Payne, William O'DANIEL, Sr. (1691-1728), the ancestors of these O'DANIELS that we know of, was born in Ireland, according to Robert DANIEL. All of my notes that I have on Brother William O'DANIEL were mostly provided by this same Robert DANIELL and are included, below, for your and others review. I do not know how this is going to break out but do not forget that Capt. WILLIAM O'DANIEL Pages 582 - 586, GENEALOGIES OF VIRGINIA FAMILIES, VOL IV (W -Y and Appendix) "By deed dated August 16, 1757, (Fairfax Liber D, 468) his son James O' Daniel of the Province of South Carolina conveys to the Rev. Charles Green, of Truro Parish, 100 acres left to thim by the last will and testament of his father, William O'Daniel, being the lower part of a tract of land granted by the Proprietors of the Northern Neck to the said William O'Daniel by deed dated April 19, 1717, for 300 acres. It seems probable that this James O'Daniel is the James Daniel who voted at the Fairfax election in 1744, and who, before he migrated to South Carolina, married, October 19, 1755, Theodosian Congers, and in the following year had a son, William Scott O'Daniel" (Boogher Overwharton Parish Register (1899), 136). General Notes: WILLIAM O'DANIEL (About 1691 - About 1728) of Accotink Run, Stafford (subsequently, 1731, Prince William, and 1742, Fairfax) County, Virginia "William O'DANIEL (1691?-ante 1728) of Accotink Run, Stafford (subsequently, 1731, Prince William, and 1742, Fairfax) County, Virginia, makes his only appearance on the surviving records as grantee from the Proprietors of the Northern Neck." (Fairfax Harrison, Tyler's Quarterly Historical and Genealogical Magazine, Volume I, page 164). [*He had a residence before 1730 in Accotink Run, Stafford County, Virginia.] He received the following land grants from the Proprietors of the Northern Neck: Parcel 81 - O'DANIEL, WILLIAM 300 acres 19 April 1717 NH 5:159 North side main run Accotink adjacent lands of Major Thomas OWSLEY, deceased; Captain Daniel McCARTY, formerly of John THOMAS; James HERREFORD; and James CARROLL. This evidently was his home land, not too far from the Potomac River. In 1717 this land was in Overwharton Parish, Stafford County, Virginia. The Rent Roll for this Parish showed William O'DANIEL with these 300 acres. Parcel 103 - O'DANIELL, WILLIAM 400 acres 16 March 1724 NN A:132 South side main branch of Accotink above Elk Lick and adjacent George MASON and Colonel George ALLASON. These lands were in Overwharton Parish, Stafford County in 1717, and later in Hamilton Parish, Prince William County, and finally in Truro Parish, Fairfax County in 1742. William married Frances before 1718. Before William's death, they had at least six children: John, William, James, Elizabeth, Katherine, and Ann. Their birth dates are not all known. William O'DANIEL's will was dated 24 January 1724b(1725) as quoted in a 1753 deed. It was indexed in the "Old General Index" which was transcribed into a new index and listed as having been recorded in "Record Book K (1721 - 1730) on page 290 with inventory on page 300 and his estate account on page 323 - GLADEN X". Apparently GLADEN was his executor. No copies of these records exist because Record Book K is missing, but seemingly known dates of items recorded on adjacent pages place his death by late 1728. (Catherine Bond Gheesling) From several recorded deed transfers of William's land by his children as their inheritances, it appears that each his children each received 100 acres from the will. Katherine and Elizabeth and their husbands sold 200 acres to Francis SUMMERS in 1753. James sold 100 acres to Reverend Charles GREEN of Truro Parish in 1757. No record of the remaining 400 acres has been uncovered. It would seem likely that each of William's children received 100 acres, but what happened to the last 100 acre plot? William had 700 acres. The seventh 100 acre parcel may have been given to his wife Frances, and disposed of by her second husband, John GLADIN. William married Frances "O'Daniel" GLADIN , daughter of Unknown and Unknown , before 1717. General Notes: Frances was the mother of all William O'DANIEL's children. Her maiden name has not been discovered. After William's death, she married last John GLADIN, will 1749, and was left his home land, leased from ALEXANDER, for her life. John had no children. The remainder of his land