Full Title: An Act to authorise Dr. J. J. M. Goss of Jackson, Baily White of Hancock, Manford J. Jones of Marion, Isaac H. Hall of Troup, F. N. Hardman of Fulton, B. H. C. Beman of Gordon, and all graduates of the Botanic or Medico Botanic School of Medicine to practice medicine in this State. 8. Section I. Be it enacted, &c, That Dr. J. J. M. Goss of Jackson, Baily White of Hancock, Manford J. Jones of Marion, Isaac H. Hall of Troup, F. N. Hardman of Fulton, B. H. C. Beman of Gordon be, and they are hereby authorised to practice medicine upon the Eclectic system as taught at Cincinnati, Ohio, and to collect and charge the usual fees. [Sidenote: Privileges extended to others] 9. Sec. II. And be it further enacted, That all graduates of the Botanic or Medico Botanic School of Medicine be, and they are hereby fully authorized to practice physic and all its kindred branches in this State, and charge for the same in the same manner as though they had graduated in any other School. [Sidenote: Graduates of Botanic School, &c.] 10. Sec. III. Repeals conflicting laws. Approval Date: APPROVED, March 5th, 1856. Additional Comments: Southern Botanico Medical College was established August 15, 1840 in Monroe County, Ga. The Botanico Medical movement's philosphy embraced the belief that ills should be treated with medicinal concoctions obtained solely from plant life, namely herbs, rather than the vegetable/mineral concoctions common at that time. Law Number: No. 21. Full Title: A resolution to pay pension of 1907 due to Newton Harris. WHEREAS, Newton Harris was on the disabled pension roll from Marion county and was due the pension of 1907 of fifty dollars; and [Sidenote: Pension.] WHEREAS, The pension to be paid to this class annually becomes due under the law the 26th day of October of each year, prior to the time the payment is made after the first of January of each year; and WHEREAS, Newton Harris died on the 24th day of December, 1906, after said pension to be paid in 1907 was due, and before payment could be made; and the ordinary in reporting death failed to give date to the Commissioner of Pensions, and his claim has not been included in the deficit appropriation to pay those unpaid for 1907: ------------------------------------------------------------------------------- - Page: 1005 Be it therefore resolved, That the sum of fifty dollars be, and the same is, hereby appropriated out of any money in the treasury of the State to be paid to the ordinary of Marion county to be by him paid to the funeral expenses and doctor's bill of the said Newton Harris as is now provided by law; and the Governor is hereby authorized to draw his warrant on the treasury for said sum. Full Title: An Act to incorporate the Newnan & Americus Railroad Company, and for other purposes therein named. Section 1. Be it enacted, etc., That Hugh Buchanan, W. B. Wilkinson, Tollerson Kirby, of the county of Coweta; John L. Dixon, Henry R. Harris, J. M. C. Robertson, of the county of Meriwether; Thomas A. Brown, Isaac Cheney, William A. Danill, of the county of Talbot; Martin L. Bivins, William Drane, J. L. Baker, of Marion county; John R. Respass, Isaac Hart, Seaborn Montgomery, of Schley county; W. W. Barlow, William J. Patterson, Moses Speer, of the county of Sumter, or a majority of them, are hereby constituted a board of commissioners for organizing the Newnan & Americus Railroad Company. [Sidenote: Corporators] ------------------------------------------------------------------------------- - Page: 351 Sec. 2. That the capital stock of said company shall be divided into shares of one hundred dollars each, and shall not exceed three millions of dollars. [Sidenote: Capit'l stock] Sec. 3. That the said board of commissioners is hereby required, when the sum of fifty thousand dollars shall have been subscribed to the capital stock of said company, to convene the subscribers to the same, or a majority of them, for the purpose of electing from their own number a board of five directors to manage and control the affairs of said company for one year, or until their successors are elected and installed, and said board of directors, as well as all other boards which may thereafter be elected, shall select from its own number a president, and have power to adopt by-laws for its own control, and to appoint and employ such officers, agents and servants as it may deem proper. [Sidenote: Election of directors.] [Sidenote: Of Presid'nt] Sec. 4. That at the election hereinbefore provided for, each subscriber to the capital stock of said company shall be entitled to one vote for each share subscribed by him or her, or which he may represent by power of attorney; and in all elections hereafter, each person shall only be entitled to one vote for each share of the capital stock