Matilda Ashley of said state and county, being of sound and disposing mind and memory, do make this my last Will and Testament, hereby revoking all Will heretofore made by me. Item 1. I will that my nephew J.B. Ashley have in money, Five Hundred Dollars and thirty six cents in cash that I have placed with him, free of interest during my natural life. Item 2. I will that after my death. J.B. Ashley, my nephew is to have Four Hundred and Fifty Dollars and thirty six cents in money. Item 3. I will that ny neice Mary Furlow is to have fifty dollars in money. Item 4. I will that Mrs. Mary Ashley and Miss Willie Ashley, wife and daughter of J.B. Ashley to have all of my beds, and bed clothing and wearing apparel of every description. Ashley shows that on the 29th of December 1908 Hariet Matilda Ashley, late of said County, departed this life, after having made and published her last Will and Testament, in which no executor is named. Petitioner shows that the following named persons are the heirs at law of said deceased, to wit: Mrs. Ann Screws of Carroll County, GA P.O. Item first: It is my will and desire that whatever debts I may owe shall be paid as soon after my death as practicable. Item second: It is my will and desire that after the settlement of my just debts as provided in item first, that all the property both real and personal that I may own and possess at the time of my death, shall remain for the benefit and support of my wife Mary M. Hardigree and such of my children by my said wife as remain unmarried at the time of my death. And that all my estate aforesaid shall be kept together for this purpose during the life of my said wife Mary M. Hardigree. But if in the judgement of my said wife it should at any time become necessary either for the support of herself and such of my children as remain unmarried and living with her as aforesaid, or for the benefit of the estate, she may sell or dispose of such of the personal property as she may deem best. Item Third: It is my desire that at the death of my said wife that all the real estate as aforesaid and such of the personal property as may remain, shall be equally divided among all of my children by my said wife or in case of the death of any of said children, then their ? representatives shall take per stirpd?? in lieu of such deceased children, share and share alike. But it is understood to be my desire that each of my said children and their legal representatives in case of death of any of said children shall first account for any indebetdness that they or either of them may owe the estate. Hightower State of Georgia, Heard County Signed: July 1892 Filed Oct 26, 1899 I, John D. Hightower, of said state and county, being of sound and disposing mind and memory, so make this my last will and testament. Item 1st. Having heretofore given to my wife Mary C. Hightower twenty four acres of land off of the North half of lot of land number two hundred and seventy nine in the north district of originally Carroll but now Heard County, GA as evidenced by a deed of gift which I made and delivered to her on the sixteenth day of January in the year of our Lord one thousand eight hundred and ninety two which deed was attested by W. F. Hill and W.S. Darrington, J.P. I now, in addition thereto bequeath and devise to her the said Mary C. Hightower the following property to wit: All of my livestock such as horses, cows, hogs, sheep or goats and all fowls which I may own or possess at my death and also all of my household and kitchen furniture and also all my wagons, buggies or vehicles of any kind and to be ?? explicit. I give and bequeath her all of my personal property of every kind or sort whatever and also all money that I may own at my death. Hightower, J.H.S. Williams and Dewey Walls or his wife S. C. Walls said sixty acres, more or less of land to be divided by three disinterested and impartial men one of whom must be chosen by I. F. Hightower served in the Civil War as a PVT Co. I 41st GA Inf. CSA, Heard County Rangers; he enlisted March 4, 1862, was captured at Vicksburg, MS on July 4, 1863; paroled from there on July 6, 1863; was shown on muster rolls with his regiment as present on Dec 31, 1863. John D. Hightower applied for an Mexican Wars pension in 1887 (ref. index of Mexican war pension applications - - pension Number C7247 (2-16-1887) Buried at Caney Head Methodist Church Cemetery in Heard County, Georgia (ref: Heard County, GA Cemeteries book, listed as John D. Hightower) Note: Appears from his Will, filed in Heard County, Georgia, that John D. Hightower remarried after the death of his first wife Roseanna. As he was of advanced age (presumably), it is thought that he did not have any children with the second wife. Excerpt from an article in the book "Memoirs of Georgia", publ. 1895: " John Dickerson Hightower, farmer, Rockdale, Heard Co., GA, son of Henry R. and Tempie (Ray) Hightower, was born in what is now Campbell County, GA in 1825. His father was born in Pennyslvania and about the year 1800 migrated thence to Georgia and settled in Oglethorpe County. his conveyance was an old time ox cart with wooden wheels, the frame being put together with wooden pins and hickory withes. He cleared a farm and commenced farming, but after some years moved wo what is now Campbell County and engaged in farming until his death, which occurred in 1857. Mr. Hightower was raised on the farm, on which he worked and attended school at a little log school house until nearing maturity, since when many years of his life has been interestingly eventful. At the age of nineteen he ran away from the home to join an expedition against Mexico, and enlisted in Company C, Capt. W.T. Wofford, in Calhoun's Cavalry Battalion. He did scout duty during the entire war, and went as far south as the penisula of Yucatan, where he was wounded in the right thigh by a lance in the hands of a Mexican. In 1848 he returned to his home in Campbell County but did not stay long. The next year he joined a company of gold hunters, started for California and shipped from Mobile to go via Cape Horn. After a long and rough and tedious voyage he reached the alleged land of promise, only to meet with sad disappointment. After spending several months in fruitless search for the precious metal, he found himself impoverished, and decided to return home. A sympathizing friend loaned him money for the purpose and the early fifties found him at the plow handles on the old homestead. In 1852 he moved to Heard County where he continued farming with satisfactory success. When the civil war was precipated in 1861 he enlisted in Company K 41st GA Reg., participating in it's engagements. At Perryville, Kentucky, he received a wound which disabled him temporarily, and he was