I hope it is correct to accept "Colonial Settlers of Prince George's Co., MD".which shows twins James and John b. 16 Feb 1756 among the children of James and Susannah Downing (KPG p. 312) on p. 102. Also - it bothers me that they had a son Joseph, is apparently not accepted by all researchers. What is your opinion on Joseph? He is my line. Thanks,Mary Lou, for your research and time. Marlene >

    3. Last year I sent an email to the Downing-L Mailing List entitled "James & Susanna Downing - Part 2." In the email, I made two conclusions which I now believe to be incorrect. New research has shown that the John Downing b. 1747, and listed as an orphan in the 1760 Frederick Co, Maryland court records, is not the son of the James & Susannah Downing. James Downing, also known as James Downy (Timothy1), b. 1726 in Collin Hundred, Pr. George's Co, MD, d. 1761 in Ayr Twp, Cumberland Co, PA. James and Susannah traveled up Conococheague Creek to the Great Cove settlement in Pennsylvania about 1748. They were among the families that were chased out of the Cove in 1750 by the Pennsylvania Authorities. The land still belonged to the Indians, and the settlers were trespassing on Indian Territory. James and Susannah returned to Frederick Co, Maryland and remained there until the land at Great Cove was purchased from the Indians in 1754. Cumberland County Probate Records, Vol A:39 - 2 Jun 1761. Letter of Administration was Granted to Susannah Dunning of the goods and Chattels of James Dunning Deceased. (ML Cole - 2015) Cumberland County Probate Records, Vol A:46 - 13 Aug 1762. Letter of Administration was Granted to Joseph Wells and Susannah his wife of the goods and Chattels of James Downing Deceased. (Joe Downing - 1986) Mary Lou Cole

    3. Hi, Marian, Thank you for your interest. I regret that I don't have anything on your Mo. connections. Most of my Downing ancestors have pretty well stuck on or near the East coast, mostly in the Southeast part of the U. S. I have reason to believe that my Downing ancestors settled in Southern England, as they seem to have scattered from Kent County to Cornwall County. In my researches, I have found a Renatus Downing who married in Cornwall about 1628, and about three Renatus Downings in the U. S. A., one who was born about 1750 in N.C.,U.S.A., another who was born abt, 1810 in S.C., U.S.A, and another who was born abt. 1850 in Florida, U.S.A., where I live. The Renatus who was born in1810 in S. C. was my great-great grandfather. Again, I thank you for your interest, sorry that I couldn't be of more help with your Mo. connections. I need to prove the parents of Joseph Downing b MD 1748 who m. Jemima Woodward. Does anyone have that information? I have seen both a James/Susannah and also a William Downing stated as his parents. Does anyone have proof? Sure will be grateful hearing from anyone!! THANKS! Marlene

