I'm just a crabby so an so and I do apologize. I just hate it when people deny me access to history and I've already been through this battle Access to Cemeteries is covered under the right of way laws in Georgia. In other states is it actually covered under cemetery laws. Also in Georgia you have an ally in the Secretary of State. They MUST protect the cemeteries. Here are some of the references: The county or Municipality MUST upkeep cemeteries 36-72-3 G *** CODE SECTION *** 10/15/99 36-72-3. Counties, anywhere within the county boundaries, and municipalities, anywhere within the municipal boundaries, are authorized, jointly and severally, to preserve and protect any abandoned cemetery or any burial ground which the county or municipality determines has been abandoned or is not being maintained by the person who is legally responsible for its upkeep, whether or not that person is financially capable of doing so, to expend public money in connection therewith, to provide for reimbursement of such funds by billing any legally responsible person or levying upon any of his property as authorized by local ordinance, and to exercise the power of eminent domain to acquire any interest in land necessary for that purpose. Here is an FYI: 44-3-139 G *** CODE SECTION *** 10/15/99 44-3-139. (a) The administration of the provisions of this article shall be vested in the Secretary of State, who may delegate such of his powers and duties under this article to a division director of his office as he shall deem appropriate. (b) The Secretary of State shall keep a record of all proceedings related to his duties under this article and shall keep a register in which shall be entered the names of all cemeteries to whom certificates of registration are issued, which register shall be open at all times for public inspection. The Secretary of State needs to know about the cemeteries that are in disrepair as well as the local municipalities. Quote them the law 36-72-3 if they don't already know it. It is their responsibility to maintain our history! Here are some the Trespass Laws: 32-6-110 G *** CODE SECTION *** 10/15/99 32-6-110. As used in this article, the term "local service road" means any public road, whether existing at the time of the designation of a limited-access road or established thereafter, which serves the owner or occupant of any land or improvements abutting a limited-access road and which gives a means of ingress to and egress from any such lands or improvements. 32-6-113 G *** CODE SECTION *** 10/15/99 32-6-113. Limited-access roads may be so designed as to regulate, restrict, or prohibit access thereto so as to best serve the traffic for which such facility is intended. The authority designating and establishing any limited-access road is authorized to divide and separate such highway into separate roadways by the construction of raised curbings, central dividing sections, or other physical separations or by designating such separate roadways by signs, markers, or stripes; to designate the proper lanes for traffic moving in opposite directions; and to prohibit the making of turns at specified points. The designating authority may recommend to the commissioner of public safety or, if the roads in question are in a municipality, to the municipality that there be fixed on such roads and on the separate lanes thereof such rates of speed as are deemed in the public interest. No person shall have any right of ingress to or egress from or passage across any limited-access road to or from abutting lands except at the designated points to which access may be permitted and under such arrangements and conditions as may be specified from time to time. 51-9-10 G *** CODE SECTION *** 10/15/99 51-9-10. The unlawful interference with a right of way or a right of common constitutes a trespass to the party entitled thereto. They can't stop you from viewing a cemetery because there had to have been a right of way to the site originally. The county can tell you exactly where the access is or was and you CAN use it. You also have another option in your State Senator. That's where I went when I had problems. They quote the law beautifully and MAKE whoever is impeding your access comply. They are also available to make "suggestions" to the Secretary of State when you find a cemetery in disrepair! We have had much success. Please go look at the Laws in Georgia before you make remarks like that. People have had access to cemeteries Nationwide and there ARE laws protecting the rights of people to view their ancestors. Regardless of who you think the "enemy" is there are laws on the books that allows for even disputing siblings to have access to graves. There is one that we may have problems getting to. Believe it or not - this is at the back of a business location, but we'll figure out something! This brings up a related issue - there should be some type law granting ingress and egress to get to cemeteries, using existing roads or byways. If you have an ancester buried somewhere, you should at least have the right to visit their grave! I think almost everybody would ask the landowner for permission to cross their property before visiting a grave - even if there were such a law granting ingress & egress. Hi all, Whew! What a day! I think we're finally getting our home remodelling/Spring cleaning project under control, & almost ready for our carpet to be laid on Thursday! I am wondering if any of you dear people might have any information on the following people: Nancy BEARDEN, born about 1836, and her husband Egbert DARBY, who were married in Walton County on 4 May 1854. And the people I believe might be her parents, Richard P BEARDEN, born in VA about 1814, listed in the 1860 census, but not in the 1870, and his wife Julia Ann / Juliann / Jaelin WARREN, born in GA about 1820. They were married in Walton County on 9 Dec 1835. She was still listed in the 1870 census. The 1860 census has the two couples living next door to each other in the Northern District of the county, and I am hoping that someone out there might have some information on either or both families. Right now all the information that I have on any of them came from the 1860 and 1870 census records. Any information you might be able to provide will be gratefully appreciated! Tricia

Bettie, I belong to another list in which the gateway is active. A gateway is nothing more than way of porting items from one format into another, as I understand it. Once activated the mechanics of the process are transparent to the user. In our case the activation or deactivation of the GenConnect gateway is controlled by the list manager. It is either on or it is not. What happens is, when anyone posts a message to the Genconnect board or a response to a message on that board that affects your county of interest, that message and the link back URL (universal resource locator or web address) appears in a "normal" posting on say the GAWALTON-L list. If you are interested, you may explore the message and any associated threads leading to or from it.. If not delete it as you would any other message and go on about your business. It really makes one more aware of the GenConnect message board postings and the service makes it less likely that you will miss something. You could do the same thing by just checking the message boards personally every now and again. But this way, if you follow a list with the gateway active, you pretty much stay on top of both lists as you go. The disadvantages are slight. The only one I can see is that you get a few more messages. But when you think about it, messages and communication are what you joined a list for in the first place. For people who are overwhelmed with messages already, the slight addition to the number could be easily handled by converting to the digest mode e.g., GAWALTON-D where you receive the messages in a "packet" rather than continuously as posted. Hi all, Well, I've got news today! The "Gooder" news is we now have 2 more census images online. The Good news is: You have to go to our web page & look under the "Census" section to look at them! I hope to have the 1860 indexed by the end of the month???? These 2 census (censi?) leave us with just 1910 & 1920 totally unreprestented because the 1900 has been bought & 1880 has a mortality schedule. WOW, we're getting there, aren't we? Hi kiddoes, I think we've had some very interesting topics on the list lately--with the surrounding county cemeteries, & towns. I'm almost done with all these marriages--there's still a few, here & there, but when I'm done there & we get most of our remodeling out of the way, how about these projects for our web page: 1) Neighboring Counties--we could do a little more "history" on these, that could be beneficial, & give county seats, etc. 2) Populated Places--we could do some "histories" on these towns, tell some stories about them, what county they're now in, etc. 3) Cemeteries--we could include nearby cemeteries in other counties, & give names of our ancestors buried there, similar to what we've done with Walton cemeteries. I think this could be very beneficial to many of us, as the county did change so much. Give me some feed back--I can't do it without you! Walter, you are correct regarding the break in the Methodist Episcopal Church North/South. The Bishop was James O. Andrew b. 1794 and died 1871 who was bishop from 1832 until his death. The slave was Kitty Andrew Shell who was born in 1822 and died in 185?. Interestingly, Kitty Andrew Shell is buried in the family lot of the Andrews family in the Oxford Historical Cemetery in Oxford, Ga. Just a few miles from Monroe. The exact year of death is not clear and if anyone might have information regarding that date I would love to know. BTW: Any Stones from Walton County out there? Nancy (Stone) Brown
The new Barrow County Cemetery Book is a wonderful book. It also tells of the Formation of the County, Talks about the Old Nodoroc and The Ancient Temple,Indian Burial Grounds and List all the Revolutionary War Soldiers. The reason I listed the CAMP families that are buried there is because I am researching the Camp family. I am one of the Founding Members of the Piedmont Regional Genealogy Society which is now called "East Georgia Genealogy Society". Winder was in Walton County before 1914 when Barrow County was formed. Winder was called Jug Tavern. Winder was a town that was divided between Walton,Jackson and Gwinnett Counties. ~Tina~
