HARDING, of the town of Dobbins, County of Yuba, State of California, being of sound mind and disposing mind and memory, and not acting under duress, menace, fraud or undue influence of any person whatever, do make, publish and declare this my Last Will and Testament, hereby revoking all other Wills by me made. First, I direct that all my just debts and funeral expenses be paid as soon after my decease as conveniently can be done. Second, I hereby give, demise and bequeath unto my son, Leo B. Harding and my daughter, Mrs. Jewel Deal, all my estate, real, personal and mixed, of every nature, kind and description, wherever situate and however held, which is or may be subject to my testamentary disposition at the time of my death. The division of my estate, real, personal and mixed, of every nature, kind and description to be shared and shared alike, divided as near equally between my son and daughter as possible. In case of the death of my son, Leo B. Harding, before this estate is settled, his share shall go to his living child or children equally divided. In case of the death of my daughter, Mrs. Jewell Deal, before the estate is settled, shall go to her child or children equally divided. Third, I hereby nominate, constitute and appoint, my daughter, Mrs. Jewel Deal, as executor of this, my Last Will and Testament, and I direct and request that no bond or other security be required of her as such executor or in any capacity in which she may act under this will. I give her power to sell all or any of my estate without an order of Court and the returns from the same to be divided share and share alike between my son and daughter or as stated above for each of their children. IN WITNESS WHEREOF I, CHARLES A. HARDING, the Testatrix above named, have hereunto set my hand and seal, this 4 day of June 1950 in the year of our Lord, One Thousand Nine Hundred and Forty One. The foregoing instrument, consisting of two pages, including the page signed by the testator, was at the date thereof by Charles A. Harding, the maker thereof, signed in our presence, and in the presence of each of us, and at the time of his subscribing and instrument he declared that it was his Will, and at his request and in his presence and in the presence of each other we have subscribed our names as witnesses thereto.
