Martha Rice, Wid., and Martha Rice, her daugher Article Text: Circuit Court, Washington County Griffith Coombe vs. Martha Rice, Widow and Administratrix of Edmond Rice, deceased, and Martha Rice, his daughter and heir at law. The bill in substance states that Edmond Rice, in his life time, on July 20, 1821, made and executed an Indenture of that date, conveying to complainant thereby, that piece of ground in the City of Washington, known and distinguished in the subdivision by the heirs of William Whitcroft, of Lots No. 6 and 7 in square No. 458, as the Lot No. 7, in the Plat of said subdivision; which portion or subdivision Lot of Ground No. 7, appears, by said Plat, to be 20 feet front on 7th street West, by 56 feet 8 inches deep, containing 1130 square feet, with the buildings &c. thereon, with a proviso for making said Indenture void on payment of two notes of said Edmond Rice to complainant, one for $201.87 and the other for $444.25, both dated said 10th July, and the former payable at 60 days, and the latter at six months; and upon said Rice indemnifying said complainant against a note for $690, endorsed by complainant, and discounted for said Rice's accommodation in the Branch Bank of Was! hington; the said Deed was omitted to be recorded by indenture, and without fraud within the time allowed by law; that said note for $201.87 was paid, but that said other note for $444.25 remains due and unpaid, and that complainant was obliged to take up said note, discounted as aforesaid in the Branch Bank, and did pay, or principal, interest, and costs on the same, the sum of $707.04; and the personal estate of said Edmond Rice being insufficient to pay his debts the object of the bill is to have said mortgage recorded, or degreed to be duly made to him and the said property sold for payment of the complainant's said debts; and if insufficient, to have the other real property of said Rice sold for that purpose and because the said defendant, Martha Rice, the daughter, has removed out of the jurisdiction of the Court, and resides in the state of Maryland, it is, this third day of December, 1825, Ordered, that the complainant give notice to the said absent defendant, of th! e substance and object of the bill, by publishing a copy of this order in the National Intelligencer, once a week for six weeks, and warning said defendant and her guardian or guardians to be and appear in the Clerk's Office of this County on the first Monday in April next, then and there to answer the Complainant's Bill fully and truly; otherwise that the same will be taken pro confesso against said defendant. B. Thruston, Associate Judge of the Circuit Court, D. C. Griffith Coombe appeared personally before me, the subscriber, and made oath on the Holy Evangelists, that Martha Rice, the daughter of Edmond Rice, resides out of this District, and in the State of Maryland.
