There are two types of Guardianship - person and property...If a Parent died intestate, the surviving parent might have no need to get Guardianship of the minor childrens' person, however the children would inherit a Property Estate, wherein the Widow would need to get Guardianship of the Estate in order to use the proceeds for the Minor children's support...If the person did not name a Guardian of their Minor childrten in the Will, the Adminsitrator would need some kind of Court order to place the Minor children with someone else...
