of the "facts" I told you about in my first reply (that was also posted to the maillist). (ii) Circular#21 covering Fair Use AND Reproduction by LIBRARIES of copyrighted works -- plus more.     3. Ed, you as the author of the work, own the copyright, regardless of the claim made by the apparently anonymous claimant on the site you listed. You do not need to file it with The Library of Congress or anyone other office to make the claim; you just need to be able to prove you originated the material. However, to prove copyright, if proving and claiming were to be needed, you would have to provide evidence of authorship, which presumably you can do with your original manuscript, dated computer files, correspondence, and copies you gave to the various institutions. But, since you never sought financial compensation, and apparently don't seek it now, your damages are intangible. Despite the seeming callousness of that statement, I can readily imagine the hurt is real and the your perception of being violated as real as if you had been held up at gun point. Let's hope the folks at Rootsweb see it the same way and either pull your Evergreen Cemetery History and Index, or whatever you've entitled it, or compel the false claimant to relinquish his or her claim, request your permission, and, if granted, post full credit where appropriate, if that is a resolution that you can accept. I've had my copyrights violated more than once, and have never sued for the simple reason that claiming damages can be very daunting if large sums of money are not at stake. But I have dressed down the thieves in ways that brought them notoriety, which was rewarding in and of itself.
