Deed Book 23 Page 3&4 Mrs. Catherine Bates to Mrs. Rosena Bates Towns ET AL State of Georgia, County of Clarke: This indenture, made and entered into this the 31st, day of July, 1917, between Mrs. Catherine Bates of the County of Clarke, State of Georgia, as party of the first part and her children Mrs. Rosena Bates Towns, Mrs. Flora Bates Williams, Mrs. Lee Bates Tucker, Mrs. Cleo Bates Smith, Will Bates and John Bates, all of the County of Clarke, State of Georgia, as parties of the second part. Witnesseth: That the said Mrs. Katherine Bates for and in consideration of the love and affection she bears for her children aforesaid and for the further condideration of One Dollar, cash in hand paid at and before the sealing and delivery of thes presents, the receipt wherof is hereby acknowledged has granted, bargained, sold, aliened conveyed and confirmed and by these presents does grant, bargain, sell convery and confirm unto the said parties of the second part to-wit: Mrs. Rosena Bates Towns, Mrs. Flora Bates Williams, Mrs. Lee Bates Tucker, Mrs. Cleo Bates Smith, Will Bates and John Bates, their heirs and assigns, the following described property to wit: "All that tract or parcel of land lying within the corporate limits of the Town of Whitehall, County of Clarke, in the 217th, District G.M. on the North side of the Public road leading from the City of Athens to the Georgia Factory containing 5/10 acre more or less bounded as follows: On the West by the lands of the Georgia Manufacturing Company, better know as the Royster lot on the North side by lands of Wm. Bates estate, on the East by lands of Wm. Bates Estate on the South by the Public Road leading from the City of Athens to the Georgia Factory and more particularly described as follows: - Beginning at a Rock corner on the North side of the said road and running in a Northerly direction 120 feet to a rock corner thence in an easterly direction 82 feet to a rock corner thence in a Southerly direction 129 feet to a rock corner; thence in a Westerly direction down said road to the beginning corner. Said lot to be used as a Burial lot or cemetery by the parties of the second part". To have and to hold the said described property, with all and singular the rights, members and appurtenances thereunto appertaininng, to the only proper use, benefit and behoof of the said parties of the second part to-wit; Mrs. Rosena Bates Towns, Mrs. Flora Bates Williams, Mrs. Lee Bates Tucker, Mrs. Cleo Bates Smith, Will Bates and John Bates, their heirs and assigns, in Fee Simple; and the said Mrs. Catherine Bates the said described property unto the said Mrs. Rosena Bates Towns, Mrs. Flora Bates Williams, Mrs Lee Bates Tucker, Mrs. Cleo Bates Smith, Will Bates and John Bates, their heirs, executeers, administrators and assigns, and against all and every other person or persons shall and will warrant and forever defend by virtue of these presents. In withness whereof, the said Mrs. Catherine Bates has hereunto set her hand and affixed her seal and delivered these presents the day and year first above written.
