Posted on: DEWHURST - DEWHIRST Wills & Such Board URL: http://cgi.rootsweb.com/~genbbs/genbbs.cgi/surnames/d/e/DEWHURST/wills?read=12 Surname: DEWHURST, CARDWELL, ASTLEY, ECCLES ------------------------- I Thomas Dewhurst of Cotton Hall within Lower Darwen in the County palatine of Lancaster Gentleman Do by this my last Will and Testament give unto Richard Cardwell of Blackburn in the said County Esquire Thomas Astley of the same place Organist and my Son Thomas Dewhurst All my Messuages Lands Tenements Hereditaments and real Estates situate in Lower Darwen aforesaid and in the Parish of Blackburn.... aforesaid and elsewhere in the said County of Lancaster To hold unto them the said Richard Cardwell Thomas Astley and my said Son Thomas Dewhurst their Heirs and Assigns forever Upon Trust and to the Intent and Purpose that all my said Messauges Lands Tenements Hereditaments and Premises shall be divided by them the said Richard Cardwell Thomas Astley and my said Son Thomas Dewhurst and the Survivors and Survivor of them and the Heirs of such Survivor into nine Parts or Shares and that one ninth Part of Share thereof shall be applied and appropriated in and towards the Discharge of all my just Debts (insert - except those accessed by Way of Mortgage) funeral Expenses and the Charges attending the Probate of this my Will and conveyed and assign for answering those Purposes And upon further Trust that the Rents and Profits of three other Parts of Shares of my said real Estates and Premises shall be received by my Dear Wife during the Term of her natural Life in case she shall so long continue my Widow and after he Decease or second Marriage Upon Trust that the same three Parts of Shares shall be conveyed and "assure"? to such of my Children or Grandchildren as shall by Deed or Will nominate and appoint and in default there of equally amongst them and upon further Trust to convey and "assure"? one other ninth Part or Share unto my said Son Thomas Dewhurst his Heirs and Assigns for ever one other ninth Part or Share of the said Premises to my Son John Dewhurst his Heirs and Assigns forever one other ninth Part or Share unto my Son James Dewhurst his Heirs and Assigns forever one other ninth Part or Share of the said Premised unto my Son William Dewhurst his Heirs and Assigns forever And as to one "mority" of the remaining ninth Part or Share of the said Premises Upon Trust to convey and "assoure" the same unto my Daughter Sarah her heirs and Assigns forever And as to the other "Mority" of the same remaining ninth Part or Share of the said Premises Upon Trust to permit and suffer my Daughter Nancy to receive the Rents and Profits thereof during the Term of her natural Life and after her Decease Upon Trust to convey and "assoure" the same "Mority" in two equal Parts one whereof shall be held used and enjoyed by my Grandson James Eccles his Heirs and Assigns for ever and the other Part by my two Grand Daughters Mary and Betty Eccles and their respective Heirs and Assigns for ever as Tenants in Common Provided "...." that if any of my said four Sons shall happen to die under Age and without Issue then and in such Case the Share or Shares and proportion of my said Real Estate Hereby intended for the benefit of such Son or Sons so dying shall go to and be held used and enjoyed by the Survivors or Survivor of my said Sons and their or his Heirs Provided also that all my said real Estates so devised as aforesaid shall be subject and liable to the Payment of all the Money charged thereon by Way of Mortgage and the Interest thereof after such date and in such Shares Proportions and Manner as the same one herein before respectively directed to be divided and conveyed Except as to the Share appropriated for the Discharge of such of my Debts as are not secured out of my said Estates and I constitute and appoint the said Richard Cardwell Thomas Astley and my said Son Thomas Dewhurst joint Executors of this my last Will and Testament hereby revoking all former Wills by me made In Witness whereof I the said Thomas Dewhurst hereunto set my Hand and seal the twenty fifth Day of October in the Year of our Lord one thousand seven hundred and ninety.
