I have just read the Irish judgement. It is an Irish domestic judgement on what are the plaintiff's rights to anonymity in a civil case. The Irish Constitution says none and the judge upheld this, only commenting that, although this was an unusual case, the constitution is clear that cases must tried in open court with all parties identified and that newspapers had a constitutional right to report, fully, on any case tried in open court. The actual defamation was subject to a separate judgement. Any EU directives have to be enshrined in legislation in the member country. This is probably some way off. The only impact on family history societies will be they cannot leave personal information on bulletin boards, forums etc for ever and they must be able to remove personal information on demand. I am not sure if this is a bad thing as there is too much out-of-date information out there with forum threads going back to the 90s.