and estate went to his goddaughter, Sarah NELSON, daughter of Ann NELSON. John O'DANIEL was executor over Sarah's bequeaths and William O'DANIEL executor over Frances' part. James O'DANIEL/DANIELL gave a bond against any claim of dower by his mother to the 100 acres he sold to Charles GREEN in 1757, proving that his mother was still alive at the time of that sale. Frances O'DANIEL GLADIN's will in Fairfax County Will Book B-1, pages 180-181 and 239-240. This copy is from a transcription. There are numerous odd spellings in it. No witnesses were listed. Surnames were capitalized for this use. "IN THE NAME OF GOD AMEN this sixth day Feruary in year of our Lord one thousand seven hundred and fifty five I Frances GLADIN of ye Parris of Truro and County of Fairfax being very sick and week in body but of perfeck mind and memory and ordain this my last will and Testament Imprimus I give and bequeath to my son James DANNELL a feather Bed and furniture my chest and table too dishes and four plaits Young heffer if any cost or truble should happen everyone of my heirs shall bare an eqill charge acordin to chares portion. Frances{her mark} GLADEN." John O'DANIEL presented Frances' will in court on 21 March 1758. Her bequeath to her son James DANNELL appears to be her effort to replace household goods that he was required to sell by the court to sell as the result of a lawsuit by William PAYNE, Jr. in January 1755. Frances did not list any land in her will. William had six children, and apparently gave each 100 acres in his will. James sold 100 acres to Reverend Charles GREEN of Truro Parish. Katherine and Elizabeth and their husbands sold 200 acres to Francis SUMMERS. No record of the other 400 acres has been uncovered. It would seem likely that each of William's children received 100 acres, but what happened to the last 100 acre plot? Elizabeth O'DANIEL was born about 1723 in Stafford Co., VA. and died before 1755. General Notes: Elizabeth O'DANIEL Elizabeth married William SCOTT, who was a friend of her brother, James O'DANIEL. In 1746 William was listed as owning land formerly owned by her father, William O'DANIEL. Their marriage undoubtedly took place before that date. IMPLIED MARRIAGES OF FAIRFAX COUNTY, VA by Marty Hiatt lists the following on page 194: SCUTT, WILLIAM and Elizabeth O'DANIEL, dau of William O'DANIEL (Drawer X ( will dtd 24 Jan 1726/27 ); SCUTT to SUMMERS -1792. The dated marriage may be that of a descendant of the marriage of William and Elizabeth. On 7 April, 1753 , William and Elizabeth (O'DANIEL) SCOTT and her sister and husband, Henry and Katherine (O'DANIEL) GUNNELL, signed an indenture selling 200 acres of land to Francis SUMMERS. These two hundred acres were part of the four hundred acres granted to William O'DANIEL on the 16 March 1724 , and bequeathed to his daughters, Elizabeth and Katherine, in the his will, dated 24 January 172 ?. The indenture was witnessed by Lewis ELLZEY, James HAMILTON, William PAYNE, William SUMMERS, James? STEPHENS, John LANE , and James HANDY. Elizabeth apparently had died before 1755, as she was not named in the will of her mother, Frances (O'DANIEL) GLADIN, dated 7 February 1755 . Elizabeth married William Scott before 1746. William SCOTT, husband of Elizabeth O'DANIEL: In the earliest found mention of James O'DANIEL, he and William SCUT (SCOTT) were listed as chain carriers on a survey of 300 acres of land for John GLADDIN on 7 June, 1740 . William SCOTT signed an Administrator Bond for Ruth Canterbury, Fairfax County,Virginia Will Book A-1,part 2 Page 360 31 March 1750 Know all men by these presents that we Samuel Canterbury,Robert Boggs,and William SCOTT are held and firmly bound unto John COLWILL the first Justice in the Commission of the peace for Fairfax county for and in behalf,and to the sole use and behalf of the Justices of the said county and their successors in the sum of five hundred pounds Sterling to be paid to the said COLWILL, his executors,administrators and assigns to the which payment, well and Truely to be made we bind ourselves and every one of us and every of our heirs,Executors and administrators jointly and firmly by these presents. Teste John Graham Clerk. This William SCOTT is likely the William SCOTT(SCUT) who married James O'DANIELs' sister, Elizabeth O'DANIEL. In 1746 William was listed as owning land formerly owned by her