AND EAST CUMBERLAND AND WESTMORLAND NEWS. NO. 440 - Ninth Week in Quarter Registered for Transmission ABroad. SATURDAY, FEBRUARY 28, 1874. PRICE 1D. ____________________________________________ PERILOUS POSITION AND NARROW ESCAPE. The captain and crew of the Norwegian ship' Magnet ', of Moss, CAPTAIN NONDRUM, 915 tons, for Liverpool with pitch pine, were rescued on the 15th Feb. from a very perilous position. On the 13th, in lat. 47 29 and long. 30 W., she was caught in a hurricane and thrown upon her beam ends, the deck load was washed adrift, and the poop bulkheads, pumps, and windlass smashed. On the main and mizen masts being cut away, she righted, but began rapidly to fill, and in two hours had 9 ft. of water in her hold. Soon afterwards the decks and beams burst upwards, and the crew took refuge in the foretop, where they remained till 2 p.m. on the 15th, the sea washing completely over the vessel. At this time she was discovered by the ' Saga ' of Picton, from Jamaica for orders. The Saga immediately lowered her lifeboat, from which a line was thrown to the almost exhausted men, who were hauled on board the boat, and afterwards hauled in the same manner on board the Saga, the sea being too rough for the boat to live alongside. The boat was ultimately swamped, but all hands were saved. _________________________________________________
AND EAST CUMBERLAND AND WESTMORLAND NEWS. NO. 440 - Ninth Week in Quarter Registered for Transmission ABroad. SATURDAY, FEBRUARY 28, 1874. PRICE 1D. _____________________________________________ The Hamburgh American steamer Thuringia, from New York, arrived at Plymouth, with New York papers containing accounts of a general rising of Sioux Indians. A telegram from Wyoming states that near Fort Laramie, two officers were murdered. Their bodies, when found, were scalped, riddled with bullets, and stuck with arrows. COLONEL BULLOCK reports that he saw a large party of Indians on the Upper Crossing of the Horse-shoe Creek, singing and dancing a scalp dance. The Sioux are reported as raiding in almost every direction, burning ranches, murdering ranchmen, and stealing stock. A company of cavalry left for Potter Station on the Union Pacific Railroad where the Indians have been driving in the section men and stealing stock from the Red Cloud Agency. News was brought that FRANK APPLETON, acting Indian agent, had been murdered by the Sioux, and the same night fourteen mules were stolen from the Government freighter within three miles of the agency. At the White Clay Agency the Indians have driven off the herdsmen. Troops have been telegraphed for, and the greatest excitement prevails. A large fire was seen in the direction of the Red Cloud Agency. The rising appears to be general. SERGEANT HOWARD, from the Spotted Tail Agency, writes that several large war parties from both agencies have left, and he fears that all the Indians will commence hostilities. COLONEL SMITH also reports that the flour issued to the Indians they throw away, and that their year's supply of beef has been so wasted that it will be exhausted next month. Troops are scouring the country in all directions. Calls for mass meetings have been issued in the papers, to express indignation at the Indian policy pursued by the Government. _________________________________________________

Hi - and a happy festive season to you all! The Cumbrian CASCAT. The Cumbrian archives are in the middle of a massive move out of the Castle to somewhere else. I have never used CASCAT but would assume that all the info that they have on their site would also be on the National Archives site. Try info@cumbriacc.gov.uk. Someone there should be able to help you- they have been really helpful helping me with a very difficult family!!!! AND EAST CUMBERLAND AND WESTMORLAND NEWS. NO. 440 - Eighth Week in Quarter Registered for Transmission ABroad. SATURDAY, FEBRUARY 21, 1874. PRICE 1D. _____________________________________________ Two well-dressed men have been apprehended by the police at Penrith, on a charge of obtaining money by false pretences from MR. DENT, of Flass House. It appears that the men, driving a pony and conveyance, had called on MR. WELSH, of Leck Hall, near Kirkby Lonsdale, wishing to sell telescopes. From there they went to Underley Hall, where they saw the EARL OF BECTIVE, and endeavoured to obtain money from him on the plea that one of them was an optician at Lancaster, and had got into difficulties. The earl declined, and the inspector of police at Kirkby Lonsdale reported the matter to the authorities at Appleby. Inquiries were made, when it was found that the delinquents had visited Flass House. Introducing himself as MR. ROBINSON, of Warcop, and mentioning gentlemen of his acquaintance there, one of the men told MR. DENT that his companion was an optician in Kendal, who was in difficulties, having to meet a bill for £250 in a few days. MR. DENT thereupon gave them £5. They were soon afterwards apprehended at Penrith, and were remanded until to-day. The names they now give are JOHN WILSON, optician, Manchester, and JAMES THOMPSON, labourer, Huddersfield. They state that the pony and conveyance were hired in Manchester. _____________________
