First, to answer Pat Stark's query "What's a Tithable" (in Loudoun Co. in particular) - Prior to 1787, households in VA were taxed based on the head of the household, the no. of horses, mares, colts, mules one owned. In October 1786, a law was passed which mandated the 1787 personal property assessments include: (1) an accounting of the name of every white male Tithable Over 21 Years; (2) the number of white males between 16 & 21 years; (3) the no. of slaves over 16 & those under 16 yrs.; (4) a listing of their horses, cattle & carriages; (5) also the names of all persons to whom Ordinary Licenses and Physician's Licenses were issued. In Volume 3 of "The 1787 Census of Virginia", compiled by Netti Schreiner-Yantis and Florene Speakman Love (in 3 volumes), the following Fultons are listed (under "List A", p. 27): (1) Robert Fulton: Charged w/Tax--self - 4 horses, mules, etc., 10 cattle (no males 16-21; no blacks above 16 or under 16) (2) David Fulton: Charged w/tax-Robert Fulton (nothing listed under the other columes. (3) Robert Fulton: Charged w/tax-self (nothing listed under other columes). (3) Hugh Fulton: Charged w/tax-self - only shows 3 horses, mules, etc.; 3 cattle. Fultons listed under "List C", p. 57, Personal Property Taxes, 1787: (1) William Fulton: Charged w/tax--John Daniel In a book titled "Tithables, Loudoun Co., VA 1775-1781", edited & published by Ruth & Sam Sparacio, McLean, VA (Fairfax Co., VA), The Antient Press - 1992, Vol. III: "A List of Tythables for Shelburne Parish taken by Thomas Lewis 1775 (pp 776-782)" {I assume these pages refer to actual pages from the recorded taxes}: p. 4 - Robert Fulton, David Fulton -- 2 (listed this way throughout the book) "Tythables taken by Wm. Douglas 1775 (pp 783-787)": p. 6 - Hugh Fulton - 1 "A List of Tithables taken by Thos. Repress (pp 1318-1319)" (no date shown): p. 29 - Robt. Wilcox, Robt. Fulton, David Fulton -- 3 (all listed on same line - not sure what this means) "List of Tythables taken in Feb. 1777 (p. 808-820)" (no name shown): p. 35 - Robert Fulton, David Fulton -- 2 "William Doughty's List No. 2, List of Tythables taken in 1779 (p. 896-904): p. 65 - Robert Fulton & son -- 2 Hugh Fulton - 1 "Loudoun Co. List of Tithables for Shelburne Parish 1780 taken by Simon Triplett (pp 954-986)": p. 82 - Robert Wilcox -- 1 Robert Fulton, David Fulton -- 2 {this time Wilcox is shown on a separate line from the Fultons} To Dave Van Doren -- The will of Robert Fulton (1763-1841) {dates from the marriage records as recorded in the Charles Blair Tavenner Collection} -- his will was proven in court May 10, 1841, "by oaths of George Richard and John Janney, the subscribing witnesses thereto... and on the motion of William Fulton the Executor therein named who qualified as such and with M. C. Shumate and David P. Fulton his securities..." (I made a copy of the will from the Will Book Z, p. 414-416, located at the Circuit Court in Leesburg. If you do not have a copy and would like one, let me know (with a mailing address). As to the "Charles Blair Tavenner Collection", I was told yesterday by one of the librarians at the Balch Library in Leesburg, that he had donated his collection of genealogy material to the Virginia Archives in Richmond, VA and staff of the Balch Library had photocopied the books for their library. She said that in one of the books he explains that he researched will books, property records, tax lists and marriage records in the Loudoun Co. courts to obtain his information. As soon as I have a full day to devote to the task, I will check the marriage records at the courthouse and see if I can find any more information that will distinguish the various David & Robert Fultons from each other. There is a will (which I copied earlier) for a Robert D. Fulton (1848-1933) [Will Book 3X, p. 256-257, Loudoun Co., VA]. The will