father, William O'DANIEL. On 7 April, 1753 , William and Elizabeth (O'DANIEL) SCOTT and her sister and husband, Henry and Katherine (O'DANIEL) GUNNELL, signed an indenture selling 200 acres of land to Francis SUMMERS. These two hundred acres were part of the four hundred acres granted to William O'DANIEL on the 16 March 1724 , and bequeathed to his daughters, Elizabeth and Katherine, in the his will, dated 24 January 172 ?. The indenture was witnessed by Lewis ELLZEY, James HAMILTON, William PAYNE, William SUMMERS, James? STEPHENS, John LANE , and James HANDY. Elizabeth apparently had died before 1755, as she was not named in her mother's will, dated 7 February 1755 . A William SCOTT was the St. Andrew's Parish Representative to the South Carolina U.S. Constitution Ratification Convention of Sep 17, 1787 , voting for ratification May 23, 1788 (if my dates are correct.). It is reasonable to think that William SCOTT and James DANIELL moved together because of their close relationship in VA, but that in itself doesn't prove this William is the same William from James' Fairfax days. Now added into this mix is the discovery of the deed witnessed by James DANIEL on Aug 8, 1753 and the fact that William and Elizabeth SCOTT sold their 100 acres inherited from William O'DANIEL on April 7, 1753 . Did the SCOTTS cut ties to Fairfax in 1753 and go to South Carolina with her brother, James. I think so. This is beginning to look like a group departure from Virginia by James, William, Jr., and William SCOTT. (RLD) The 1782 State Census for Va. , Fairfax County lists a William SCUTT 7 whites, 3 blacks; and a William SCOTT - 1 white. There are possibilities of this being her son and his father, or William and another wife and his father, if you reason that she may have died in childbirth and William did not go to SC. (RLD) 6 F v. Katherine O'DANIEL was born about 1725. General Notes: Catherine O'DANIEL: In the following Indenture, Catherine is spelled with a "K": On 7 April, 1753, Henry and Katherine (O'DANIEL) GUNNELL and her sister and husband, William and Elizabeth (O'DANIEL) SCOTT, signed an indenture selling 200 acres of land in Fairfax County, Virginia to Francis SUMMERS. These two hundred acres were part of the four hundred acres granted to William O'DANIEL on the 16 March 1724 , and bequeathed to his daughters, Elizabeth and Katherine in his will, dated 24 January 172 ?. The indenture was witnessed by Lewis ELLZEY, James HAMILTON, William PAYNE, William SUMMERS, James? STEPHENS, John LANE , and James HANDY. In Frances (O'DANIEL) GLADIN'S will, dated 7 February 1755 , Frances left to her daughter Katherine "a trunk, butter pot, 1 earthen dish and two plates." Henry GUNNELL, husband of Catherine O'DANIEL: In Truro Parish, Henry was elected Church warden in 1761-1763, and Vestryman in 1756-1765. He was a justice of Fairfax County between1757 and 1764, served as sheriff in 1772, was a member of the Committee of Safety there in 1774, and voted in the 1744 election of Burgesses in Fairfax County. Henry GUNNELL left a will dated 21 January 1792 which was proved 20 Febuary 1792. Fairfax Co. Will Book F 22 Feb 1791 - 19 May 1794 Pg 9& 10 / PP 58-61 In the Name of God Amen I Henry GUNNELL of County of Fairfax and Commonweath of Virginia being weak of body but of perfect mind and sound memory do make this my last Will and Testament. Imprimis I do desire that my body be decently buried at the Discretion of my Executors and that they pay all my just Debts. I do give and bequeath to my son John GUNNELL two hundred and seventy acres of land to be laid of on the west or upper end of the tract whereon I now live by a strate line from difficult or piney branch as the quantity may be found to require so that the whole two hundred and seventy acres lays on the upper side of piney and also to include the plantation whereon William GUNNELL now lives. I give and bequeath to my son Robert GUNNELL all that tract of hundred acres of land that I purchased of William A. Henry GUNNELL was buried at his Gunnell's Run home near Falls Church. 