Thanks Lee and Karen, More questions, if a troop was at Fort Garland would they be called to escort a survey party in the Arkansas Valley? Would Jackson and all those photographers who photographed the area around Leadville, Dayton, Granite City have gone clear to Fort Garland to receive escort? My thoughts that Jackson and other photographers came from the Denver area but that is my thoughts. Would the escort have met the survey team and photographers at a location and then proceed into the area? I know it was the 15th that was the escort for this party. What I don't know is would they hold court martial's in the 1870's at the location of the incident or would they take the person back to the fort for court martial, if they had court martial's. What I am finding is the person who shot the two comrades was being held in Granite City from Sept 1873 until Jan 1874. Surely the 15th moved on with the escort and left this soldier behind... for the local officials to deal with?????? I then find this soldier as part of the Leadville War as one of the 180 vigilantes that was organized. And, then I find this man living nicely in an Old Soldier's Home. Did he get away with the crimes that he committed? Did he get to move on with his life and live off the government in retirement? I do not find him in any census's until 1910... nothing at all.... so from the time period of 1874 until 1910 this man married but nothing can I find on him. I think I used the term "scum" in wrong usage. I just feel that some of the men on the frontier were not the most respectable men of their time. They didn't join the service for having pride for their country and what they could do for their country but I feel that many needed a way to escape whatever was following them. Fort Garland was established in 1858 in what is now Colorado (then New Mexico Terr) and stayed until it closed in 1883. It is shown on the 1862 Colorado Territory map. ----- Part of Original Message ----- From: "Gail Kilgore" <gail.kilgore@gmail.com> Were their other Forts besides Fort Garland which at the time was in New Mexico Territory.
Gail Refuse to speculate without the facts of this case. But in general terms - If a private was pending only military charges he wouldn't be held in civil custody in Granite City. The army would have returned him to his unit (probably to the regimental headquarters) to face a military court. On the other hand if he was being held pending civil trial the army could waive any shot at him in a military court. Insanity as a defense is a recent invention so we can't apply today's use to trials in the 19th century. No military court would waive charges because the suspect "went crazy" and murdered members of his unit. Lee ----- Original Message ----- From: "Gail Kilgore" <gail.kilgore@gmail.com> Second, in the time period of 1873 in Colorado if an event happened was it probable that there would be a court martial or if the person was tanked when he killed fellow comrades, did they do a court martial or did they just assume he was crazy at the time and let him go?
Gail An 1896 history of the US Army is on-line. The section on the 15th Regiment of Infantry is at: http://www.history.army.mil/books/R&H/R&H-15IN.htm. The part you need covering 1870-1882 is on page 626-627. It shows companies from the regiment were spread over 6-7 forts in New Mexico and a company was stationed at Fort Garland. About 1880 the regiment was restationed to Fort Lewis and Fort Lyon but still had a company in Santa Fe. In 1882 they moved north to the Department of Dakota. The army has always been a reflection of the society it draws recruits from. There were quote, scum, unquote in Washington's Continentals and we still have a few awaiting execution at Fort Levenworth. Hi Gail, In Pueblo County, there was Fort Lyons and Fort Reynolds, and Bent's Fort, which was a trading post but the military were always there. I would assume that they kicked him out of the military OR he escaped, then joined the vigilantes. There are many stories in the digital newspapers about the heroic Privates of the military so I don't think they were all scum. That person was probably the exception to the rule. I just update all my counties, I added the special projects links to them all made come changes to the CSS file and made sure they all had links to the county archive page. I think it was Costilla and Rio Grande that were missing them. Put up pleas for volunteers and contributers to expand the recourses for the counties. The Cogen Web http://www.rootsweb.com/~cogenweb/ccinfo/cogw-rules.htm page needs some update to the rules to reflect message boards. It still says the query pages need to be updated at least monthly or bi-weekly among other things that need changing. You all should have a link to your county message board. We need to work on Rootsweb/Ancestry so the message board have prominent links back to the county page. I'm working on an help page for common errors I've seen in CoGen Pages. I updated the http://www.rootsweb.com/~cogenweb/ccinfo/reception.htm#html a bit.
