Richmond, Va., Feb. 4. - A defense motion to set aside the verdict in the case of Joseph ENOCH, 23, convicted of first degree murder of Miss Celia SHEVICK in April, last, was denied today by Judge D. C. RICHARDSON in hustings court. Sentence of twenty years' imprisonment recommended by the jury was formally pronounced. An appeal for a writ of error was noted by ENOCH's attorneys and they were allowed sixty days in which to file the petition. Two novel points of law were raised in the case, namely, the admissibility of evidence before the jury as to an alleged confession by the accused, after the court had ruled that the confession was not voluntary, and the admissibility of questions relating to the alleged confession by the commonwealth's attorney and the answers thereto by the defendant in the presence of the jury. Judge RICHARDSON added to his opinion a note specifically asking that the supreme court of appeals pass on these points. Miss SHEVICK was waylaid and attacked while on her way home from a motion picture show here on April 26, last. Her unconscious form was found next morning on a lot near her home by passersby. Her skull had been crushed with a heavy tool and she died that afternoon without regaining consciousness. ~ ~ ~ ~ ~ ~ ~ DC-Old-News ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ NewspaperAbstracts.com - Finding our ancestors in the news!
