The case involves Michael Elliot, who was convicted of the 1991 murder and robbery of Earl Cowden. Elliot was sentenced to life in prison without the possibility of parole for 25 years. Kentucky Public Defender Marguerite Thomas, along with three attorneys and two law students for the innocence project in New York, filed suit Wednesday in US District Court in Covington, asking that blood samples collected at the murder scene 11 years ago be tested, not destroyed. Thomas claims detectives collected blood samples from Cowden's home that may have come from the real killer. She says someone other than Elliott broke a window to get into the Cowden home and that it will prove there was a second perpetrator
