    3. If you read what I stated, John and Mary Ann Harper, who were full blooded Choctaw and spoke fluent Choctaw were denied scrip by the corrupt Choctaw agent William Ward. They could not remove because Ward denied them scrip. This was proven in a Congressional investigation of Ward but they did not allow the people any recompense. Also, some of the family were accepted, although they are not my direct ancestors. Family of John Harper's sister were accepted.     3. Halito, Yes you have the right files. There are many for our family and many that have considerable evidence in them. I think it is interesting that although these people lived in different parts of the country, they all had the same story. I believe that alone is confirmation. Also, there are some members of our family who did make it on to the rolls. Now how does that make sense. Furthermore, how they denied them based on appearance. If you have a full blooded Indian and a full blooded Caucasian, half of the offspring will have the appearance of being Caucasian and half will have the appearance of being Indian, with both having some of the characteristics of the other. In my mother's family, half of her siblings appear Scot-Irish and half appear Indian. John Harper and his wife Mary Ann Harper were full blooded Choctaw. They and their children spoke fluent Choctaw. In other files there is considerable evidence of that. Also, on the Ky. tax lists all of their property, including livestock, was recorded in Mary Ann's name. This is Choctaw tradition. The Europeans and then the Euro-Americans would criticize the Indians for allowing their wives to own property. Now why would John and Mary Ann Harper do this unless it was very important to them? That alone is very strong evidence that they were Choctaw. Also, John Harper was denied scrip by William Ward, the corrupt Choctaw agent. There was a congressional investigation of him and they found considerable wrongdoing by him. However, they did not give the victims any remedy or recompense for what he had done. I believe the Dawes Commission just followed through and continued the insult just so they could be consistent. Also, they mention that they did not speak Choctaw. Well, after John Harper was denied, he had to go to Mississippi and sell his land in the Choctaw Nation. I have the records. He was of very advanced age at the time, so all of this traveling must have been very difficult. I believe he did this, because he couldn't go to Oklahoma because he was denied and he couldn't keep the land because it was being given to whites. Now this is a period of very intense Indian hatred. I believe it would be smart to have your family live as white in such circumstances. Also, the government was trying to eliminate the use of Indian languages. So you're cut off from your people, forced to live in a hostile environment, i.e. around people who hate you, the government doesn't want you to use your language and they deny you for these very same reasons. I especially liked the part where they said the person had black hair, black eyes and dark complexion but had the appearance of a white person. lol. You know, Grandpa at the age of 20 and the Smith girl at the age of 19................Then, I finally found my Father's Late Birth Certificate. He had not had a birth certificate until 1976 or thereabouts, so he had to have one for his Social Security and in getting one he had to prove his birthday, etc. So, by golly, guess who he got to verify his age? Orlean Smith, the same Orlean Smith who is the son of Annie Smith. And, in Orlean Smith's statement, he verified that Francis M. Hendrix was my Father's true birth Mother and she appears as such on my Father's birth certificate. And, I'm pretty convinced that Francis M. Hendrix was the daughter of Lorenzo Dow Hendrix and Katherine Benson. I've attached the same Canadian Township 1910 census ( different page ) that lists the Hendrix's ( they are about middle page on the sheet ). BTW, the whole darn bunch of them, the Benson's, Hendrix's, Barnes's, Payne's are all buried at Crowder Cemetery ( With the exception of my Father and Mother who are buried at the cemetery in Hugo, OK.). Father's name: Howard C. Payne - Born 21 Apr 1912 in Canadian township, Pittsburg county, OK., Died 13 Sep 1991, Hugo, OK His Mother's name: Francis M. Hendrix - Born 1892 in Arkansas (this is all I have, sorry). His Mother's Father: Lorenzo Dow Hendrix - Born 1841 either in Mississippi or Alabama (either around Philadelphia MS or in Mobile or Washington county AL). Married Katherine K. Benson c. 1880. Died 1912 in OK (probably in Crowder or Canadian, Pittsburg county, OK). Katherine Kate or Katy Benson was born either in 1854 or 1860 in Alabama and died in 1928 in Crowder, Pittsburg county, OK and is buried in Crowder Cemetery. Katy was married previously to marrying my Gr-Grandad Lorenzo, to James William Barnes. James was killed in 1880 by white people, probably in Crowder/Canadian and is buried in Crowder Cemetery. I lose track of these folks in MS or AL and can get no further back than that. My Father was some blood quantum and we were always told that his mother (Francis W. Hendrix) was "a lot Indian", whatever "a lot" is. We were never told much more than this, whether that is because our Father WAS Indian or, possibly, because his Mother and Father maybe didn't have "the benefit of clergy". I do know that we kids (my Brother, who is the Judge down at Hugo, and I) were never told that our REAL Grandmother (Francis) and all her folks were living right there in Crowder, along with our Mother's folks and our Father's Father (Walter Payne) and his Step-mother.     3. Halito, I am Choctaw and have a number of Barneses. You will have to excuse me though, I have lost some of my data and reorganizing what I have left, so I'll only be able to give you part of what I have for now. The Barnes name is a trader name. As you might be aware, most of the traders intermarried into the tribes they were trading with. The data I have for you today, is taken from a list of people from my family, who attempted enrollment in the Choctaw Tribe during the Dawes' Commission. The Barneses on my list are: Athley Barnes MCR# 7167, application# 911; Lydia Barnes MCR# 6544, application# 276, 279a. You can order these records from the NARA and they are usually loaded with genealogical information. I will be ordering more information soon and will get back with you on what I have found. I will also get back with you after I am finished reorganizing my data. It will take some time, though as I have a considerable amount to do. I do have more info. on the Barnes family. Katherine Kate or Katy Benson was born either in 1854 or 1860 in Alabama and died in 1928 in Crowder, Pittsburg county, OK and is buried in Crowder Cemetery. Katy was married previously to marrying my Gr-Grandad Lorenzo, to James William Barnes. James was killed in 1880 by white people, probably in Crowder/Canadian and is buried in Crowder Cemetery. I lose track of these folks in MS or AL and can get no further back than that. My Father was some blood quantum and we were always told that his mother (Francis W. Hendrix) was "a lot Indian", whatever "a lot" is. We were never told much more than this, whether that is because our Father WAS Indian or, possibly, because his Mother and Father maybe didn't have "the benefit of clergy". I do know that we kids (my Brother, who is the Judge down at Hugo, and I) were never told that our REAL Grandmother (Francis) and all her folks were living right there in Crowder, along with our Mother's folks and our Father's Father (Walter Payne) and his Step-mother.
