Good morning all, Although these laws were not directed at the Choctaws of Louisiana they would have affected them & all others classified as Native American in Louisiana & anyone doing genealogy in Louisiana might find these laws interesting in finding clues to missing ancestors. These are from White by Definition - Social Classification in Creole Louisiana by Virginia Dominguez, Rutgers University Press, 1986 ed. "The Louisiana Supreme Court decision in the case of Adele v. Beauregard in 1810 explicitly stated that American Indians were persons of color, and this classification was accepted as valid throughout the nineteenth century. This meant that until 1870 when antimiscegenation statutes were repealed by Reconstruction governments, marriages between Indians and whites were prohibited. When interracial marriages were again outlawed in 1894, Indians---still classified as people of color---were again prohibited from marrying whites. This depended exclusively on their identification as persons of color. The first legal sign of a change in the classification of Indians came in the form of a 1920 statute (act220; Louisiana Revised Statute 9:201) that treated the union of an Indian and a person of the colored and black race as miscegenetic and thereby nullified it completely. Indians were thereby described as noncolored for the first time in Louisiana's legal history. By the 1930's the attorney general explicitly stated that marriages between white persons and Indians was not prohibited in Louisiana." Notice prior to the acquisition of Louisiana in 1803 there didn't seem to be any need for laws relating to whether or not Native Americans were persons of color & who they couldn't marry. One supposes that meant it wasn't a problem for the French or Spanish who came before the Americans. Well back to work, Ya'll stay dry down here along the coast. Its pitch dark here & raining good. They don't let us stay home for a little old thing like a tropical storm. Take care, Marcie

In the line you provided, there is a Benjamin Brashears and a Rachel Brashears but they lived a good time before there was any Treaty of Dancing Rabbit Creek so they wouldn't be on the rolls. However, in Goss' book on "...Choctaw Claimants and their Heirs..." there are citations for Benjamin Brashears and Rachel Brashears. I would think that there's a good chance that they were the grandchildren of your Benjamin Brashears and Rachel Brashears. Or even the great grandchildren of them. There are other Brashears listed as well in Goss' book. You might want to consider contacting OldBuck Press in Conway, Arkansas, and see about getting the book which originally came out in 1889 and has been reprinted by Oldbuck Press, 1025 Watkins St., Conway, Arkansas 72032. It is simply a listing of names of people who claim to be Choctaw and the pages that these claims can be found on in either the Atopka Commission Records or in the US Court Records. I would think that should you ever get any of these records from the US Archives, you will discover the names of others you might not have realized were relatives and the Goss book would be a handy reference for those additional names as well. I don't know if Oldbuck Press has a website but they probably do. John Craven New Orleans

Usually, no matter how atrocious the spelling of the name it is similar in pronounciation or gives the same or a similar sound when pronounced and that just isn't the case with Burgess/Bourgeois as say Bourquoi/Bourgeois which is something I have encountered. My gggrandmother, Sarah Elmira Rogers Bryan , was a plantiff in a lawsuit aginst the US government in 1919, apparently on behalf of the Mississippii Choctaw Indians. Hello list members, have any of you encountered a place name around Bay St. Louis, Mississippi, called Choquopoulou, Mississippi, or spelt Chucupulu, Mississippi. I've discovered this name in the "Dispensation Records" with regard to some of my Ladner/Bourgeois ancestors and was wondering if it was a Choctaw name or, if not, was it an Indian name at all and if so from what tribe would it have been around Bay St. Louis, circa 1801? Where would this place be in relation to contemporary Bay St. Louis? John Craven New Orleans

Hello Linda, there have been a number of emails to the list regarding the name "Brashears" so I would think that your John Brashier Dumas is likely to be related since often names got corrupted over the years. I'm certain that someone on the list whose related to a Brashears will check into some of this for you. Others have indicated that they have ancestors from South Carolina as well.
