Mrs. Berryhill was the daughter of the late Mr. and Mrs. Cicero Isom Ray, was born in Calhoun, April 26, 1892, and had resided in Rome for 50 years. She moved to Rossville in 1969 to live with her grandson. She was a member of the Bluffton, Ala. Baptist Church and for thirty years owned and operated a grocery store and cafe in the North and West Rome area. She was preceded in death by her husband, William Sanders Berryhill, on October 4, 1942. Survivors include two sisters, Mrs. H. H. Holder, Atlanta, and Mrs. Nettie Beal, South Carolina; one half sister, Mrs. Rosa Lee Phillips, Miami, Fla.; one grandson, Arthur T. Guice, Jr., Rossville; and two great grandchildren. Funeral services will be held Saturday at 3 P.M. in the chapel of Jennings Funeral Home with Parnick Jennings Sr. officiating. Interment will be in the East View Cemetery. John's death certificate gives his birth date as April 14, 1877 and his name as John W. Smith. It confirms he died of a gunshot wound in the side of his neck and that the shot was fired by W. S. Berryhill in self defence. Birth information provided by his daughter Lillian Harris. Fathers name Milton Smith, mothers name Elizabeth Peak. It is unclear what John's middle name was. His death certificate as well as his obituary gives his name as John W. Smith, his tombstone has John E. Smith. I am unable to establish which is correct. John was not very tall, small in fact, he had dark hair and dark blue eyes and a long nose. His wife Roxy was quite a beauty and admired by all the gentlemen. John and Roxie was divorced about 1926 and about a year later Roxie married W. S. Berryhill. The following article was published in the Rome News Tribune, Wednesday July 12, 1933. SLAIN BY WOUNDED MAN _____________________ Came To Home Of Former Wife. Demanding Admission: Shooting Follows _____________________ A Gun Battle Resulted in the death yesterday of John Smith 56, and wounds which may prove fatal to W. S. Berryhill, 40, when the two engaged in a shooting scrape about 4:30 p.m. at the Berryhill home, 211 West Tenth Street. " I don't know why he did it. I guess he just tired of it." said Mrs. Berryhill, who explained that Smith, her divorced husband, had previously warned her that he would not permit her to marry anyone else after having divorced him. Mrs. Berryhill divorced Smith about seven years ago and married Berryhill about one year later. She stated that there had not been any trouble between them before the shooting took place. Smith appeared at the back door of the Berryhill home yesterday and demanded admission, according to Mrs. Berryhill. When her husband told Smith that there was some mistake and tried to persuade him to go away, Smith drew a pistol and began firing through the screen door at Berryhill, said Mrs. Berryhill. One bullet took effect in Berryhill's abdomen and another entered his left wrist. Berryhill went to get his gun while Smith opened the door and fired three shots at Mrs. Berryhill, who ran out of the house screaming for help. Berryhill came into the hallway with his shotgun and fired once at Smith, the charge taking effect in the right side of Smith's neck. The inquest, ordered by the solicitor general, was held this morning and a verdict of self-defense was given Berryhill. Police Officers Warren, Russell, and House investigated the case. Smith, a former Roman, was the operator of an Atlanta restaurant at the time of his death. Berryhill was formerly a railroad clerk. The two were almost strangers, and it is thought that the motive for the shooting was solely jealousy. Smith and Mrs. Berryhill's daughter, Mrs. Lillian Harris of Atlanta, with whom Smith resided stated that her father left Atlanta Tuesday morning, saying that he was going to visit his brother, George Smith, in Cedartown. Instead, he came to the home of another daughter, Mrs. H. H. Hendrick, of Rome. She stated that he left there about 3 o'clock yesterday afternoon. It is thought that he went from there to the home of his former wife. One report was that he had been drinking. It is thought there was a struggle after Berryhill came back to Smith with his shotgun, because when Smith was found, the flesh on his right hand between his thumb and forefinger was shot off, indicating that he was holding the muzzle of Berryhill's gun when it was fired. The wound in the neck which caused instant death, indicated that the gun was not more than twelve inches from his neck, it is said. Berryhill was picked up by a Jennings ambulance two blocks toward town from his home. Friends had assisted him in walking to that point. The ambulance was returning to town after having picked up Smith. Berryhill was taken to McCall hospital. Smith lived in Rome until two years ago when he moved to Atlanta. At one time he was a well known and prosperous merchant in Rome, having owned three stores here. Since his divorce it is said that he had experienced numerous losses. Surviving Smith are three daughter, Mrs. H. H. Hendrick, of Rome; Mrs. Rachel Guise, of Chattanooga, and Mrs. Lillian Harris, of Atlanta; three sisters, Mrs. Susie Mullinax, of Atlanta; Mrs. Sally Ausby, of Piedmont, and Mrs. Frances Tanner of Cedartown; and two brothers, J. Smith of Bluffton, Ala, and George Smith, of Cedartown. Funeral services will be conducted from the Salem Baptist church in Bluffton, Ala., the old family home, at 2:30 o'clock Thursday afternoon. The love triangle, which resulted in one death Monday afternoon, that of John Smith, is expected to develop into a double murder, as W. S. Berryhill, the present Husband of Smith's former wife, lies on his death bed in McCall, hospital as a result of wounds received when Smith, enraged with jealousy of his former wife, fired at him through the back screen door of his home, at 211 West 10th street. One bullet went into Berryhill's abdomen and another penetrated his wrist. Despite his serious injuries, he dragged himself through the hall leaving a rail of blood, went into his room, procured a shotgun and returned to the back of the house. By that time Smith had entered the door. A struggle ensued; Berryhill pointed the gun toward Smith, Smith grabbed the nozzle, but before he could push it away from his head, Berryhill fired. The bullet went into Smith's neck, which caused him instant death. The flesh on his right hand between the thumb and finger was completely blown off, where he was holding the muzzle. The gun was estimated to have been not more than twelve inches from the point of contact when it was fired. With the assistant of friends, Berryhill had staggered a distance of two blocks from his home, when a Jennings ambulance picked him up and took him to the hospital. His condition improved slightly for a few hours, but Thursday at 1 o'clock virtually all hope has been given up for his recovery, it is stated. He is expected to die at any moment. Smith was buried this afternoon at 2:30 o'clock in his old family home at Bluffton, Ala. He lived in Rome for many years and at one time was a prosperous merchant, owning owning three stores. He suffered losses following his divorce from Mrs. Berryhill some seven years ago, and two years ago he moved to Atlanta to live with his and Mrs. Berryhill's daughter, Mrs. Lillian Harris, at 85 Edgewood Avenue, S. W. He ran a restaurant on Edgewood Avenue. Mrs. Berryhill married Berryhill about a year after the divorce from Smith. She stated that Smith had warned her not to marry anyone else after their divorce. When he arrived at the house Monday she and Berryhill pleated with him to leave, but he would not. An inquest was held Tuesday morning, and a verdict of self-defence was given Berryhill. Rome News Tribune July 13, 1933. W. S. Berryhill, who was shot by his wife's first husband, John Smith, whom he killed in self-defence last Tuesday afternoon, is "holding his own" at McCall Hospital, it is reported today, although he is very low. He has been in a serious condition, having been shot through the abdomen and the wrist. He was operated on when he reached the hospital late Monday, and for the following twenty-four hours his condition was considered improved. Thursday, however he became very low and was expected to die at any moment. Berryhill lives at 211 West 10th street and was formerly a rail-road clerk. He is Forty years old. It is reported today Doctor's believe now that he will recover, although he was not expected to live a week ago.
