Daniel of said State and County, being of advanced age and knowing that I must shortly depart from this world deem it right and proper both as it respects myself and my family that I should make a disposition of the property with which a Kind Providence has blessed me. I therefore make this my last will and testament hereby revoking and annulling all other heretofore made by me. Item 1st. I give and bequeath to my grandson Andrew G. McJunkin and a Bay Mare Colt about 1 yr. old. Item 2nd. I give and bequeath to my grandaughter Sarah A. McJunkin a Negro child names Amanda about 7 months old. Item 3rd. I give and bequeath to my three grand children James C. Goodrum, Mary J. Goodrum, and Emeline E. Goodrum children of my daughter Emeline E. Goodrum now dec'd the sum of five hundred and fifty dollars each one. Item 4th I give and bequeath to my son Robert C. Daniel one fourth part of all the residue of my Estate both real and personal after deducting the above mentioned special bequests. Item 5th I give and bequeath to my son Robert C. Daniel one fourth part of all my Estate both real and personal (after deducting the before mention special requests) to hold the same as trustee for the use of my five grand children viz. Andrew C. McJunkin, Sarah A. McJunkin, Samuel McJunkin, Mary J. McJunkin and Robert C. McJunkin and my will is that each one of them shall receive from the above mentioned Robert C. Daniel trustee their portions as follows viz. the first one which becomes of age or marries to receive one fifth part of the whole amount of the above named legacy at that time, the next one fourth part of the amount of the residue at the time of becoming of age or marrying and so on of all the others each one receiving their due proportion of the amount at the time of becoming of age or marrying. Item 6th. I give and bequeath to my daughter Mary E. Butler wife of Edmund U. Butler and to her children by her present or any future husband free from the dispostion of her present or any future husband one fourth part of all My Estate both real and personal (after deducting the before mentioned special bequests) to my said daughter and her children forever, and I do hereby appoint the above named Edmund U. Butler trustee for the property herein bequeathed to my daughter Mary E. Butler and her children. Item 7th I give and bequeath to my son Samuel E. Daniel one fourth part of all my Estate both real and personal (after deducting the before mentioned special bequests) and my will is that he take all my interest in the tract of land on which I now live (it being one half) as part of his legacy at the sum fifteen hundred dollars. P, There is something amiss on these Cunningham-Daniels. A thought I had is that Thomas DANIEL who married was it Sarah RANDLE was the son of James DANIEL and Jean KELSO. That would put is his birth in the 1740 time frame, something we have always considered. They were the parents of Charles DANIEL who married Elizabeth COFFEE. At the same time in Greene County, GA is another Thomas DANIEL, the one who married Sarah BURNEY. This Thomas was either Thomas DANIEL, Jr, son of T&E or a grandson of this family. Which, I do not know. I tend to think the James DANIEL who married Jean KELSO was not a descendant of Roger DANIELL. I will take a closer look at your assignment of this James to that family to see what the KELSO information states, since her brother was a Robert KELSO. As for the Robert C. DANIEL listed in the will of Jane EWING, I offer the following 1860 Jefferson County, GA census. For the name, Robert, especially one with a C. as the middle initial being a rather unpopular name in all of these families, all of a sudden we have lots of them floating around all over the place (person, 23 99, below), don't we? That Robert DANIEL at the top of this census is my GGF and the Alice, age 6, listed below him is my grandmother. Mary J. DANIEL is Mary Jane RENEAU, his 4th wife. The three WISE boys listed with them are his nephews and the GREEN boy is a nephew of his late, 3rd wife, Rachel Rebecca GREEN who died in 1851. I do not know who the BELL and PETERSON boys are, but probably family of sorts since all of the others are family. I also tend to think, now, his 3rd wife, Rachel Rebecca GREEN (1824-1851) was the daughter of William GREEN and Rachel WARREN, and Rachel was the d/o Hinche WARREN (1745-1804) and Rachel ANDERSON and g/d of Robert WARREN of Surry County, VA. I have Hinche's will (transcription, below) and it confirms the William GREEN and Rachel WARREN marriage. I had his name as Daniel GREEN from another researcher but this was incorrect and the names, William and John, float all through this family supporting this re-assignment. If so, this puts this Robert WARREN as being the Robert WARREN born ABT 1682 in Surry County, VA, the son of Thomas WARREN, Jr. and Elizabeth PLAW and grandson of Capt. Thomas WARREN and Mary Alice POWELL of Surry.
