    1. [[Hawks]] Moses ILES Will 1853
    2. den toms
    3. Following the Pond Dipper's suggestion here is a transcription of the Will. The Will raises a couple of questions. Did Moses farm at Saddlewood? Unless Saddlewood is in the Dunkirk area I believe that the Saddlewood ILES are incomers as indicated in the 1851 Census. Dorothy Arkell ILES of Saddlewood is buried in Hawkesbury churchyard. Her son Daniel was born in North Cerney. The other question is that of Moses son William. He is not mentioned in the Will so was he dead by March 1851 when the Will was written? Did he fall out with his father? Was he the William who married Elizabeth ASHBEE? Who is the William ILES aged 58 carpenter, with wife Betty in the 1851 Hawkesbury Census? Is this Moses son or another William ILES? Moses son Daniel ILES can be found in Thornbury in the 1851 Census. He appears to have been baptised after his mother died and is enumerated as Daniel HES on the IGI. Anyway on with the Will..... I Moses ILES of Dunkirk in the parish of Hawkesbury in the county of Gloucester yeoman do hereby revoke all former Wills and Testamentary papers by me at any time heretofore made and declare this to be my last will and testament I give and devise unto my son in law Thomas LEWIS the uessuage or tenement wherein he now resides together with the garden and appurtenances thereunto belonging To hold to him his heirs and assigns for ever I also give and bequeath unto the said Thomas LEWIS the sum of nineteen guineas I give and bequeath unto my grand daughter Amelia STINCHCOMBE the wife of Daniel STINCHCOMBE the sum of one hundred pounds Also I give and bequeath unto her the said Amelia STINCHCOMBE the further sum of ten pounds for the purpose of apprenticing her son Henry CORNOCK when he shall arrive to a proper age and in case he shall die without being apprenticed then I give the said legacy of ten pounds unto the said Amelia STINCHCOMBE I direct that the said Amelia STINCHCOMBE and her said husband shall have the use of the uessuage wherein they now reside with the garden thereunto belonging for the term of one year next after my decease free from the payment of rent and that my daughter Elizabeth STINCHCOMBE shall have the use of the uessuage wherein she now resides for the term of one year next after my decease free from the payment of rent and as to the last mentioned uessuages and hereditaments and all the rest residue and remainder of my real and personal estate whatsoever and wheresoever I give devise and bequeath the same respectively unto William RODWAY of the parish of Hawkesbury aforesaid farmer and Allen GOULTER of the same place farmer their heirs executors and administrators upon trust that the said William RODWAY and Allen GOULTER or the survivor of them his heirs executors and administrators do and shall from and after the expiration of one year next after my decease make sale and absolutely dispose of all my real estate either by public auction or private contract and either together or in parcels and at one time or at several times as to them or him shall seem expedient for the best price or prices that can be reasonably procured for the same and shall convey and assure the same to such purchaser or purchasers thereof his her of their heirs executors administrators or assigns or otherwise as he or they shall direct or appoint And I hereby declare that the receipt or receipts of the Trustees or Trustee for the time being acting in the execution of the Trusts hereby created shall be an effectual discharge for so much money as therein shall be acknowledged to be received and the person or persons paying the same shall not be obliged to see the application of such purchase money or be answerable or accountable for the misapplication or nonapplication of the same or any part thereof and do and shall at their and his discretion convert my said personal estate into money And I hereby direct that the said William RODWAY and Allen GOULTER or the survivor of them his executors and administrators do and shall stand and be *** of and interested in *** monies to be received by them or him as aforesaid in trust in the first place to retain and reimburse themselves and himself all the costs changes and expenses attending the carrying into execution the trusts of this my will and to pay and discharge all my just debts funeral and testamentary expenses and the legacies hereinbefore by me given and then upon trust to divide the residue of the said trust monies unto and equally between my children Daniel ILES, Ann CORNOCK and Elizabeth STINCHCOMBE share and share alike I appoint the said William RODWAY and Allen GOULTER executors of this my will I declare that my Trustees and Executors shall only be answerable for their respective wilful defaults and that they may reimburse themselves all costs and expenses incurred in or in relation to the trusts of this my will In Witness whereof I the said Moses ILES have hereunto subscribed my name this twenty first day of March one thousand eight hundred and fifty one.