of said company, which he or she may own, or represent by power of attorney, upon which twenty per cent. has been paid: Provided, That no one shall be excluded from voting if the twenty per cent. has not been called for. That when said board of directors shall have complied with the requirements set forth, and an election for a board of directors shall have been held as provided for in section third of this act, the books of subscription to the capital stock of said company, together with all other books and papers appertaining to the business of said company, shall be turned over to the board of directors, and the functions of said commissioners shall cease and determine. That whenever the subscribers to the capital stock of said company shall have convened and elected a board of directors under the provisions of section third of this act, they, or their associates and successors, shall be deemed, held and considered a body corporate and politic, under the name and style of the Newnan & Americus Railroad Company, with perpetual succession, and all the rights, powers, privileges and liabilities common and necessary to such a corporation, and the organization of said company, shall be complete. [Sidenote: Name and style.] [Sidenote: Succession.] Sec. 7. That said company shall have power to construct, maintain, equip and use a railroad from Newnan, in Coweta county, through Greenville, Talbotton, Buena Vista, Ellaville, -- , to Americus, in Sumter county; to accept, purchase, have, lease and convey any property, real, personal or mixed, and to erect such buildings and shops, operate such machinery, and do other things as it may deem proper for its advantage and benefit. [Sidenote: Special powers.] Sec. 8. That in all cases where a question of the right-of-way arises, and the company cannot agree with the owner or representative of the land upon which it is proposed to enter, the work ------------------------------------------------------------------------------- - Page: 352 of the company may proceed as if there was no disagreement; but in such event, the Sheriff of the county in which said land is located, at the request of either party, shall summon a jury of five disinterested freeholders of said county, who shall assess the damage to be paid by said company, after being sworn to take into consideration the enhanced value of said land from the building of said road, and to do justice between the parties, and the finding of said jury shall be final and conclusive against both parties: Provided, Each has received from the said Sheriff ten days' notice of the time and place of meeting of said jury, and neither party shall appeal to the Superior Court in ten days thereafter. [Sidenote: Questions of right-of-way -- how adjudicated.] Sec. 9. The right-of-way of said company shall not exceed two hundred feet in width. [Sidenote: Width.] Sec. 10. That said company shall have power to receive land in payment or part payment of the subscriptions to its capital stock at such valuation as may be agreed on, or may be assessed by three freeholders, under such rules and regulations as may be adopted by it, and to mortgage, lease, sell or otherwise dispose of said land, as shall be deemed most advantageous to its interest, and said lands, so received in payment or part payment to the capital stock of said company, shall be free from taxation so long as the legal title thereof remains in said company. [Sidenote: Subscriptions -- how paid] [Sidenote: Taxation.] Sec. 11. That the Governor of the State be, and he is hereby, authorized and required to indorse the bonds of said Newnan & Americus Railroad Company, upon the same terms and conditions upon which he is authorized and required to indorse the bonds of the Georgia Air-line Railroad Company, which terms and conditions are set forth in an act to loan the credit of the State to the Georgia Air-Line Railroad Company, and for other purposes, approved September 21st, 1868; and it shall be the duty of the Governor of the State to give to the said company the benefit contemplated in said act so soon as said company shall have placed itself in the condition required by said act. That the said Newnan & Americus Railroad Company shall not sell any bond or bonds upon which may be indorsed the guarantee of the State for less than ninety cents in the dollar. Frances Brooks of Marion county, and widow of Robert Brooks having died intestate, possessed of an estate worth about twelve hundred dollars, which estate was inherited by her husband Robert Brooks, and Robert Brooks having left a daughter by a former wife, who is unable to support herself, and the said Frances having no heirs at law that are known, [Sidenote: Preamble.] 