Cauthen Oct. 24, 1917 - March 6, 2011 Milner resident Griffin Daily News Mr. William Dennis (W.D.) Cauthen Jr., 93. of Milner, passed away on Sunday, March 6, 2011, at Westbury Medical Care Center. Mr. Cauthen was born in Milner, Ga., on Oct. 24, 1917, to the late William Dennis Cauthen Sr. and the late Ella Harris Cauthen. Mr. Cauthen was preceded in death by his wife, Hazel Cook Cauthen. He was retired from the Georgia Baptist Children's Home in Meansville, a lifelong member of the Friendship Baptist Church, where he served as a deacon. Mr. Cauthen was a veteran of the United States Army, having served in World War II. Funeral services for Mr. W.D. Cauthen will be conducted at 11 a.m. Wednesday, March 9, 2011, in the chapel of Conner-Westbury Funeral Home. The Rev. Dennis Fowler and the Rev. Tom Dobson will officiate. Bankston, of Meansville, which was solemnized at the Druid Hills Baptist church last Saturday at one oclock with Rev. Louie D. Newton, pastor, performing the ceremony. Only close friends of the bride and groom and the immediate family of the groom were in attendance. Mr. Bankston is one of Pike Countys best known young business men, being half owner of the Holloway and Bankston Pimento Pepper Plant at Meansville and prominently connected in other business of the county.. Miss Milner, who formerly lived at Barnesville is known as a young lady of great charm and highly accomplished. She has resided in Atlanta for some time. Immediately after the ceremony Mr. and Mrs. Bankston left for a wedding trip to Florida and Cuba. They will be at home to their friends in Meansville after May 15. Mr. and Mrs. J.J. Pitts Dies Last Evening Mrs. Julia Reeves Pitts, wife of P.L. Pitts, one of the most beloved women in this section, died at her home, 303 North Ninth Street, Griffin, Wednesday night at 11 oclock following an illness of nine weeks. Death was attributed to heart trouble with which she had suffered for some time. Funeral services were held from the home Friday afternoon at 2 oclock. Rev. George D. Goddard officiated. Interment was in the family cemetery at River, Ga., with Haisten Brothers in charge. The following served as pallbearers: Barney Cox, Heywood Wright, Robert Plot, J.W. Smith, O.J. Blackmon and Jack Bowden. She is survived by five daughters, Mrs. O.J. Blackmon, Experiment; Mrs. John W. Smith, Lovejoy; Miss Estelle Pitts, Atlanta; Mrs. Jack Bowden and Mrs. H.S. Burtz, in Zebulon. The impressive ceremony was quietly performed in the presence of a few intimate friends. The bride was lovely in a pale blue crepe dress with other accessories to match. After a short trip to North Georgia the young couple returned to Zebulon to make their future home. Mrs. Yeager is the daughter of Mr. Henry Reynolds and the late Patia Hutchinson Reynolds. Rozilla "Rosa" Ann Swygert, was the daughter of Martha Madora "Dora" Nixon and her 1st husband, Morgan Govan Swygert, of Meriwether Co., Georgia. Dora and my husband's 2x Great-grandfather, Charles Bartow Nixon, were brother and sister. Their parents were Harrison H. Nixon and Elvira H. Elmore of Coweta Co., Georgia. A judgment in personam for temporary alimony and attorney's fees cannot be lawfully rendered in a divorce suit brought against a nonresident husband, who is not served with process within this state and does not appear in the case, but is only constructively served by publication. Hood. Judgment for defendant, and plaintiff brings error. Reversed. Mrs. Sallie Hood brought, in the superior court of Pike county, Ga., a petition for divorce against her husband, Frank E. Hood, who, the petition alleged, formerly resided In that county, but was then "a resident citizen of the state of Texas." It was also alleged in the petition that the defendant was a son of James Hood, deceased, who, plaintiff was informed, died intestate, leaving an estate of realty and personalty In Pike county; that Mrs. Rosa Hood was the duly qualified administratrix upon such estate, and that the defendant, as an heir at law of James Hood, would be entitled to a distributive share of such estate, when the same should be duly administered and ready for distribution. The petition prayed that the defendant be enjoined from disposing of or encumbering his interest in his father's estate, that the administratrix be enjoined from paying to him, or to any one for him, any portion of his distributive share in that estate, and "that a reasonable provision for permanent alimony be made for the support of plaintiff out of the interest and distributive share of said defendant in * * * the estate of James Hood." No process, however, was prayed against the administratrix, nor was she in any way made a party to the case. An order was passed by the judge that service be perfected upon the defendant, as a nonresident, by publication. This order was dated October 2, 1905. On April 2, 1906, at the April term of the court, the petition was amended by asking for $100 as counsel fees and "a reasonable amount as temporary alimony during the pendency of said suit." There was no appearance by the defendant in the case, but upon the same date that the amendment to the petition was allowed the judge, upon ex parte hearing of the application for temporary alimony and attorney's fees, "adjudged that the plaintiff have judgment against the defendant . . * for $20 per month, from this date, as temporary alimony," to continue while the case should be pending In court, and for $100 as attorney's fees. On September 20, 1906, the plaintiff procured the issuance of summons of garnishment, based upon this judgment and directed to the administratrix upon the estate of James Hood. The administratrix answered, admitting that she was indebted to Frank E. Hood, the defendant in the divorce proceeding, in a stated amount. This answer was traversed by the plaintiff, and at the April term, 1907, the issues in the garnishment case were by agreement of counsel submitted to the court without the intervention of a jury. The plaintiff introduced the record in the divorce proceeding, including the judgment for temporary alimony and attorney's fees, and other evidence. The court found that the administratrix had in her bands $400.29, as the defendant's distributive share in the estate of J. W. Hood, deceased, and ordered and decreed that the plaintiff recover from the garnishee $220. To this judgment the garnishee excepted, on the grounds that "Frank E. Hood was a resident of the state of Texas, as set out in the petition of plaintiff, that service was perfected on him by publication, that he made no answer and that the judgment against him was not a valid binding judgment, that his property could not be taken under it, as It would be doing so without due process of law," and that for these reasons the garnishee "would not be protected in paying over the money in her hands as administratrix, belonging to said Frank E. Divorce-Alimony-Judgment In Personam -Nonresident Defendant. A judgment in personam for temporary alimony and attorney's fees cannot be lawfully rendered in a divorce suit brought against a nonresident husband, who is not served with process within this state and does not appear in the case, but is only constructively served by publication. [Ed. Note.