I found a couple more notes I took at the Sutro two weeks ago. I have no idea if any of them are pertinent. TYLER'S QUARTERLY vol. 1 p 61 (Notes from Barton's Colonial Decisions vol. 1, Sir John Randolph's reports. Cases were decided between 1728-1743) William Fox died, willing his estate to his wife [Ann Chinn Fox Chichester--daughter of Alice Stretchley, sister of Dorothy Durham--this is really stretching] during his natural life, and in case of her death the property should go to his nephew David Fox and his heirs, but if it should so happen that he should not be alive nor have any heirs, at the time of the decease of the said wife [Ann CFC], he gave his estate to Mrs. Burgess and all the daughter of George Heale who should be living at that time. [George Heale was the husband of Ann's sister Catherine Chinn] . David Fox is deceased and Mrs. Burgess is his only sister and admx. Mrs. Chicester died during the suit and it was revived by George Heale, in behalf of all his daughters, several of whom were born after the testator's death. George Heale married herh sister Catherin Chinn and left four daughters. Mrs. Burgess was Francis Fox, daughter of Samuel Fox and wife of Charles Burgess. Her brother David Fox is omitted from the pedigree. Preston Haynie Heritage Books Inc. 1996 p.130 #723 10/15/1679 Certificate is granted Amuel Mahan for 250 a. of land for ye importation of John Dodd, Thomas Howard, James Gilbert, James Pope and ---Blewfield OB 1678-98 part 1, 45 p. 267 11/18/1730 #1626 Ann Scrivener came into court and acknowledged 6 years since to Wm. Smoot above her indented time in consideration of his buying her of Hugh Kelly, her former master. OB 1729-37 p.24 p.148 5/15/1734 #1651 Judgement is granted to Ann Scrivener against Wm Smoot for her freedom . . . Steve Smoot (currently living!) has advised me he believes this William Smoot to be the grandson of the immigrant William Smoot, and from the MD branch of the family.
