From: Ted Urquhart, President Alabama Cemetery Preservation Alliance Subject: RE: Pinkston Cemetery - On Tuesday's Mtgy Co Commission Meeting's Agenda - Update Walter Byers, City Attorney, returned my call yesterday and confirmed that the county has jurisdiction over the cemetery. Commissioner Reed Ingram and I just talked - and he was not optimistic for the commission ruling in our favor. He explained that the developers are contributors to the individual board members, including himself, and he believes he will be the only one to vote against declaring the cemetery abandoned. He did encourage me to be at the 8:00 meeting Tuesday and to point out the Alabama Supreme Court case ruling - he had read it prior to the meeting two weeks ago but didn't know if the others had. Can we influence the vote? We've got Reed's vote - he represents Dist 5. A bit late, but if any of you know any of the other commissioners, live in a different district or know someone who does, a call to the other commissioners encouraging them to vote against abandonment on Agenda Item 21 could help. The Montgomery County website at http://www.mc-ala.org/commission/2006/default.htm only lists their names and office phone and email and, of course, Monday's a holiday, so need to try to reach them at home. I'll be at the 8:00 meeting to present our case. For those of you who can't make it to Tuesday's meeting, wish us luck. Consider Adoption of Resolution Regarding the Declaration of Abandonment of a Cemetery Located on Chantilly Parkway I contacted the Commission's (Clerk??), Donald Mims, and he said the county and city attorneys got together and determined that the county had jurisdiction. I missed Commissioned Reed Ingram at the courthouse and have left a voice mail on his home phone to call me to see his take on the outcome. I also called Jeff Downes, the Mayor's Exec Assistant, and he was not aware of the two attorney's getting together and gave me the City Attorney, Walter Byers, name and phone number - I've left a message with his office to call me as well. I plan on being in the County Commission's 8:00 meeting Tuesday morning. Would appreciate those of you who can to attend the 9:30 formal session. Will advise if I hear anything back from these turkeys - err, gentlemen. Ted