-For cases in point, see Cent. Dig. vol. 17, Divorce, § 591.] (Syllabus by the Court.) Error from Superior Court, Pike County; E. J. Reagan, Judge. Action by Sallie Hood against Frank E. Hood. Judgment for defendant, and plaintiff brings error. Reversed. Mrs. Sallie Hood brought, in the superior court of Pike county, Ga., a petition for divorce against her husband, Frank E. Hood, who, the petition alleged, formerly resided In that county, but was then "a resident citizen of the state of Texas." It was also alleged in the petition that the defendant was a son of James Hood, deceased, who, plaintiff was informed, died intestate, leaving an estate of realty and personalty In Pike county; that Mrs. Rosa Hood was the duly qualified administratrix upon such estate, and that the defendant, as an heir at law of James Hood, would be entitled to a distributive share of such estate, when the same should be duly administered and ready for distribution. The petition prayed that the defendant be enjoined from disposing of or encumbering his interest in his father's estate, that the administratrix be enjoined from paying to him, or to any one for him, any portion of his distributive share in that estate, and "that a reasonable provision for permanent alimony be made for the support of plaintiff out of the interest and distributive share of said defendant in * * * the estate of James Hood." No process, however, was prayed against the administratrix, nor was she in any way made a party to the case. An order was passed by the judge that service be perfected upon the defendant, as a nonresident, by publication. This order was dated October 2, 1905. On April 2, 1906, at the April term of the court, the petition was amended by asking for $100 as counsel fees and "a reasonable amount as temporary alimony during the pendency of said suit." There was no appearance by the defendant in the case, but upon the same date that the amendment to the petition was allowed the judge, upon ex parte hearing of the application for temporary alimony and attorney's fees, "adjudged that the plaintiff have judgment against the defendant . . * for $20 per month, from this date, as temporary alimony," to continue while the case should be pending In court, and for $100 as attorney's fees. On September 20, 1906, the plaintiff procured the issuance of summons of garnishment, based upon this judgment and directed to the administratrix upon the estate of James Hood. The administratrix answered, admitting that she was indebted to Frank E. Hood, the defendant in the divorce proceeding, in a stated amount. This answer was traversed by the plaintiff, and at the April term, 1907, the issues in the garnishment case were by agreement of counsel submitted to the court without the intervention of a jury. The plaintiff introduced the record in the divorce proceeding, including the judgment for temporary alimony and attorney's fees, and other evidence. The court found that the administratrix had in her bands $400.29, as the defendant's distributive share in the estate of J. W. Hood, deceased, and ordered and decreed that the plaintiff recover from the garnishee $220. To this judgment the garnishee excepted, on the grounds that "Frank E. Hood was a resident of the state of Texas, as set out in the petition of plaintiff, that service was perfected on him by publication, that he made no answer and that the judgment against him was not a valid binding judgment, that his property could not be taken under it, as It would be doing so without due process of law," and that for these reasons the garnishee "would not be protected in paying over the money in her hands as administratrix, belonging to said Frank E. She was born in Pike County, the daughter of the late J. B. (Bunt) Armistead and Stevie Brown Armistead of Zebulon. She was preceded in death by her first husband of 54 years, W. D. (Bill) Allen; siblings, Cleveland Armistead of Williamson, Dan Armistead and Jesse Armistead of Barnesville and Eula Wood of Commerce; nephew, Doug Armistead of Williamson; and her grandson, Josh Reeves, who was killed in action in 2007 while serving in Operation Iraqi Freedom. Mrs. Reeves was a graduate of Pike County High School. She attended business school and was employed as the first secretary of the Pike County Welfare Department that was opened in 1936. She was Clerk of the Pike County Selective Board until she closed the office at the end of World War II. She lived in Barnesville for 25 years where she and her husband opened and operated Allen's Cleaners and Laundry. They sold it in 1972 and moved back to Pike County. While living in Barnesville, she was active in the First Methodist Church, serving as Sunday School Teacher in the children's department and as Superintendent of the Children's Division for a number of years. During her retirement, she and her husband traveled extensively. After the death of her first husband, and at the age of 79, she married a former high school classmate, Leyman Reeves. She was a member of the Williamson United Methodist Church. Ruth was a charter member of the Pike County Historical Society and was very interested in her family history.

Yarbrough Died in Williamson Mr. R.H. Yarbrough, age 68, died at his home in Williamson Tuesday night, after being stricken on Monday afternoon with paralysis. Funeral services were conducted Thursday morning at Williamson Christian church, of which the deceased was a member, by the pastor, Rev. F.L. Adams. Burial was in the Baptist cemetery. F.S. Pittman, funeral director, in charge of arrangements. Mr. Yarbrough was a good man, highly respected by all who knew him. He had for many years been engaged in the mercantile business with his son, Mr. Clifford Yarbrough.