    3. As James Downing died prior to 2 July 1761, could he have died in 1760 and his son John b. 1749 be the orphan John Downing recorded in the 1760 Frederick Co, MD court records? There is a calendar change in 1750 which could help account for the difference in birth years. John was the eldest of James and Susannah's four sons as stated in a letter by Capt. Timothy Downing's son John to Lyman Draper in 1863. As the eldest son, John is listed on the 1762 Air Twp, Cumberland Co, PA Tax List - even though he was a minor. Two items are involved at this point: 1. Colonial Law - minors could be landowners, since they could acquire land by gift or inheritance. Land was never without title, so a father's will devising land to a minor resulted in the minor's immediate ownership regardless of age. Likewise, the land of an intestate person fell immediately to a specific heir, even if a minor, under the law of succession. (Bob's Genealogy Filing Cabinet - Minors and Land.) Also, Pennsylvania granted equal divisions of land and movables in intestates with a double share to the eldest son. 2. On the 1762 Tax List, John Downing has 50 acres and Widow Downing has 200 acres of "Unseated Land." Land that is privately owned but not cultivated, improved, or occupied. And the tax list includes non-residents. That raises the interesting concept that James and Susannah were at the Great Cove when the settlers were expelled in 1750 and had a claim to land there. We know they returned to Frederick Co, Maryland as established by their son James' 1750 birth place. We assumed that James and Susannah returned to the Great Cove c. 1751 and James' probate record and the 1762 tax list were confirmation. But, if you read the 1762 tax record, they were listed as owning "Unseated Land" - unoccupied with no improvements such as a cabin, a barn or a garden. In other words - no family had lived there. Also, son Timothy was born in Maryland in 1755. 1 No one in Great Cove was able to obtain a clear title to their land until after the Indians relinquished their rights in 1765. As James died in 1760, he was unable to receive a warrant for his land. It appears that his widow Susannah filed an estate for James in Cumberland Co. hoping to secure their 1750 land claim. When she married Joseph Wells in late 1761 or early 1762, he then became the administrator for James' estate. No further record seems to exist in Cumberland County. However, there is a record showing a Joseph Wells obtained a lease for 150 acres in Conococheague Manor in 1763. State of His Lordships Manor [Conegocheague?] 1767. Joseph Wells - Lot #15, 150 acres held by Certificate dated Feb. 10th, 1763. (Maryland Records - Colonial, Revolutionary, County, and Church by Brumbaugh.) As a result of the above documents and historical facts: 1. James and Susannah were at Great Cove in 1750 when the Pennsylvania Authorities expelled the settlers. They returned to Frederick Co, Maryland and remained there until James died in 1760/1761. The Downing entries on the 1762 Aire Twp, Cumberland Co, PA tax list were as non-residents who had claim to 250 acres of unseated land. 2. James and Susannah had four sons and John b. 1749 was the oldest. The John Downing who appears in the Frederick Co, MD court records in 1760 as an orphan very probably is their son. 3. Susannah m. Joseph Wells and they lived in Frederick/Washington Co, MD until the family moved to Catfish Camp, now Washington Co, PA, 1773-1776. 4. Nancy Ann b. 1762 is the daughter of Joseph Wells and his wife Susannah [Downing].

    3. I found an earlier probate record for James Downing/Dunning in Cumberland Co, PA. Cumberland Co, PA Probate Administration Records, Vol. A, p39. Be it Remembered that on the 2nd day of June 1761 Letters of Administration was Granted to Susannah Dunning of the goods & Chattles (sic) of James Dunning Deceased Inventory to be Exhibited on or before the 2nd day of July Next & an Acct of the Administration Rendered in one Year after the Date hereof Given under my hand and Seal of Office ____ Harm's Alrich New Letters of Administration were granted a year later when James' widow Susannah petitioned the court that she had married Joseph Wells. A widow gives up her rights when she remarries. Her new husband makes all the decisions and owns her property - known as coverture. Cumberland Co, PA Probate Administration Records, Vol. A, p46 - 13 Aug 1762 (Joe Downing 1986). Letters of Administration Granted to Joseph Wells and Susannah his wife of the goods and Chattles (sic) of James Downing Deceased. James died before 2 June 1761 and as Nancy was born 16 Oct 1762 - he could not be her father. Nancy Ann Downing b. 1762 was really Nancy Ann Wells. Mary Lou Cole

I do have a great deal of personal history information on Oscar from my family. He moved to PA to live with his son Herbert (my Grandfather), and died there. He is buried in the family plot, along with his wife Eva Crossman Downing, longtime Hempstead family residents. I have always known he was from Hempstead, and Herberts sister, my Aunt Olive, claimed the Downing family was from Hempstead for generations. I am really looking for something on Oscar's birth, christening. I will follow the Issac/Myrtie thread as well. I would be happy to share a photo of Oscar, his son Herbert Downing or even my Dad with you. I do not have a real "tree" on Ancestry. I sometimes add folks (right or wrong) to help with my research, but it is nothing valid, as I add and delete for my own needs. He was born on April 22 1876 in Rockville Centre and died on Oct 2, 1943 in Bethlehem, PA. Owned Carpenter and Restaurant business. "Own business" was very common for our Downing family of Long Island where Isaac learned the family tradition. Death record stated Oscar's parent were Isaac and Jane Warmth but unknown date of birth. It can't be one of George and Mary Coles Jackson's because Oscar's birth date was too f However...I suspected it might be Isaac Richard Downing (1848-unknown) of Glen Cove, LI because his 1900's to 1920's census record stated that he ran Carpenter business like Oscar's.
