SOMMERVELLl Brothers of Kendal, leather merchants and boot manufacturers against Mr. Thomas KENNING , 91 Lord Street, Liverpool, boot manufacturer for an injunction against defendant to stop him from marking his boots in a similar fashion to plaintiff's trademark. The plaintiffs are registered proprietors of a trade mark consisting of a single capital letter K enclosed in a geometric figure. Plaintiff claim they had sold boots so marked and the boots were known as K boots or waterproof K boots and that defendant had been advertising boots called waterproof T-K boots of which he was the sole maker.
