E. Evans, of near Phroso, and a woman of the same neighborhood were arrested some weeks ago, charged with living in adultery. Evans came to Alva, gave bond for appearance before the grand jury, secured a marriage license and returned home and marred the woman; this the couple thought would settle the trouble, but somebody pushed the matter before the grand jury and had them both indicted. The indictment charged them with having lived for some time in "open and notorious" adultery, but Evans employed Attorney Jesse J. Dunn to look after his case in court and Jesse called the court's attention to the fact that the statutes didn't mention any particular king of adultery, hence the indictment should be quashed and Judge Pancoast so ruled.
