I don't know which Tumlin it was but the other person was Arthur Haire, brother to my 2Great Grandfather. Linda Atkins

    1. [GABARTOW] Georgia Cemetery Laws-Rights of Access
    2. Greg & Winn
    3. Forwarding to the lists I am own that most likely would be interested in this. I hope it is not improper to do so since I feel this is genealogy too. A couple of the cemeteries I have surveyed are on private property and certainly not being taken care of right here in Thomas Co too. Winnette ----- Original Message ----- From: "Jones, Brad" <Bjones@JJG.com> To: <GA-CEMETERIES-L@rootsweb.com> Sent: Monday, October 02, 2000 11:12 AM Subject: [GA-CEM] Georgia Cemetery Laws-Rights of Access Hello Cemetery list subscribers: I am undertaking a project and am looking for some help, on what I think is an important issue regarding the preservation of historic cemeteries in Georgia. You may not be aware that there is no specific law in the state that allows someone the right to access cemeteries on private property. However, it is the position of the Department of Natural Resources that under the state's common law, rights of access are indeed granted. Yet this is vague and can be easily challenged, perhaps even ignored, by the property owner. I know, because I am having a problem like this right now, trying to access an old cemetery where my ancestors are buried. The property owners refuse to allow me access to the graves to see them or to begin maintaining them, mark them properly, etc. I have contacted an attorney to try to resolve the situation, and it could prove costly. I do not want someone else to have to go through what I have. This is primarily a problem in rural areas. There are cases of old cemeteries on timber land and other areas, and there have been cases where the timber companies will not give specific access either--they basically take a "dont ask, dont tell" position if one wishes to access a graveyard. Basically, the issue is becoming very confusing. Who has responsibilty of such cemeteries? Abandoned cemeteries are protected under state law, which requires local government to take responsibility for them. However, once someone has "claimed" an abandoned cemetery to be the burial place of their ancestors, then it's not abandoned anymore, now, is it? This is where the law becomes tricky. Therefore, I have contacted my state legislator about amending the Cemetery Preservation law to include specific direction and language that allows someone with legitamate claim to a family cemetery previously abandoned to be allowed access to maintain it. It would clear up much confusion and allow for people to be able to preserve thier family history without interference. I have gotten verbal support from such groups as the Cobb County Cemetery Preservation Commission, the Georgia Society of Professional Archaeologists, and the Georgia Trust for Historic Preservation. However, I need further support from those interested from a geneological point of view. If anyone knows of a Georgia geneoloical group interested in having such an amendment passed, please let me know. I plan to meet with my legislator in Mid-November so any help or suport will be appreciated. Thank You. If anyone wishes to contact me you can call me at work or at home at 770-901-9731. Pat Jones Smith BRIDGETON MEMORIAL PARK Bridgeton, Missouri 1843 -------- 1963 This burying ground at 4616 Long Road was made into a memorial park in 1962. In 1959 several lawsuits were filed against the City for allowing the cemetery to deteriorate. Individual stones had already been removed "through error and misunderstanding" but members of the Bridgeton Historical Commission were able to learn the names of some who were buried there and a large monument was erected in 1963 which bears this inscription, "We honor the people buried here. They were part of this nations adventure and their vision lighted the path we follow today." At the dedication ceremonies, Mrs. Anna Wilson gave a talk about colored veterans who are buried here. Records indicate that the cemetery was integrated from its beginning in 1858. It was in use as late as 1954 and at least 100 people are buried in the two acres. On the bronze plaque of the monument are the following names: Annie Adams Auston Edwards Enoch Mumps Edward Walker Benjamin Adams Auston Edwards, Jr. Elio Phillips Kit Walker George Adams Grace Edwards Eliza Phillips Lizzie Walker Lottie Adams Katie Edwards Ike Phillips Quiller Walker Ben Alexander The Galliger Family Tilly Phillips Tommy Walker George Alexander Almiria Grannison Walter Phillips Barbara White Henry Alexander Creed Hall Bell Pruitt John White Lucy Alexander Creed Hall, Jr. The Pueroa Family Noah White Eugene Allen Hillard Hall Fred Riddle Shibina White Arthur Bassett Hiram Hall James Robertson Alice Wilson Dr. William Berry Jack Haggerty Will Rush Ernest Wilson Febie Bivens The Heidron Children Baron Scott Geroge Wilson George Bivens Lizzie Hodge Louise Scott Theodore Woodson Lizzie Bivens Steve Hodge Lydia Scott Baby Woolfolk Millie Bivens The Horn Family Laura Smith Hadley Woolfolk Rafe Bivens Nasrus Jackson Roberta Stanton Gibson Wright Samuel Bivens Amy Johnson Lewis Stevenson Hiram Wright Cosley Black George Johnson Fred Steward Mamie Wright Edward Black Julia Johnson Henry Stocker Green Young Hiram Black Robert Johnson Joseph Taylor Mary Ann Young King Black Turner Johnson Abe Thompson Skip Young Sam Balck Mr. Knight Henry Thompson Bell Carter Henry Lewis Hiram Thompson Lilly Cheeks Hal Lint Jenny Thompson Henry Clanton Luvenia Lint Mamie Tucker Fred Dickson The McClure Family Barney Vonsray Joe Duglas, Jr. Jessie Moore Texas Hall Wadlington This list was given to me by The Missouri Historical Society P.O. 1. [GABARTOW] BLAYLOCK
    2. I am trying to determine who were the parents and ancestors of Charles M. Blaylock and Philadelphis Kelly. Charles was b. 1780 (according to his tombstone) in NC and d. April 17, 1870, Sebastian Co., AR. Philadelphia was b. 1785 in SC and d. 1862, Sebastian Co. Their children were Isom, William Matthew, Milton, Philadelphia, Mary Ann, Lucinda, James Leander, Francis Marion, twins Helena Elsma and Parina, and twins John and Alfred Newton Blaylock. Charles had a brother, John Blaylock, b. ca 1810, NC and d. 1843. Macon, GA. He m. Margaret Neal on Nov. 26, 1832 in Rutherford Co., NC. She was b. ca 1810 and d. ca 1860. Before 1850, she brought her nephew, William M. Blaylock (Charles' son) to Sebastian Co., AR. John and Margaret's children were Betsy E., Edward D., Lucy Jane, Matthew Gibson, and Blainey Ann Blaylock. Buckner Millington Blalock and Nancy Ann Clark were NOT the parents of my Charles M. Blaylock. They did have a son named Charles but he was b. July 15, 1806, Edgefield Co., SC, d. Jan. 18, 1835, same, m. Prudence McDaniel. My Charles had a brother named John, their's did not.
