You may not be aware that there is no specific law in the state that allows someone the right to access cemeteries on private property. However, it is the position of the Department of Natural Resources that under the state's common law, rights of access are indeed granted. Yet this is vague and can be easily challenged, perhaps even ignored, by the property owner. I know, because I am having a problem like this right now, trying to access an old cemetery where my ancestors are buried. The property owners refuse to allow me access to the graves to see them or to begin maintaining them, mark them properly, etc. I have contacted an attorney to try to resolve the situation, and it could prove costly. I do not want someone else to have to go through what I have. This is primarily a problem in rural areas. There are cases of old cemeteries on timber land and other areas, and there have been cases where the timber companies will not give specific access either--they basically take a "dont ask, dont tell" position if one wishes to access a graveyard. Basically, the issue is becoming very confusing. Who has responsibilty of such cemeteries? Abandoned cemeteries are protected under state law, which requires local government to take responsibility for them. However, once someone has "claimed" an abandoned cemetery to be the burial place of their ancestors, then it's not abandoned anymore, now, is it? This is where the law becomes tricky. Therefore, I have contacted my state legislator about amending the Cemetery Preservation law to include specific direction and language that allows someone with legitamate claim to a family cemetery previously abandoned to be allowed access to maintain it. It would clear up much confusion and allow for people to be able to preserve thier family history without interference. I have gotten verbal support from such groups as the Cobb County Cemetery Preservation Commission, the Georgia Society of Professional Archaeologists, and the Georgia Trust for Historic Preservation. However, I need further support from those interested from a geneological point of view. If anyone knows of a Georgia geneoloical group interested in having such an amendment passed, please let me know. Grandparents and I have found them at home this morning in a cousin's publication entitled: Richardson: Daniel - John - Littleberry 1790 - 1996 With Childs - Morgans - Deans by Jesse C. Richardson. Library of Congress Catalog Card Number 97-73509. Willoughby L. Richardson's parents were Mesia Gilba Richardson, Sr. (b. 1824) and Mary Ann Mathison. And, I have Ida Overby's (her birth date Oct. 10, 1857, Webster Co., GA) parents: Benjamin Mitchell Overby and Lucy C. Seay. I hope this last paragraph is helpful to you. Let me know. Pat Jones Smith BRIDGETON MEMORIAL PARK Bridgeton, Missouri 1843 -------- 1963 This burying ground at 4616 Long Road was made into a memorial park in 1962. In 1959 several lawsuits were filed against the City for allowing the cemetery to deteriorate. Individual stones had already been removed "through error and misunderstanding" but members of the Bridgeton Historical Commission were able to learn the names of some who were buried there and a large monument was erected in 1963 which bears this inscription, "We honor the people buried here. They were part of this nations adventure and their vision lighted the path we follow today." At the dedication ceremonies, Mrs. Anna Wilson gave a talk about colored veterans who are buried here. Records indicate that the cemetery was integrated from its beginning in 1858. It was in use as late as 1954 and at least 100 people are buried in the two acres.     3. Hi all After the Civil War how were slaves given their freedom in Irwin County? Was their a State of local County Proclamation freeing the slaves after the 13th Amendment? Was their an application process to obtain freedom by the owner or slave? Were slaves given property from the owner? Where would official documents be located for that County (Irwin/Burke)? What reference material would you recommend? If anyone has info on the Dorminey's, does "The Dorminy-Dorminey Book" mention anything about the people that lived on their property? Or any info on person property Tax for Slaves? Or any Slaves that were mentioned in Dorminy Estate/Wills? Or any previous slaves that were under contract after 1865. I am looking for documentation to trace my ancestor (Summer Gibbins/Givings/Givins/Givens) to his last slave owner. I have found his Amnesty Oath (Summer Gibbins, Aug 20, 1867) in 3rd/15th Senatorial District, Irwin County, Ga (GDAH). I have also found Summer and his family (Catherine "Katy"; Wilby; Eave; Rose; and James) living on/next to J. B. Dorminy in the 1870 Census for Irwin County, Georgia. J. B. Dorminy/Dormany/Dorminey was a wealthy business/land/slave owner(1850/60 Slave Schedule) and Senator and Representative from the 3rd/15th Congressional District in Irwin County, GA. He died 12/6/1878. I suspect that Katy (40) was a slave of J.B. or Mrs. Dorminey in 1860 Irwin County Slave Schedule. However, I have also found a "Summer, Sr. and Summer, Jr. in the Inventory and Appraisement of a wealthy land owner, Allen Inman (1806 - 1858) and Ave Murphree Inman Estate (Inman Homestead 2050 Acres, McGruder Place 3000 Acres, and Haislip Land 69 Acres) in Burke County, GA. Both, Summer Sr. and Summer Jr., was awarded to his youngest daughter, Indiana Inman (Jeremiah Inman and Malcolm Jones-Guardians), while other slaves were awarded to the wife, Ava, and to his married daughter and her husband, Virginia L. Inman Jones and Malcolm D. Jones (1/2 owner of McGruder Place) in the division of the Estate in 1861. Two entries for "Summer" (1851 and 1858) are also found the in the Afrogenias Slave Bills of Sale Collection- Slave Data website (Bark Camp Baptist Church Membership List, Burke County, GA). I can't seem to find the microfilm record for that Church so I can check the actual membership list. I have been unsuccessful in finding information on Dorminy and Inman Plantation holdings, but I have found the Dorminy and Inman family genealogy site; however, the family historians/custodians of those sites state that they have no interest in records containing slave holdings or plantation records. I know that the Freedman's Bureau provided transportation to some freemen to reunite family members, but I don't have any documentation on the Waynesboro or Ocilla Office (Augusta District Office) that transportation was provided to Summer to transport him from Burke to Irwin County, GA.