was written June 15, 1921; he wrote a codicil March 25, 1930 (p. 257), and the will was proven in court July 10, 1933 (one record shows that he died July 4, 1933). His codicil stated that "after my debts and funeral expenses are paid and before my estate is divided into five portions, as therein directed, I hereby direct the payment of $3,000.00 to Arthur J. Pierpoint of Paeonian Spring, VA". [Note: Massie Pierpoint apparently died prior to March 25, 1930 when he wrote the codicil leaving her share to her husband- his executor also.] When the Court Clerk recorded the Fiduciary Account, (typed copy), he listed it as: "Arthur J. Pierpoint, Executor to estate of Robert B. Fulton, dec.," -- another error on the part of a clerk - the will was also a typed record and shows "I, Robert D. Fulton of Round Hill, Loudoun County, Virginia..." (approx. 8 miles sw of Leesburg). He appointed Arthur J. Pierpoint as Executor. A list of heirs was recorded on page 254-255 (Fiduciary Book 18), in the Fiduciary Account, presented to court Nov. 16, 1933 (and a list of heirs was also recorded on p. 258 of Will Book 3X and shows their relationship to Robert D. Fulton). He doesn't mention any children or a wife in the will. His list of heirs were: (1) A. J. Pierpoint of Paeonion Springs, VA (also near Leesburg); (2) Mary James, Sarah Mock, Malinda James - sisters, (all of) Hamilton, VA; (3) Lula Fulton Cooper and Mary Fulton Higdon, both of Herndon, VA} Robert's nieces -- daughters of John Israel Fulton, (Robert's brother); (4) Lillian Fulton Allder of Bluemont, VA, Massie Fulton Pierpoint} daus. of Charles Edgar Fulton, (brother to Robert) -- (Massie was also wife to Arthur J. Pierpoint); (5) J. A. Pierpoint, Edgar W. Pierpoint} grand nephews -- sons of Massie & A.J. Pierpoint of Paeonian Springs, VA. In the marriage records copied by Mr. Tavenner, he shows that: (1) John E. Fulton (b. Penn.) 1817, d. Loudoun Co., VA 1873; m. 1840 Massie (Massa) Warner (1821-1918), dau. of Israel Warner (this info is also listed in a genealogy of the Warner family of Loudoun Co. in the Balch Library) [no record of who his father was]. There is a will for John E. Fulton (WB 3D, p. 244 and inventories), also a will for his wife Massa Fulton recorded in WB 3X, p. 90 - I did not copy these wills. Children of John E. & Massie Warner Fulton (according to Tavenner): (2) John Fulton (Jr.??) (1842-ca 1862) - killed in Civil War (2) Charles Edgar Fulton (1844-1915); m. 1873 Charlotte Ellen Hope (1845-1914), dau. of John A. Hope; (3) Massie Fulton (1883-1921), m. Arthur J. Pierpoint, Paeonian Springs, VA (4) J. A. Pierpoint (4) Edgar W. Pierpoint (3) Lillian Grace Fulton (1881-1964) m. 1911 Joseph Thos. Allder (3) Hattie Lee Fulton (1874-1910) m. (unknown) (3) Myrtle Alice Fulton (1882-1915) (2) John Israel Fulton (1846-ca. 1933) m. 1876 Susan Cooksey (1851-?), dau. of Wm. Cooksey; (2) Robert D. Fulton (1848-1933) - no wife shown (2) Malinda (Linnie) Fulton (1851-1934) m. George Wm. James (1852-1954) (2) Sarah A. Fulton (1853-1934) m. 1877 James E. Mock, Hamilton, VA (2) Mary W. Fulton (1855-1938) m. 1879 Frank James I believe Pat Stark mentioned in one of her reports (correct me if I am stating this wrong Pat) that no one could find the will of Hugh Fulton of Loudoun Co., VA, because it was filed under a William Cox's name in the court records. In a book of "Deed Abstracts of Loudoun Co., VA (1757-1762)" compiled & published by Ruth & Sam Sparaco, McLean, VA; there is listed (p. 13, Deed Bk. A, p. 110-114) "Indenture...3rd October 1757...Wm. Cox of County of Orange in Province of North Carolina and Benjamin Grayson of County of Prince William, VA....original deed dated 8 November 1841 and registered in Lib. E. Fol. 383 - Wm. Cox & Cathron (x) Cox (sic). Just noted this as another example of the connection between VA Fultons and others in NC.
