This applicant has the appearance and physical characteristics of being descended from White parentage; her hair is somewhat gray-- formerly black; eyes are black; complexion medium dark; doesn not speak or understand the Choctaw language and has no knowledge of any compliance on the part of her Choctaw ancestor with the provisions of the 14th article of the treaty of 1830. See how they basically call these people liars?John Harper was denied by William Ward, who was proven to be corrupt. They then had to live as white as they were forced to live around white people who were openly hostile to Indians. The government goes on a program to eliminate Native languages and they deny John Harper's descendants for these very reasons. Isn't it interesting though that all of these people, living in different parts of the country, had the same story about their ancestors? Halito, Yes you have the right files. There are many for our family and many that have considerable evidence in them. I think it is interesting that although these people lived in different parts of the country, they all had the same story. I believe that alone is confirmation. Also, there are some members of our family who did make it on to the rolls. Now how does that make sense. Furthermore, how they denied them based on appearance. If you have a full blooded Indian and a full blooded Caucasian, half of the offspring will have the appearance of being Caucasian and half will have the appearance of being Indian, with both having some of the characteristics of the other. In my mother's family, half of her siblings appear Scot-Irish and half appear Indian. John Harper and his wife Mary Ann Harper were full blooded Choctaw. They and their children spoke fluent Choctaw. In other files there is considerable evidence of that. Also, on the Ky. tax lists all of their property, including livestock, was recorded in Mary Ann's name. This is Choctaw tradition. The Europeans and then the Euro-Americans would criticize the Indians for allowing their wives to own property. Now why would John and Mary Ann Harper do this unless it was very important to them? That alone is very strong evidence that they were Choctaw. Also, John Harper was denied scrip by William Ward, the corrupt Choctaw agent. There was a congressional investigation of him and they found considerable wrongdoing by him. However, they did not give the victims any remedy or recompense for what he had done. I believe the Dawes Commission just followed through and continued the insult just so they could be consistent. Also, they mention that they did not speak Choctaw. Well, after John Harper was denied, he had to go to Mississippi and sell his land in the Choctaw Nation. I have the records. He was of very advanced age at the time, so all of this traveling must have been very difficult. I believe he did this, because he couldn't go to Oklahoma because he was denied and he couldn't keep the land because it was being given to whites. Now this is a period of very intense Indian hatred. I believe it would be smart to have your family live as white in such circumstances. Also, the government was trying to eliminate the use of Indian languages. So you're cut off from your people, forced to live in a hostile environment, i.e. around people who hate you, the government doesn't want you to use your language and they deny you for these very same reasons. I especially liked the part where they said the person had black hair, black eyes and dark complexion but had the appearance of a white person. lol.
