McClendon of said County and State, being of advanced age, but of sound and disposing mind and memory; knowing that I must shortly depart this life, deem it right and proper both as respects my family and myself, that I should make a disposition of the property with which a kind Providence has blessed me: I do therefore make this my last Will and Testament hereby revoking and annulling all others, by me heretofore made. 1st I desire and direct that all my just debts, if any, be paid without delay by my Executor hereinafter named and appointed. 2nd I give bequeath and devise to my beloved daughter Sarah M. Maples and Annis M. McClendon for their sole separate use as [ _ ] [ _ ]bodily heirs, not subject to the control or debts of any present or future husband all my property both real and personal of every description and kind whatsoever. Said property to be kept together it now stands and used for the mutual benefit of my two said daughters, unless Annis M. McClendon should marry: then and in that event all of said property to be sold by my Executor whether privately or publicly as may be deemed best by him without the expense of an order from the court and equally divided between my two beloved daughters above named, share and share alike, And should either of my beloved daughters die without child or children then that part of my [ _ ] belonging to the one thus departing this life to revert back to my [ _ ] and become the property of the one surviving and her children 3rd I desire and direct that if at any time after my death it should become necessary or thought advisable to sell any portion of the personal property of my Estate, that my Executor be allowed and [ _ ] to do so either privately or publicly as may be deemed best upon consultation with my daughters and that said sale be had without any order from the Court for that purpose. 4th I thereby constitute and appoint my beloved son in law W. H. Maples [ ? ] Executor of this my last Will and Testament this June 16th 1877 Wm. H. McClendon Signed sealed declared and published by Wm H. McClendon as his last Will and Testament in the presence of us the undersigned who subscribed our name hereto in the presence of said Testor at his special instance and request and in the presence of each other. This June 16th 1877 W. H. Redding C. F. Redding J. J. Harper Pike Court of Ordinary August Term 1877 Personally appeared in open court J. J. Harper and C. F. Redding two of the describing witnesses, who being duly sworn depose and say that they saw Wm. H. McClendon sign & seal and heard him publish and declare the within & foregoing instrument of writing to be and contain his last Will and Testament on the day and year the same [ _ ] and that he was of sound and disposing mind & memory at the time. That he signed the same freely and voluntarily in the presence of the subscribing witnesses: to wit C. F. Redding, W. H. Redding and J. J. Harper, That they signed the same as witnesses, at his request in his presence and in presence of each other on the day and year it purports to have been executed. C. F. Redding J. J.
