This is the last will and testament of me Joseph COOPER of Cold Change in the parish of Hawkesbury in the county of Gloucester, Farmer. Whereas I have lately contracted with my neice Hannah DAVIS of Oxleaze in the said parish of Hawkesbury Spinster to sell to her my freehold cottage garden and small orchard thereto adjoining situate at Inglestone Common in the said parish and in the occupation of Charles STINCHCOMBE for the sum of £100. Now I hereby give and devise the said hereditaments and premises with the appurtenances unto and to the use of John ALLWAY and Edward STINCHCOMBE both of the same parish of Hawkesbury, Farmers their heirs and assignes for ever in trust on receipt of the said sum to convey the same hereditaments and premises unto and to the use of the said Hannah DAVIS her heirs and assignes or otherwise as she may direct. And I direct my said trustees to pay and discharge out of the said sum of £100 , the sum of £57 secured (?) by my promisory note of hand to Thomas DAVIS of Upton, Butcher with all interest then due thereon and that the remainder of the said sum sum of £100 shall be considered part of my ????personal estate. And I give, devise and bequeath unto the said John ALLWAY and Edward STINCHCOMBE all the residue of my freehold messuages lands hereditaments and real estate and all my leasehold messuages gardens lands and premises with their respective appurtenances and all other my personal estate and effects of every description to hold the same unto and to the use of the said John ALLWAY and Edward STINCHCOMBE their heirs, executors adminstrators and assignes according to the legal qunatity (?) thereof respectively upon trust at such time or times as they in their discretion shall think proper to sell and convert the same with money whether by public auction or private contract as they shall think proper with power to give weight to purchasers without satisfying (???) such purchasers to see (?) to the application of the moneys paid by them respectively and also with power to invest moneys which may come to their hands on such securities as they make think fit and to vary and transfer such securities at their discretion . And in trust by and out of the moneys arising by such sales and other my persoanl estate to pay and discharge all my mortgage and other debts and my personal and testementary expenses held in trust during the natural life of ym wife Mary COOPER to permit her to occupy and enjoy all my said real and personal estate until such sales and conversions aforesaid and afterwards to pay to her the net sum income arising from all my property for her own benefit on condition that she shall join in the conveyance to the said Hannah DAVIS for the purpose of her ??essing her(?) down (?) in the premises so contracted to be sold. And after the decease of my said wife or her breach of the condition aforesaid in trust that my said trustees shall ??? and ??? of my said estates and effects or such parts thereof then remaining undisposed of under the trusts aforesaid for Joseph COOPER , Thomas COOPER, William COOPER, John COOPER, JAMES COOPER, Mary WALLINGTON, Harriet COOPER and Ann COOPER sons and daughters of myself and my said wife their heirs executors adminstrators and assigns equally as tenants in common and to be vested interests in them respectively immediately on my decease.And if either of them shall then be under the age of 21 years in trust to apply and pay the nety income of each of them under that age for his or her benefit at the discretion of my said trustees until they shall respectively attain that age and I appoint the said John ALLWAY and Edward STINCHCOMBE executors of this my will. And I declare and direct that the trustees and trustee of this my will for the time being shall be allowed and may (?) attain (?) all their costs charges damages and expenses to be occasioned in the execution of the trusts hereby in them or him reposed (?) And that they shall not be answerable one for another and by no means for involuntary losses nor for any loss which may happen on account of their permitting my said wife to occupy and enjoy my said estate and effects until such sales and conversions as aforesaid. In witness whereof I have to this my will set my hand and seal this 7th day of December in the year of our lord 1833. The mark of Joseph COOPER. NB. Joseph COOPER was buried on the 12th of December 1833 ( 5 days after this will ) aged 77 giving him a birth date of abt 1756. All 8 children are mentioned. Hopefully this will conclusively answer Rodericks question which he is entirely correct to ask.
