The Jurors for our Lord the King upon their Oath present that Charles Cogdell late of the Parish of Saint Patrick, in the County of Dobbs aforesaid Labourer-- not having the Fear of God before his Eyes, but being moved and seduced by the Instigation of the Devil, on the Second Day of October, in the Thirteenth Year of the Reign of our Sovereign Lord, George the Third, now King of Great Britian &c, with Force and Arms, at the Parish aforesaid, in the County aforesaid, in and upon Samuel Thomas, in the Peace of God, and our said Lord the King, then and there being, feloniously, wilfully, and of his Malice before thought, did make an Assault, and that the said Charles Cogdell a certain Gun, of the Value of five Shillings, Sterling Money of Great Britain aforesaid, then and there, charged with Gun Powder, and leaden Shot, which Gun, he the said Charles Cogdell in his Right Hand, then and there had and held, to, against, and upon the said Samuel Thomas, then and there, feloniously, wilfully, and of his Malice before thought, did shoot and discharge; and that the said Charles Cogdell, with the Leaden Shot aforesaid, out of the Gun aforesaid, then and there, by Force of the Gun Powder, shot and sent forth as aforesaid, the aforesaid Samuel Thomas, in and upon the left Side of him the said Samuel Thomas, a little below the left Ribbs of him the said Samuel Thomas, then and there, with the Leaden Shot aforesaid, out of the Gun aforesaid by the said Charles Cogdell, so as aforesaid Shot, discharged, and sent forth, feloniously, wilfully, and of his Malice before --- thought, did strike, penetrate and wound, giving the said Samuel Thomas, then and there, with the Leaden Shot aforesaid Shot, discharged, and sent forth, out of the Gun aforsaid, by the said Charles Cogdell, in and upon the said left Side of him the said Samuel Thomas, a little below the left Ribbs of him the said Samuel Thomas, one mortal wound, of the Depth of two Inches, and of the Breadth of one Quarter of and Inch of which said mortal wound the aforesaid Samuel Thomas then & there instantly died. And so the Jurors aforesaid, upon their Oath aforesaid, do say, that the said Charles Cogdell, in Manner and form aforesaid, feloniously, wilfully, and of his Malice before - thought, did kill and murder, against the Peace of our said Lord the King, his Crown and Dignity Jn'o Cooke att'y pro Dom.kege Source: Secretary of State Records, Court Records, Oyer & Terminer, 1773, Box 314 ___________________________________________________________________ The Confession of Joseph Killet Taken on Tryal Thos Harrison, Jno Cato, Robb'd Wm Radford of Courency, Hard Money & a coat one pair of Breeches, one Hunting Shirt & Linning Shirt, and further that sd Harrison ________ Stole a Sorrel Mare of Hampton Syllavan, and sd Harrison, sd Cato, Andr Killet Junr, David Lawhon Robbed Peter Lee of one Mare, one Saddle, one Green Cloak, one Gun & some Money; and that he believes sd Lawhon Sold sd Mare to Jno Honeycut upon the Waters of Deep River; and that sd Harrison, sd Kato Stole Jno Edwards's Horse, Mare, he sd Joseph Killet saw the above Men on sd Horses, and that they sold sd Horses either to Jas Farr, Capn Joeson or Jno Arthur, between Jones's Creek, Tompsons Creek's & sd Harrison Stole Jno Roache's Horse, and he heard him say he would Shoot the Horse as soon as he Rode him to Neuse River _______ and that on Tuesday 27 of this Instant he saw sd Lawhon with two Mares which he said he Borrow'd the White one of Robt Key & the Dark Bay of David Rainer _______ and that on Thursday 28th of Instant he sd Joseph Killet, sd Lawhon went to Mr Winkfields where sd Lawhon & himself Stole a Gray Horse which he was to let one Jno Cole have to carry up towards Salisbury to Sell for Halves ________ The Said Killet Further say that he Hired one Jno Vick to take his place as a Soldier and returned him to Lieutenant McNeas under the name of Jno Mitchel, and also says as he and sd Vick was going to Kingston they called at James Miles's when he saw Vick Steal a pair of Leather Breeches out of Miles's House _______ _________ Furthermore the sd Joseph Killet on his Examination saith that the following Persons doth Harbour and assist both Thieves and Deserters Viz Saml Stricklen, Thos Daughtry, Andrew Killet Senr, William Killet Junr in Dobbs County, Robt Key, Kinchin Citchen, Isaac Wheeler, Jno Miles, David Miles, Wm McClam, Joel Joiner, Benjn Joiner, Geoe Cato, Jno Barefoot, Peter Lee & Selah Thornton in Duplin County____________ The