AND EAST CUMBERLAND AND WESTMORLAND NEWS. NO. 440 - Eighth Week in Quarter Registered for Transmission ABroad. SATURDAY, FEBRUARY 21, 1874. PRICE 1D. _________________________________________________ CUMBERLAND ASSIZES / NISI PRIUS COURT - Wednesday (Before MR. BARON AMPHLETT.) There were 6 civil causes set down for trial, but none of them are of any interest to this district. DOBSON v. BREW - SEDUCTION. This was an action brought by the plaintiff GEO. DOBSON, fishmonger, Whitehaven, to recover from the defendant, THOMAS BREW, shoemaker and clogger, of the same town, damages which he had sustained by the loss of his daughter's services, by reason of her seduction by the defendant. MR. C. RUSSELL, Q.C. and MR. THURLOW appeared for the plaintiff, and MR. ASPINALL, Q.C., and MR. BRUCE for the defendants. After the opening statements of plaintiff's counsel, the first witness called was LIZZIE DOBSON, the daughter of the plaintiff, who said she had known the defendant since the 23rd of August, 1871. She knew the date, because she put it on a piece of paper. They kept company till July, 1872, when they quarrelled; but on the 15th October, 1872, they came together again and kept company. He seduced her on the 6th of November, 1871, having often promised her marriage. After BREW knew she was about to become a mother, he asked her to go to DR. BONAR's to ask for some medicine, for an improper purpose. He gave her £5. She went to DR. BONAR. She told him what condition she was in and who had sent her. DR. BONAR said he durst not give her anything, and he gave her nothing. Had never known DR. BONAR up to that time except that he was assistant to DR. HENRY their family doctor, and nothing improper ever took place between them. BREW said he would get something; and he subsequently did so; but she did not take it. BREW wanted her to go to DR. BONAR's on the 14th of February. He taxed her with intimacy with that gentleman, and drew a knife across her throat. Under his threats she said she had been with DR. BONAR; but it was not true. In March, BREW again cast imputations upon her, and drawing out his pocket knife, threatened to stab her. She would not repeat the false admission which she had made before. She afterwards heard that while this interview took place, there was a man named WATTLEWORTH within hearing in another room. (Cross-examined): Witness firmly denied the imputations about DR. BONAR's intimacy with her. She denied having paid frequent visits to his lodgings, or ha**** gone to the theatre with him. Was never in the Cumberland tavern in her life, and was never at the Indian King with him. Gave the £5 back to BREW after she had been to DR. BONAR's. Witness was asked whether, when before the magistrates on the affiliation summons, she had said she supposed her father had given her the medicine for a certain purpose. At first she denied having said so; but upon being pressed she admitted that she had given evidence to that effect. She now added that she believed her father had given her the preparation for that purpose. Re-examined by MR. RUSSELL: Had been to MRS. FIELD's about dresses. DR. BONAR had been to her father's house representing DR. HENRY. By the Judge: He father gave the medicine while she was pregnant. MR. WILSON TOWERS surrendered to his bail to answer a charge of manslaughter of JOHN HETHERINGTON, at Castlesowerby, on the 6th September, 1873. MR. THURLOW and the HON. A. D. ELLIOT prosecuted; and at the request of the judge, MR. HENRY undertook the defence of the prisoner, who had not engaged counsel. The particulars of this case will be in the recollection of our readers, being reported in our columns when the case was before the Penrith Bench of magistrates. It will be remembered that the prisoner on the above day entered the New Yeat inn, and seized hold of a little girl named GLAISTER by the hair of the head, the girl screamed out, and a little child, aged 5-1/2 months, which GLAISTER was nursing, was noticed suddenly to turn black in the face, and was then taken by the mother, being so frightened that ever after this occurrence it seemed to be ailing, and eventually died on the 6th Sept., about a month from the time when the prisoner committed the assault on the nurse. The case was argued at great length, and after his Lordship had summed up the case, the jury returned a verdict of Not Guilty, and the prisoner was discharged.