6. SECTION I. The General Assembly of the State of Georgia do enact, That if no demand is made for the estate of the said Frances Brooks, by any heir or heirs legally entitled to the same, within the time now prescribed by law, the whole of the estate of said Frances Brooks, shall go to, and absolutely belong to Martha Brooks, daughter of Robert Brooks, deceased. Johnson, of Marion county, a valiant and worthy Confederate soldier, made application to the Commissioner of Pensions for the indigent pension provided by law, and filed his application with the commissioner, fully establishing his services as such soldier on September 21, 1904; and, WHEREAS, The physician making the examination of the applicant ------------------------------------------------------------------------------- - Page: 1149 failed to fill out the blank properly, it was sent back for amendment, this held him off the pension roll for 1905; and, WHEREAS, When this amendment was made and returned to the commissioner, it showed his condition to be such that he could not make a living by manual labor; so the commissioner returned it to the ordinary of Marion county, with the suggestion that the physician should also state that the applicant could not make a living in any other way than by manual labor; and, [Sidenote: Pension of J. H. Johnson.] WHEREAS, The physician amended the application fully, showing applicant to be entitled to be enrolled, but said application was misplaced in some way by the ordinary, so that it reached the commissioner too late to be enrolled for 1906; and, WHEREAS, The said J. H. Johnson has now been fully approved and enrolled on the pension list for 1907; and, WHEREAS, His failure to be enrolled for 1906 is due to no fault or condition of his, but to an oversight of the ordinary; and, WHEREAS, The said J. H. Johnson is very old and feeble, being too weak to work or to earn a living in any way, having to be supported by charity; therefore, Be it resolved by the General Assembly of Georgia, That a pension of sixty dollars be paid to the said J. H. Johnson for the year 1906, and that the Governor of this State be authorized to draw his warrant on the Treasurer of this State for the same. Approval Date: Approved August 21, 1906. Hollis and the heirs-at-law of Jacob A. Clements, both of Marion county. WHEREAS, Henry N. Hamilton was duly elected Tax Collector for the county of Marion in the year 1863, and at each successive election since; and WHEREAS, said Henry N. Hamilton has gone on from year to year without having a settlement of his account with the State; and WHEREAS, no full and complete settlement of his account was ever had until December, 1873; and WHEREAS, upon said settlement, said Henry N. Hamilton proved to be in default for the sum of two thousand dollars; and WHEREAS, said deficit was not the default of said Henry N. Hamilton for one year, but for a series of years, running through his term of office; and WHEREAS, said deficit is about to be visited upon the sureties of said Hamilton, who signed his last bond; and WHEREAS, said loss ought to be sustained by the former sureties, according as said deficit occurred; and WHEREAS, said sum, by the promptness of his present sureties, has been reduced to six hundred dollars; and WHEREAS, one of said sureties has died, and one has applied for, and had set apart, a homestead of realty and exemption of personalty; and WHEREAS, the whole of said loss is about to fall upon one of said sureties, assisted by the estate of said Jacob A. Clements; and WHEREAS, said sureties should not, in good conscience, bear any other or further burthen than they obligated; for remedy whereof, [Sidenote: Preamble.] § 11. SECTION I. Be it enacted, etc., That, from and after the passage of this Act, that the execution issued against Henry N. Hamilton, Tax Collector for Marion county, and his sureties, John F. Section 1. Be it enacted, That Warren Battle, and his associates and successors, are hereby constituted a body politic and corporate, by the name of "The Tazwell Cotton Manufacturing Company," for the purpose of manufacturihg cotton and vending the same, and for such purposes may erect buildings, procure machinery and put into operation the process of manufacturing the staple of cotton under the name aforesaid; sue and be sued, plead and be impleaded, appear, prosecute and defend in any Court of law or equity whatsoever in all suits and actions; may have a common seal, and the same alter and renew at pleasure, and may enjoy all the privileges incident to corporations, and may purchase, hold, mortgage, transfer and convey real and personal estate. [Sidenote: Corporators, style, purposes and powers of.] Sec. 2. And be it further enacted, That the said Warren Battle shall have the privilege of opening books of subscription, and when the sum of fifteen thousand dollars shall have