    2. Marjorie, You asked about posting the data from John Mullinax's will the other day. I don't have the exact copy of his will, but do have the following from SOME MULLINAX ROOTS - SOUTH CAROLINA TO TEXAS written by Otto B Mullinax -- p 123 John made his will on July 11, 1836. Wm Trimmier, James Coan and Elisha Bishop were witnesses. He described himself as "being low in health." He died three days later on July 14, 1836. On September 7, 1836 Rebecca having applied as executrix (and others named in the will refusing to serve, the Ordinary appointed John Caldwell, John Stroble, Edward Bomar, John Snoddy, and John Crawford to appraise the estate. Stroble, Snoddy, and Crawford on October 20, 1836 appraised the estate, including 15 slaves at $14,539.62 1/2 exclusive of real estate. On October 7, 1836 John's will was recorded and proved before John Bomar, OSD. (Spartanburg Co, SC Wills book C p 97 box 21 pkg 4) Citation for the will was published at Mt Zion Meeting House on October 2, 1836. On September 5, 1838 Rebecca Mullinax sold 390 acres of land on Cub Branch of North Tyger River to John Snoddy for $808. Buying at the sale of John's effects were Daniel Pruett, John Plowman, Enoch G Foster, Michel Roberds, Wm Walker, Wm Trimmer, John Bomar Jr, Wm Nance, John Strobel, Wm Lenard, H Newberry, John C Coan, and many others. At a second sale, sold on order of January 4, 1839, Negro boys Alfred, Simpson, and Peter were sold for $2,165, and the proceeds were divided among ten legatees equally. Rebecca sold eight acres for $230 to Daniel Mullen on December 9, 1839. This land lay on both sides of the North Tyger River and included the mill and shed. John Snoddy Jr and Benjamin Boing were the witnesses before John Chapman, magistrate, on March 16, 1944. The deed was recorded January 21, 1845. (Spartanburg Co, SC Deeds book Y p 535-6) p 124 By the 1840 Spartanburg census, Rebecca was alone in her home with only one boy under five years of age. She resided north of Pacolet River on the north fork and was 66 years old. A Gideon Mullinax lived in the district. The Spartanburg census taker in 1850 (p 6 dwelling 52) found her alone. Marion Mullinax lived in dwelling 295 (p 34 L 22) On July 26, 1858 she died and was buried near her husband near Fair Forest, SC. John Mullinax left $1000 in trust with John Stroble, Adam Gramling, and John Murph to repair Methodist churches at Foster, Shiloh, Mount Pleasant, Cannons, Drummonds, Leonards, Woods, and Bethel. On April 12, 1848, Thos I P Vernon CESD took charge of the church money. Interestingly, John left to his brother, Absolem Mullinax, his Negro man named Guy "to labor for and serve the said Absolom [sic] during his lifetime . . . then to be equally divided among his children." Guy was appraised at $500. At the time of his death John and Rebecca had no children, but had, as brother and sisters and heirs, the following: 1 Matthew Mullinax, DAR certified 2 Mary Mullinax. She married a Francis Dover and moved to Habersham Co, GA in 1820 and was over 70 years old in 1840 3 Anna Mullinax. She married a Hendrix 4 Sarah Mullinax. She married George Johnson and had moved to Habersham, GA by June 21, 1838. 5 A daugher Mullinax. She married a Grimes and had as children Martin, David and Mahala. 6 Malinda Mullinax, who married a Cowan. 7 Elizabeth Mullinax. She was married to Ablolom Martin. She died following the birth of her son Fields. Absolom remarried and was then murdered and his widow and Fields were beneficiaries under John's will. 8 Absolom Mullinax 9 Peter Mullinax (a Revolutionary War casualty) . . . . . p 125 Footnote # 25: . . . . A check on Mary Dover, married to Francis Dover, confirmed this. Living in Habersham Co, GA she gave Absolem a power of attorney to collect her part. A check of the 1820 (p 115), 1830 (p 29 line 11) and 1840 (p 153 line 43) Habersham censuses show her to have been born 1760 - 70. [NOTE: If Mr Mullinax thought Francis J Dover was dead in 1838 when he wrote about Mary (Mullinax) Dover's "widow pension" then what was he reading in 1840 to get Mary's age? Doesn't make sense. Page 153 1840 Hab Co, GA is the census record for Francis J Dover.] p 127 . . . On June 21, 1838, Mary Mullinax (married to Francis J Dover and Sarah Mullinax (Johnson), two of the legatees of Rev John, living in Habersaham Co, GA, excuted a power of attorney to Absolem to collect for them their part of their brother's estate from their sister-in-law Rebecca. Absolem was visiting in Habersham County, Georgia July 13, 1838 when he swore before Jno R Shanford, Judge of the Inferiour Court, to an affidavitt, in an effort to assist his sister, Mary, in getting a widow's pension (she was married to Francis J Dover). He swore that he was living in York District, SC "during the Rev War," that he knew and saw Francis Dover serving in the Army of South Carolina in 1777 and 1778 under Captain Jenkins. He stated that Francis Dover served throughout that war according to the neighborhood history. . . . [NOTE: Mr Mullinax was mistaken about the information in his book about Mary (Mullinax) Dover -- he claims that Absolem Mullinax witnessed papers in 1838 for Mary to receive a widow's pension for FJD's Rev War service. Since FJD didn't die until 1851 it was NOT Mary filing for a widow's pension. It was FJD himself refiling for his pension. Since we know that FJD was living by himself in 1830 and he and Mary were signing a power of attorney together in 1838, it seems most likely that FJD & Mary did not marry until sometime between 1830 & 1838. Had Mr Mullinax looked further at the Hab Co, GA census he would have found FJD by himself in 1830 and with an apparent wife in 1840 and living with his dau and s-n-l Thomas & Rebecca (Dover) Cross in 1850] ************************************ In the book SPARTANBURG COUNTY SOUTH CAROLINA WILL ABSTRACTS 1787 - 1840 compiled by Brent Holcomb can be found the abstact of the will of John Mullinnix(sic). In Will Book C 97-101, Francis Dover is named as one of the beneficiaries. John Mullinnix made his will 11 July 1836. He died three days later 14 July 1836 and his will was recorded and proved 7 Oct 1836.