JAMES DOBIS surrendered to his bail, to answer a charge of robbery with violence, from the person of JAMES ROBINSON, at Seaton, on the 4th of October 1873. Prisoner was charged with stealing a pair of shoes and a hat from the prosecutor, the evidence was of such a weak character that the jury by direction of his lordship, returned a verdict of Not Guilty, and the prisoner wa discharged. ____________________________________ CHARGE OF ROBBERY AT GREYSTOKE. MARY AGNES SIMON, surrendered to her bail to answer a charge of stealing a silver watch and gold chain, the property of WILLIAM MILNER, at Greystoke, in the month of February, 1870. MR. DAWSON prosecuted; and MR. HILLS defended the prisoner. The case for the prosecution, as stated by MR. DAWSON, and proved in evidence, was of a peculiar character. The offence with which the prisoner was charged was committed in the month of February, 1870. At that time the prosecutor - WM. MILNER, who now lives at Whitrigg, Hutton-in-the-Forest, resided at Whitbarrow, near Greystoke. At the period referred to the prosecutor had in his service the prisoner, and four men servants, named WARWICK, ROBINSON, ERRINGTON, and GRAHAM. ERRINGTON had been in prosecutor's service since the previous Martinmas, and was engaged to be married to a woman named SCOTT, who had left at Candlemas to be married, and the prisoner was engaged in her stead. The prisoner entered on her service the Thursday after Candlemas, 1870, and remained only about a month. She became ill, was, in fact, taking fits, and MR. MILNER and his wife sent for a doctor to see her, and in consequence of her illness she left. She returned, however, in about ten days to ask for her wages, and she spent a night or two in the house, but before she returned, the watch, which prosecutor had not see for more than six weeks before, had been missed. The prosecutor and his wife did not accuse the prisoner of stealing it at the time, but it had been matter of talk in the house before her return. ERRINGTON, who was married at the time while the prisoner was there on her return, heard about the watch being missed. It was a silver watch with a gold chain, and was left to MR. MILNER by an uncle of his of the name of TRAVERS. The prosecutor was accustomed to keep the watch in a drawer in the bed-room. On missing it MR. MILNER gave information to the police, but they failed to discover any trace of it. In January of this year, however, an advertisement appeared in one of the Penrith papers announcing that a watch had been found by the father of the prisoner. On seeing the advertisment and remembering the loss of his watch, the prosecutor communicated afresh with the police, and eventually went over to Shap where the prisoner was living, she having in the meantime married a man named SIMON, her name when in the prosecutor's service being DENT. In the prisoner's presence, her father said she gave him the watch as he had no watch of his own,, and she produced it from her box. She gave it to him shortly after her return from Whitbarrow, and said it was given to her by a man of the name of JOHN, a week or two before she left Whitbarrow. The watch was found in prisoner's father's possession, and was identified by MR. MILNER as the one he received from his uncle, whose name was still in the watch when recovered. In addition to the prosecutor and his wife, JOHN ERRINGTON was called, and said he was married to MARGARET SCOTT on the 19th March, 1870. He did not make any present to the prisoner while in the prosecutor's service. He did not give her the watch produced. INSPECTOR STEPHENSON, of Shap, said that when he read the charge to prisoner on apprehending her, she said it was given to her by JOHN ERRINGTON, who was sweethearting her; and asked (the Inspector) to assist her in finding him. MR. HILLS, for the defence, did not at all attempt to deny that the watch produced was stolen from the presecutor. He referred to two or three of the points of evidence, and submitted that the story told by the prisoner was more probable than the one that she stole it. He pointed out also that all the usual motives for theft were in this case wanting - she never using it for her personal adornment nor selling it for her necessities; as for the idea that she stole it for the purpose of presenting to her father, he said that that was a quite inadequate reason. HIS LORDSHIP then summed up to the jury, who returned a verdict of Guilty. Before passing sentence HIS LORDSHIP made several enquiries as to the prisoner and her connections and antecedents. She was recommended to mercy both by the jury and the prosecution. HIS LORDSHIP, in passing sentence, expressed, his pleasure that the prisoner has been convicted, though it might seem a cruel and hard-hearted thing to say, as it proved that they had convicted upon evidence and had not allowed their feeling of commiseration to influence them. It had been stated that at the time this theft was committed, the prisoner was in the family way and subject to hysterical fits, and he hoped that the light sentence he was about to pass would not encourage others to commit like crimes. He thought justice had been met by a verdict of conviction, which was a true verdict. The sentence of the court was that the prisoner be committed to gaol for two days with hard labour. [ Applause in court which was at once suppressed. ]

JUSTICE DENMAN) The Court sat at ten o'clock, and the Grand Jury were at once sworn. His Lordship, in delivering his charge, congratulated them and the County of Cumberland on the small number of prisoners for trial, and paid a high compliment to the gentlemen of the Grand Jury for their attendance in such large numbers, as well when the calendar is small, as when it is a large one, for it was by such examples that the gentry of a county really did a service, and promote respect for the administration of justice. His Lordship then proceeded to comment on four of the cases out of the ten set down for trial. THE TRIALS OF PRISONERS. THE CALENDAR - The calendar contained the names of ten prisoners, implicated in nine offences. There was only one female. Of the males one could read, two were imperfectly instructed, two could neither read nor write, and concerning four (out on bail) no education status was given. The female was out on bail and her education not stated.
