The Appomattox Society Dedicated to the 28,231 soldiers of the Confederate States of America who were there at Appomattox Courthouse with Robert E. Lee. These men found it within themselves to stay and fight for "Marse Robert" when the Confederacy was failing, their friends were deserting and their families were imploring them to comeback home. Unto this end, The Appomattox Society was formed to honor these men and their descendants. Ever faithful, they received the now famous General Order No. 9 From General Lee, stacked their arms, picked up their few meager belongings and headed to what days before had been a separate country, now again a state in the United States of America. The Appomattox Society consists of lineal and collateral descendants of the men who stayed and received their paroles at Appomattox Courthouse, Virginia, April 10 - 15, 1865. Persons of any age or gender, who can show lineage back to one of these soldiers, are eligible to join the society. The hope is to collect biographical information on every man that surrendered at Appomattox and put it into a database where it can be researched by anyone wanting to find out more information on the men that were there. After numerous requests from persons whose ancestors were paroled after Appomattox, we have agreed that any person who can show lineage to a confederate ancestor that was paroled after Appomattox shall be eligible for full membership in the Appomattox Society. We will, in turn, profile these men in our newsletter also. This includes the soldiers who surrendered with Gen'l Joe Johnston near Greensboro, N.C., soldiers who surrendered with with Gen'l E.K. Smith at New Orleans, soldiers who surrendered with Gen'l Stand Waite in Texas, and other soldiers who can show parole on or after 9 April, 1865. The society is also open to all descendants of men who were captured and held until after the surrender. http://www.appomattoxsociety.org/

Hi, I have read wills where the husband stated the estate was to be sold at his death. That would mean that the widow would have to buy it because she did not own it jointly with her husband. Other persons may have been named in a will as the guardian of minor children. Women were not thought to be capable of caring for business in those days. Mary

There are two types of Guardianship - person and property...If a Parent died intestate, the surviving parent might have no need to get Guardianship of the minor childrens' person, however the children would inherit a Property Estate, wherein the Widow would need to get Guardianship of the Estate in order to use the proceeds for the Minor children's support...If the person did not name a Guardian of their Minor childrten in the Will, the Adminsitrator would need some kind of Court order to place the Minor children with someone else... Probate Records are a great source for information... >From: "Dee Thompson" <d7777@worldnet.att.net> >Reply-To: GA-ROOTS-L@rootsweb.com >To: GA-ROOTS-L@rootsweb.com >Subject: Re: [GA-Roots] Question re Guardianship and Estate Sales >Date: Mon, 21 Jun 2004 12:07:56 -0400 > >Claudia, >The probate court can require that everything be sold and the proceeds >become part of the estate. Thanks Dee and Jimmy. There was a will and property was left to individual family members yet they still had the estate sale. I believe Dee is correct about the family not reaching an agreement... Especially knowing "Mr. Dee" is an attorney...(grin) Don't tell him I said that Dee. Thanks again claudia

This is still the law today. Same scenario if the wife died without a will and had owned property in her own right. In the event of no will, legal heirs, including the widow, often bid on the assets. The money they paid was put into a fund controlled by the administrator with the court as "overseer". Because there was no will and all property legally belonged to the husband, this was the only way that a widow could keep any of the property, including even her bed clothes. That is unless she owned property in her own right, which was probably something she had inherited or which was given to her directly. Same with other legal heirs. By law, the father was the only legal parent/guardian of his and his wife's children. The wife had no legal standing regarding her own children until she applied for and the court granted her guardianship of her and her deceased husband's children. And that's just the way of the law was carried over from England. Hope this helps a little. Jimmy
Claudia, The probate court can require that everything be sold and the proceeds become part of the estate. Usually that is required by an administrator when the family cannot reach an agreement as to who gets what. Dee For details on the reference sources used for lookups, refer to this link: http://www.rootsweb.com/~ncbladen/lookups.htm ----- Original Message ----- From: <CannadyGal1@aol.com> To: <GA-ROOTS-L@rootsweb.com> Sent: Monday, June 21, 2004 12:00 PM Subject: [GA-Roots] Question re Guardianship and Estate Sales I have a similiar question. Why did they have estate sales in which you see the family and neighbors purchasing items BUT you also see the WIDOW buying back household belongings? I know it was not to pay off debts as one relative had a very large estate. And the widow had to apply to be guardian of her own children??? thanks for any help, claudia ==== GA-ROOTS Mailing List ==== Faye Dyess fdy@comcast.net Listmanager Thou shalt read thine own message thrice before thou sendest it.
