Thanks to all who answered my question. It was greatly appreciated. I take it that when the ad litem guardian appeared in court at the probate that he was dismissed from his duties because it said further service waived. To the person who sent us the list of legal terms and explanations, many thanks. I have seen so many documents from the courts in Georgia and I had no idea what some of them meant. for instance in Dodge County a book is listed as poney sched book the instrument is listed as poney sched. Book # 1 page 30. Whatever could that mean? Thanks again for all of the help. Emma

Emma, Yes, that is how it is spelled. It literally means "guardian at law." In today's usage, a GAL is someone appointed by the court to represent the best interests of a child during legal proceedings. Today a GAL is usually appointed in situations such as contested custody proceedings, in adoption proceedings, or when a child is a dependent of the state. It is not a guardian in the sense that the GAL can make legal decisions for the child, and the GAL does not represent the child's wishes the way an attorney would for a client. The GAL would investigate what is going on and make a recommendation to the court based on what he/she felt was in the best interest of the child. Theoretically a GAL could be appointed for an incapacitated adult, too, assuming state law provides for it. The language you quoted just means C.M. Dowdy was served with notice that the will of J.R. Dowdy was going to be probated. Dowdy be fined in the sum of ten dollars and three dollars cash of this proceeding and in the event he fails to pay said fine and cash it is ordered that he be imprisoned in the common jail of Dodge County five days and then discharged.