sent home. At the end of sox months he returned to his command, and at the battle of Baker's Creek was again wounded but continued in the field. After the surrender, he returned, penniless and homeless to Heard County. He went to work as a farm hand and worked and lived hard until he got a start, when he bought a piece of land and went to farming on his own account. Working hard, and early and late, and living frugally, he had placed himself in easy circumstances. He owns a good farm, has all that he craves in the matter of a good homne and plenty, and a comfortable bank account. No citizen of the county stands higher. Mr. Hightower was married soon after his return from California to Miss Rosiana, daughter of Joshua and Polly (Wallace) Teal, who has born him six children, only two of whom, Isom J. and Benjamin F., are still living. Deponent further swears that she was the wife of said deceased soldier during his term of service in the Army; and that she has never married since his death; that she became his wife on the 10th day of November 1850; and that she has resided in Georgia continuously since January 1869; that Georgia is her home, and was such on the 23rd day of December 1890, and since said date she has not lived in any other state or locality. Deponent as the widow of said deceased soldier husband applies for the pension provided by Act of the General Assembly of Georgia approved Dec 23rd 1890 for the pension year ending Feb 15th 1892 and herewith tenders the proof of her right to receive the allowance granted by said Act. That said soldier enlisted in the service of the Confederate States on or about the 25th day of February 1863; That while in said service or by reasons of said service in the Army he lost his life as follows: He was shot and killed in battle in Atlanta GA on 22nd day of July 1864 and was buried in Atlanta GA by J.E. Garrett and other soldiers of Co. F 25th Regt Ala Vols. at that time under General Hood. We further swear that Mrs. Susan Hester was the wife of said soldier during the service and that she has not intermarried since his death and that she resides in Heard County of the State of Georgia. That she was born in Newton County, Georgia. Deponent swears that she was the wife of said deceased soldier during his service as a soldier and that she has never married since his death aforesaid; that she became his wife in the year 1850. That Georgia is her home and she resided in this State the 23rd day of December 1890 and has not lived in any other State or locality since that date. B of the 10th Regiment of Alabama Volunteers Hillard's Legion Brigade and was honorably discharged in April 1865; that whilst engaged in such military service in the line of duty in the State of Illinois in 1863 he was disabled or wounded at follows: While in the winter of 1863 he was captured by the enemy and carried to prison at Rock Island Ill. He there remained in prison for nineteen months and there contracted Rheumatism and he came home a great sufferer from said disease and it has wrecked his whole system, he now suffers continually with said disease and has all the while since the war. Buchanan, personally known to me to be trustworthy citizens, each of whom, being duly sworn according to law, severally say under oath that they are personally and well acquainted with Allen Hester whose application is herewith presented for a pension, that he has resided in this State continuously since the Winter of 1848, that he served in Co. B of the 10th Alabama Confederate Calvary Hilliards Brigade and from our personal knowledge while in the line of duty was injured by the service as follows: In the winter of 1863 he was captured by the enemy and carried to prison at Rock Island Illinois and there remained in prison for nineteen months and was roughly treated and fared bad and he there contracted rheumatism and after his discharge from prison he suffered continually with said disease. And since then it has wrecked his whole system. It causes him increased pain which is very severe and he cannot sleep at night. He can't exponse himself in rain or cold and has not sufficient strength or use of his limbs to hold out to work or plow or do anything that causes effort, exertion or strength. The muscles in limbs contracted and the same has wrecked his whole system and he suffers incessant pain which is very severe when he exerts himself at labor or exposes himself in bad weather. So you are going to have try other sources, though none will be quite as official. I just received the CSA widow's pension file for Elizabeth A. (Davis) Freeman, widow of Eli Jackson Freeman. In it she states she married E. J. Freeman in 1867 in Randolph Co., AL (Heard's neighbor and also courthouse fire victim). So maybe something like that. Good Luck, Valerie

Simms State of Georgia, Heard County I, William M. Simms of the State and County above stated, being of sound mind and advancing in age, do make and ordain the following my last Will and Testament: Item 1st. After the payment of my lawful debts it is my will that my wife Elizabeth C. Simms shall have and hold as her own during her natural life the lands whereon we now live and reside on the Chattahoochee River, said lands containing Five Hundred and Seventy five acres more or less. Also it is my will that my said wife Elizabeth C. Simms shall have, own and control as her own individual property my stock, horses, hogs, cattle, sheep, mules, plantation tools, wagons, carts and every other thing pertaining to my farm. Also all of my household and kitchen furniture. Item 2nd. It is my will that my wife E.C. Simms may dispose of as she may think proper one third of the houdehold and kitchen furniture. Item 3rd. It is my will that my wife have one thousand dollars to be paid over to her by my Executor or Executors out of the first money collected on of my estate. Item 4th. It is my will that my daughter Carmella A. Echols and her children have one thousand dollars to be paid to her by my Executors, said thousand dollars to be controlled by my daughter C.A. I hereby appoint my beloved wife Elizabeth C. Estep of said county, being of sound and disposing mind and memory, do make this my Last Will and Testament, revoking any and all others that I have heretofore made. Item 1. It is my will and desire that by body be buried in a christian like manner, the place and details I leave to my daughter Virginia Lou Estep. Item 2. It is my will and desire that all just debts be paid as soon as practical after my death, if there be any. Item 3. It is my will and desire that at my death that all of my property both real and personal whatever kind it may be go to my daughter Virginia Lou Estep to be hers during her life provided that she never marries.
