Morrison (by attorney, Thomas Espy), sold to Jesse Cross, 250 acres, Land Lot 44, 13th District, for $75.00, December 7, 1831, Recorded February 16, 1832, L.L.81, deed witnessed by Reuben Anderson and Stephen Smith. ============================================================== Thomas Cross sells to John O. Jordan, Jr., 250 acres, Lot 54 of 13th District, for $400.00 on February 5, 1835, Attested by Jesse Cross on April 9, 1836, Recorded April 14, 1836, N560. Signed by Thomas Cross, witnessed by Hezekiah Dover (his mark), and by Jesse Cross. =============================================================== Thomas Cross, by sheriff, to Stephen Smith, May 9, 1836, Recorded March 26, 1836. N581. (Record Date before date of sale or deed.) Whereas in obedience to a writ of fieri facus issued out of the superior court of the county of Habersham at the suit of Joseph Dobson against Thomas Cross, J.P. & Hezekiah Dover Charles Rilch former sheriff of the county and state aforesaid did lately seize the lot of land hereinafter described as the property of the said Thomas Cross and after being duly and publicly advertised agreeably to law did on the fifth day of April eighteen hundred and thirty-six at the place of public sales in the said county of Habersham expose the same at public outcry when Stephen Smith being the highest bidder the same was knocked of(f) to him at the price or sum of five dollars. Now this indenture made this ninth day of May in the year of our lord eighteen hundred and thirty six in the sixtieth year of the independence of the united states of America between Alexander Mauldin sherriff as aforesaid of the one part and the said Stephen Smith of the other part witnesseth that the said Alexande! r Mauldin sheriff aforesaid for and in consideration of the sum of five dollars to him in hand paid by the said Stephen Smith at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell so far as the office of sherriff authorizes him unto the said Stephen Smith his heirs and assigns all that lot of land known and distinguished by lot number fifty-four in the thirteenth district of Habersham County together with all and singular the rights members and appurtenances thereof unto the said lot of land being belonging or in any wise appertaining and also all the estate right title interest property claim and demand of the said Thomas Cross in law equity or otherwise whatsoever of in or to the same. To have and to hold the said lot of land and premises and every part thereof unto the said Stephen Smith his heirs and assigns to the only proper use benefit and ! behoof of the said Stephen Smith his heirs and assigns forever in fee simple in as full and ample a manner as the said Thomas Cross or his heirs and assigns did or might have held and enjoyed the same had it not been seized and sold under the execution aforesaid. Writ of Fieri Facias executed by Adam Pitner Sheriff against Thomas Cross by Benjamin F. Patton, April 3, 1838, land sold at public outcry, to Benjamin F. Patton highest bidder, price of $173.49, Lot 54, 13th District, indenture made January 29, 1840, recorded same date, P83. =============================================================== Caswell Cross, by sheriff Martin C. Fuller, to Andrew J. Nichols, (2 deeds), seized property of Caswell Cross, Lot 85, 13th District, for $5.00 (Andrew J. Nichols being the highest bidder) March 26, 1859, recorded April 1, 1859. T159-160, signed by Martin C. Fuller, witnessed by James E. Griggs and John H. Wyly. The above followed by: For the sum of two dollars I transfer the within sheriff's deed to Jesse Fry without any recourse on me whatsoever. Clarksville, GA March 29, 1859, A.J. Nichols. Recorded April 1st 1859. James E. Griggs, CSC. Then: Same language, LL 86, 13th District, property of Caswell Cross, seized by Hamilton L. Harrison, Constable of 977th District of Habersham County, GA, also sold to Andrew J. Nichols, for $25.00. I need page T161 to see if this property was also transferred to Jesse Fry. ============================================================== Rebecca Cross, release to Nichols, March 26, 1859, recorded December 28, 1859, T257. State of Georgia ) Habersham County ) Fi Fas from Justices Court of the 977th District G.M. Andrew J. Nichols ) And others ) Vs. ) Caswell Cross ) The above Fi fas levied upon lots of land numbers 85 and 86 in the 13th district of said county and sold by the Sheriff on the first Tuesday of this present month March to Andrew J. Nichols. Rebecca Cross now living on said land and the purchaser demands possession for said lots of land, it is hereby agreed by me that I give possession in full of all the lands sold to William L. Walker, as agent for Andrew J. Nichols, within three days from this date and at the expiration of three days I give the said Walker the privileges of full control of said lands and premises and appurtenances in full for all my claims to said lots of land, and all claims which I may have and hold, to said premises and the appurtenances to the same.