been subscribed, an election shall take place for the election of such officers as in the opinion of the stockholders may be necessary to carry on the objects of this act, and at the first election each stockholder shall be entitled to cast as many votes as he owns one ------------------------------------------------------------------------------- - Page: 126 hundred dollar shares in said Company, and the same rules and regulations shall govern all elections for officers in the future until the rules shall be changed by a vote of a majority. "She looked very well in a traveling dress, but all eyes were centered upon the groom. He wore a dark suit that fitted his form perfectly and in his dainty gloved hands, he carried a small rose. His curly hair was beautifully done, and a delicate order of hair oil of the best quality floated down the aisle as he passed. The young people will miss him now that he is married. He is loved by all for his many accomplishments, his tender grace and his winning ways. The bride commands a good salary as bookkeeper and the groom will miss none of the luxuries to which he has been accustomed. A crowd of pretty men saw him off at the depot. LOCAL AND PERSONAL Mrs. Rogers Williams has returned home from Athens. Mr. Victor McMichael, of Putnam, had business in Ellaville yesterday. Col. C.R. McCrory made a trip to Dawson this week on legal business. Miss Lucy Baldwin after a pleasant trip to Atlanta has returned home. Miss Imogene Sears has returned to Faceville, where she will again take up her duties as Music teacher. Mrs. A.J. Hill, Mrs. A. Wall and Miss Ruth Wall did shopping in Americus. Col. W.W. Dykes, of Americus, attended Ordinary's Court here Tuesday. Miss Mary Hornady and mother, of Dawson, are the guests of Mrs. T.R. Strange at Andrew Chapel. Mr. John Shriver, of Americus, was in Ellaville Wednesday on business interest. Mr. and Mrs. R.W. Edwards are here before going to their winter home in Florida. Mrs. E.L. McGowan and children left for home at Jacksonville Wednesday night, after a stay of several weeks with Mrs. L.H. Peacock. Messrs. A. Allen, J.F. Woods, P.Z. Hill and Brad Teel went as representatives of the W.T. Black Camp to the Confederate Reunion at Athens this week. Mrs. A.C.Murray is making her niece, Mrs. H.B. Brawner, a visit at Buena Vista this week. Miss Alberta Dozier, of Atlanta, and Miss Emma Dozier, of Augusta, arrived yesterday and are the pleasant guests of their mother, Mrs. M.E. Dozier. Mrs. A.J. Walters made a visit to Americus this week. Mrs. George Chipley, of Columbus, spent this week with parents here, Mr. and Mrs. E.S. Baldwin. Mrs. John Lightner and Mrs. Emmett Clements spent a few hours in Ellaville Thursday afternoon, coming thru from Buena Vista with Mr. C.B. Johnson in his machine. The "Old Timers" have arranged to have an all day singing at the Baptist church on next Sunday. Invitations have been sent out to quite a number of the lovers of the Antebellum songs and responses have come announcing that they will be on hand with their Sacred Harp. There will be no dinner on the ground, but ample provisions will be made whereby the citizens of our town will entertain all who come. EXCHANGED HANDS The Ellaville Trading Co., buys the Ellaville Telephone Exchange. The deal was perfected on last Tuesday morning between Mr. Charlie Pickard, the former owner of the exchange, and members of the Ellaville Trading Company. The price paid was $4200. Be it enacted by the Senate and House of Representatives of the State of Georgia, in General Assembly met, and it is hereby enacted by the authority of the same, That from and immediately after the passage of this act, John Mathews, his heirs and assigns, are hereby vested with the privilege of keeping a ferry across Flint River, in the county of Crawford, on his own land: Provided, the said John Mathews, his heirs and assigns, do keep a good ferry flat for the conveyance of passengers, and give due attention to said ferry; and that the said John Mathews have the right to demand and receive the same rates of toll as are allowed to other ferries on Flint River. Sec. 2. And be it further enacted by the authority aforesaid, That Mary Wanamaker and Slaughter Hill, be, and they are hereby, authorized to keep a ferry across Flint River, in the county of Marion, on their own land, respectively, and that they be allowed the same privileges as are allowed to John Mathews, in the first section of this act. Sec. 3. And be it further enacted by the authority aforesaid, That all laws and parts of laws militating against this act, be, and the same are hereby repealed. Here is the meaning: A writ of fieri facias commands a sheriff to take and sell enough property from the person who lost the law suit, to pay the debt owed by the judgment.