Confession of Joseph Killet taken before me this 30th day of July 1779 his Andrew Bass Joseph X Killet Mark Ansor of the Testimony against Joseph Killet for Horse Stealing. Jos. Windfield - Prosr 28 July lost a horse of a gray colour of pounds 600 curr. money. Dr Bass bro ? the horse to him next morning. Jas. Daniel ---- Saw Killett on the horse two hours before day, 12 miles from Winkfields. There had been thieves in the neighbourhood, uspecting him to be one ordered him to stop for riding far before, but did imediately after, & presented his gun-Shot at him- His horse threw him at the fire, & he was apprehended. Whose hores? His Bror And. Killett's - the horse run away - the next morning he and Roach followed the track of the horse- And others went different ways- the others found Mr W's horse with the bridle on - saddle fell when he did, there being no girth - it had been apprehended, & carried to Bass's - He denied at first it was the same horse, but afterwards owne it - gave several different accounts. That his Father John Grant departed this Life on Friday Night the Sixth Instant, and that he has reason to believe the death of the said deceased was caused by Several Blows & bruises he received from a certain James Wilson on the Monday precedeing. These are therefore in His Majestys name to command you that you take the Body of the said James Wilson if to be found in your Bailwick, and him safely keep untill you bring him before me or some other of his Majestys Justices of the peace for said County to be dealt with as the Law directs. August 10 Day of 1773 The Deposition of James Danniell Taken on the Tryal of James Wilson that James Wilson Came to his house the Second Day of August and Some Time after Came John Grant and that John Grant Began to Quarrill With Sd Wilson first and that Sd Wilson Seemed to Want to Beat Sd Grant and that Sd Danniell held Sd Wilson and that his Wife forewarned them from fighting on the plantation Several times and that John Grant Went of and told Wilson to Com after him and that he Sd Danniell had hold of Wilson By the arm and Would Not Let him go Til he Tore his Shirt and then Wilson Told him that he Wanted to make Water and he Let him go and that the Next News he hard Was The Children Came Screaming to the Door and Sd Wilson Would Kil Grant and that he Sd Danniell Ran To Them and he heard Grant Cry out Enough/Murder two or three Times annd Sd Daniell That he Se Wilson Strike Grant in the face Two or Three Times With his Left hand and That he Sd Daniell puld Wilson from Grant as Quick as he Could and Led Wilson to the house and that Grant followed him to the house and abusd him and Went of To go home and that he Sd Daniell Went to Grants house the 4 Day of Sd month and Seed Grant Naked Except his private parts and that he Could Se No hurt But What Was In his face But Grant Told him The Worst hurt he had Was on his Left Side Near the Rim of his Belly Next Avedince Sarah Daniell Wife of James Daniell that She Did Not hear the Beginning of the Quarill But that She Come in to his house Second Day August and that John Grant and James Wilson Was Quarreling and that She forwarnd them of from his plantation if they would fight and that Grant Went of and Wilson Deplored hir husband James Daniell that was holding Wilson to Let him go and make Water and that he let him go and the Next News she heard Was one of hir Children Cry out Lord mamma they are fighting and Wilson Will Kill Grant and hir husband Run and That She heard Grant Cry out Enough murder and that Wilson Was upon him and She Seed him Strike Grant With his Left hand In the face and that hir husband Sd Wilson Dont Strike him again and after that as Wilson Rose up he Kickt Grant on the Side of the face and that Grant follow'd Wilson up Near the house and Dard him to Com out and he Would fight him again But Grant Went of and that She Went to Se Grant the 4 Day of the month and that he told hir The Gratess of his injurrey Was Near the Rim of his Belley and Range'd into the Small of his Back The Avedence of Nathanell Dannelll in the Tryal of James Wilson that on Wensday or Thursday the 4th or 5 of August he Was at John Grants and that Sd Grant Was Beten very much and that Grant Told him that Wilson and he had had a fight and that he Was Kickt In the Belley and that he allow'd it Would Be his End The avidence of John Daniell on the Tryal of James Wilson that on fryday the Six Day of August he Was at John Grants and Saw John Grant Ly Speechless and Seed him Expire and Die.
