    2. Donna, Goodness sakes! I sure didn't mean to cause a problem! I won't post the requests to the list until I get written permission. But, anyone can still write to me privately and get a look up. (Do you think that is OK to do?) Neda

I am speaking from the Hall County Genweb page view now which is part of Georgia Genweb. It says I can't list lookups without a permission slip. If I don't abide by the Genweb rules then they can unlink me and ask me to remove the USgen and Gagen logos from my page. However, the Mail list is a Rootsweb project - not USGenweb http://helpdesk.rootsweb.com/help/mail3.html says **** "To join a list, follow the directions for subscribing. 1. Re: [GAHALL] Hall County
    2. Donna, I disagree. I am on several lists that do look ups. There has never been anything said about it. Besides, listing some of the names from that book will certainly not come near posting the whole thing. Just to try to satisfy the situation, I will try to contact someone and get permission. In the meantime, my email is [email protected] aol.com in case anyone wants to contact me directly. Neda

    2. Donna, That is the book. I agree that I would need written approval. I cannot go to Hall County. I live in Virginia. Thanks for looking into this for me. And, if anyone needs a look up for these years, I would be glad to help. Neda

    2. Judy and everyone, Yes, the copyright rules are confusing. But, I did get the same thing from it as you just stated. I was hoping that I was wrong on that! Looks like I can just fill requests for names and let it go like that. Thanks to all of you for helping out. Neda

    2. Thank you Dan. You should have by now received a copy of the request to transfer the message board. It usually takes about 24 hours. I changed the mail list addres and password, tried to log in under the old password and got an oops so you should have received the password for the maillist. I notice you didn't say mail me a kitten. All my females, cats and dogs are neutered, but I have some neighbors whose aren't. To all the Hall County list members who don't know, Dan has been one of the largest contributors to the Hall County Website. He makes those great maps. He also is the admin for the Lumpkin County page. If you haven't checked out Lumpkin County, you should do it now http://www.rootsweb.com/~galumpki/ Donna

    2. Donna, the URL for the guidelines is: www.usgenweb.org/volunteers/copyright.html It's really almost the same as writing a term paper or whatever for publication. Use your footnotes and cite the sources.

If a specific name is requested for a look up can the results be posted without breaking copy write laws? Helen >> http://www.usgenweb.org/volunteers/copyright.html Read and then click on The USGenWeb Project Lookup Permission Statement -- What is needed from the copyright holder. The new rules for the webpages say "The only way to protect The USGenWeb Project as a whole, and each of us as participants in the project, is to remove all lookup offers for which you do not have written permission or have not determined that the source is in public domain and, therefore, requiring no permission." The general rule in the past was quoting one or two references, for example two gravestones or marriages was acceptable. It keys on whether you are damaging a person's ability to make a profit from their labor. I am not an attorney but I think it would be wise not to post to the list without a permission slip. I realize that genealogy books are expensive and many times do not have anything on what we are searching for. If you can't or won't buy the book, I recommend borrowing it on inter-library loan. Maillists are archived. I recommend only publishing lookups from books published before 1923. Lookups from Original Records are acceptable. For example: If I look in Garland Bagley's History of Forsyth County, Georgia Volume I on page 143 and quote "no. 1 appraised 7th Sept 1836 Rans Bird Harris, a white man, Chattahoochee River...." I might be violating his copyright. If I reach in my file cabinet and take out my original typed copy of my transcription from the microfilm of Valuations -( Mine would probably be filed under microcopy number) it would still read: "1 appraised 7th Sept 1836 Rans Bird Harris, a white man, Chattahoochee River...." I know because Garland used my original transcriptions. The second is my original work. Donna

    1. Re: [GAHALL] Hall County
    2. I would say yes you can post lookups if the source is given. The guidelines say that quotes from a source may be used as long as that source is given credit. When quoting paragraphs, the guidelines say keep it to about 100 words. Even better, paraphrase it (put it in your own words). They discourage volunteers doing lookups and posting all of one surname. Posting a few names is okay. I think the question here is whether you can copy the whole book and post it to the Web. That is a no-no unless you have the author's permission or the copyright has expired.

    1. [GAHALL] More on Copyright
    2. You have seen me place the Forsyth County Marriages A-D by Bonnye Leary on the Forsyth page. Bonnye Leary is my mother. I saw her abstract the marriages from a microfilm copy of the original books. Any that were not decipherable we checked at the Probate Judge's Office This was a book she and Garland were doing together (he did E thru H ) and I have the original transcription sheets in my possession as well as the typeset copy for the printer. The Historical Society has the other typeset copy which was given to them by Garland Bagley's heirs. The pages were typed at the same time as the Cemetery Book and the Census Index Book. These were copyrighted 1981. My mother lives next door and I have her permission. Donna

    2. In a message dated 3/28/02 2:26:18 PM Eastern Standard Time, [email protected] writes: << I read the copyright rules but still come away empty handed. >> If this is the book you are talking about Hall County Georgia Marriage Records 1819 - 1932 1985, by Frances T. Ingmire, 10166 Clairmont Dr., St Louis, MO 63136. It says published 1985 From the page: "The Current Copyright Law - Since Jan. 1, 1978, everything an author (including you and me) writes is protected by copyright the minute it is written. " "Copyright protection under the 1978 law extends for the rest of the author's life and an additional 50 years beyond it." If Frances T. Ingmire has been dead for 50 years then you are probably safe. If not then to put it on the webpage, I would need the permission form signed by the author and/or the heirs If you want to go to the Hall County Courthouse or to the microfilm and transcribe them yourself from the original records then I could post them as your original work, but I would want an affidavit to that effect.