7 F vi. Ann O'DANIEL was born about 1727 in Stafford Co., VA. General Notes for: Ann O'DANIEL: Ann O'DANIEL is known only from the will of her mother, Frances (O'DANIEL) GLADIN,dated 7 February 1755. She is named in the will as "dafer Ann JONES". Ann was left "all my wearing clothes." Afs. 12311 Acres of Land by virtue of an Entry made the 2nd da of March 1784, on Six Treasury Warrants No. 15557,19090, 14546, 19154 aand 19156, situate lying and being in the County of Fayette, on Hinkston's fork of Licking and bounded as followeth (to wit)Beginning at, A, ...the first fork that empties into Hinston's fork...below the mouth of Flatlick Creek, commonly know as Clement's fork...crosfing Hinkston's fork three times to the Beginning~ Charles MORGAN, DS. John JONES & Francis JONES, C.C. Isaac HALBERT Marker". The HALBERT, RATCLIFF, and GUNNELL families are related by marriage to the O'DANIEL family of Fairfax , Virginia . John JONES & Francis JONES may be part of Ann's family, if so, likely a husband and son, or two sons. At the date of this survey, Ann O'DANIEL JONES would have been about 50 years old, born before 1726. All the names in the patent above, with the exception of Charles MORGAN, are closely related to the O'DANIEL family of Fairfax . For many years, Bourbon County , because of its size, boasted two regiments. In 1811, they added another one. Attorney John ALLEN was the early paymaster. John, I have nothing that proves that William O'DANIEL, 1691?-1728?, of Stafford County, VA was from Ireland. His place of birth in my records is "Ireland?". That comes from "family lore". His country of origin is not mentioned on the website. If I sent something to you that said anything else, it was in error. The information I have on William's origin is from Tyler's Quarterly in which Fairfax Harrison states "In the deed of 1717 he is described as 'of the County of Stafford.5'", footnoted with "5He was probably a recent immigrant; although he was a contemporary of James Daniel, with whom Hayden (Virginia Genealogies, 294) begins the pedigree of the family of that name long seated in Middlesex and lower Stafford, his wearing of the Celtic O' probably determines that he was not of kin." (I do not have the knowledge to get into that debate.) These statements on Payne's website are the only mention of Ireland in the William O'DANIEL of Stafford County section: "First, in Stafford/Fairfax County, Virginia in the mid-1700s, there is a Thomas O'Daniel and a Jonathan O'Daniel who have not been linked to the William O'Daniel family. Second, there is the family of John O'Daniel who died in Orange County , North Carolina in 16 June 1825 . The first mention of the O'Daniel name in Orange County , North Carolina is in 1761. It is said that these O'Daniels immigrated from Ireland in 1760. They moved into the Laurens County area of South Carolina as early as 1769 and lived near Raeburn's Creek. Other possible members of this family included William, Henry, Samuel, and Elizabeth O'Daniel. Henry and Elizabeth married in to a McDaniel family, and Elizabeth later married James Abercrombie. A third O'Daniel family with Irish connections is that of Daniel O'Daniel who was born in Ireland and died in 1839 in York County, South Carolina. There may well be others." It only refers to Thomas O'Daniel and a Jonathan O'Daniel, the NC O'DANIEL and Daniel O'DANIEL families. Another "Ireland" in a comment concerning Thomas COTTINGHAM not withstanding. William did not move from Stafford Co. to Fairfax County. His homestead and family remained in place in the area of Fairfax and Accotinck Creek from 1717 to the mid-1750s, some into the 1800s. Fairfax County came to his O'DANIEL family. As you know, the area that is Fairfax, Virginia now was originally in Stafford County, as established in 1664. In 1731, that part of Stafford County encompassing the town of Fairfax and William's land on Accotinck Creek became part of the new Prince William County. In 1742, That same part of then Prince William Co. became the new Fairfax County. In 1757, the western part of Fairfax Co. became Loudin Co., but that did not include the homestead of the William O'DANIEL family. Re: "William married Frances "O'Daniel" GLADIN , daughter of Unknown and Unknown , before 1717." This statement on Payne's website needs to be edited, deleting the - "O'Daniel" GLADIN -. My General Notes on William O'DANIEL's wife Frances state "Prior to 1718, William married Frances, her maiden name as yet unknown." The statement as currently there could wrongly give the impression that Frances' maiden name was GLADIN. It remains "Unknown" to me. I have asked Payne to make this change.
