I Stephen J. Brown of said State and County being in feeble health of body, but of sound disposing mind and knowing that man is born to die; I have thought proper this day to make this my last will and testament, making the following distribution of what property the Lord has blessed me with in the way and manner following. Item first - I will that my body be decently interred to the earth from whence it came; and my immortal spirit to the blessed God who gave it in hope of eternal life. 2 Second - My will is that my Executor and Executrix herein after named should pay all my just debts. 3 Third - My will is that my Executor and Executrix shall take the charge of my whole Estate both real and personal, and keep the same together and manage the same for the benefit of my wife Susan H. Brown and for my children: Joseph L., Thomas M., Enoch M., Emily H.(?), Alice B., Martha F., and Eliza Ann and my wife being pregnant if she should have a child or children, from time selling and disposing of what they can raise on the farm to spare _?_ as much of the proceeds as may be necessary for the support and comfort of my wife and children above named; and especially to see that my children be liberally educated in the best conducted schools which my Executor and Executrix may have in their power; and I wish my wife to have all the tract of land whereon I now live containing five hundred and sixty some acres more or less during her natural life or her widowhood; but if she should marry my will is that she have a childs part of the land during her natural life then to revert to my children above named. 4 Fourth - My will is that when my children become of age or marry that they shall then be entitled to and shall draw an equal share of what my estate may then be, the balance remaining together until another child shall marry or become of lawful age then for them to receive an equal share; and the remainder to _?_ be thrown(?) together for following divisions to be made in like manner until all shall have received their equal share remembering that my wife have an equal share until(?) my children to remain with her as my widow but if she should marry before my children are of age or marry that she in that case will draw an equal or childs part except as before named about the land whereon I now live and in the above divisions given my child or children with which my wife is now pregnant and share in the same manner. 5th Fifth - My will is that my Executor and Executrix may sell any other land which I own not herein named and apply the proceeds to the benefit of my heirs and also buy and sell such things as may be needful and right to keep up the farm and for the good and comfort of my family. 6th Sixth - My will is that no difference be made between my children above named, or those that may be born of which my wife is now pregnant and whereas my Father in his last will made the following ( I give unto my grandson Horton Lindsey Brown son of my son Stephen J. Brown one Negro girl by the name of Harriet but if he should die during his minority she with her increase if any shall fall to the four living heirs of my son Stephen J. Brown). The above named Negro being of bad disposition I have sold her because if my oldest child was to fall heir to her under the above named will of my father , then and in that case I should have given said oldest child the value of said Negro Harriett less than I should have given to my other children and wife, but having sold her, I have thrown all together for an equal division by which the oldest child gets as much as if the said Negro Harriet had been specially named and given to my oldest child. 7 Seventh - Last I do hereby constitute and appoint by beloved wife Susan H. Brown my Executrix and my worthy friend Levin (?) Turner my Executor to this my last will and testament. Stephen J.
