Creed M. Fulton, Indicted for Embezzlement, Files Interpleader. A bill of interpleader was submitted to Justice McCOY in Equity Court Saturday by Creed M. FULTON, through his counsel, Wilton J. LAMBERT and Levi DAVID by which Mr. FULTON, who was recently indicted for embezzlement of certain funds claimed to belong to the heirs of Hiram SMITH, tenders the money in question into the registry of the court for distribution as the court may direct after ascertaining who are rightfully entitled to receive the fund. By the bill, Mr. FULTON sets forth that he was employed by one Frederick M. SMITH, claiming to represent all the heirs in question, to enter suit to recover certain money claimed to be due them as next of kin of Hiram SMITH, then he filed the necessary proceedings which resulted in a compromise being effected and about $?00 was paid to him. After the receipt of the money he claims to have made a statement of the account to F. M. SMITH, but that upon investigation it became difficult to decide who were entitled to different portions of the fund, and that several minors were interested, for whom no guardians had been appointed to receive their respective shares, which, he claims created a situation making it dangerous for him to turn over the money without having to assume double liability. Justice McCOY took the case under advisement as to what order he would enter.
