    3. Judie Cook has asked for more information on this Bill. According to the previously amended language for SB 1614: "This bill would require the comprehensive index described above, and birth and death record indices prepared or maintained by local registrars and county recorders, to be kept confidential, except that these indices may be disclosed to government agencies as prescribed by law. This bill would exempt these indices from disclosure under the California Public Records Act. This bill would prohibit a government agency from selling or releasing these indices except as authorized by law. This bill would also prohibit specified entities and individuals from releasing any of the information contained in a comprehensive index purchased from the State Registrar prior to December 31, 2001, to a 3rd party. This bill would authorize the department to assess an unspecified civil penalty to enforce this provision against individuals and other specified entities. "This bill would require, on or before an unspecified date, the State Registrar to establish separate noncomprehensive electronic indices of all California birth and death records and make the indices continuously, electronically available to county recorders' offices statewide. "This bill would require the noncomprehensive indices to be available at the State Registrar's office and in county recorders' offices for public inspection and viewing only at computer terminals designated for this purpose , by individuals who have signed a standard form certifying, under penalty of perjury, that the information they view will not be used for criminal purposes. By expanding the scope of the crime of perjury, and by increasing the duties of local officials, this bill would impose a state-mandated local program. "The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement, including the creation of a State Mandates Claims Fund to pay the costs of mandates that do not exceed $1,000,000 statewide and other procedures for claims whose statewide costs exceed $1,000,000. "This bill would provide that with regard to certain mandates no reimbursement is required by this act for a specified reason. "With regard to any other mandates, this bill would provide that, if the Commission on State Mandates determines that the bill contains costs so mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above. "Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes." As amended on May 30, 2002, SB 1614 has been reduced to the following: "SB 1614, as amended, Speier. Public records: vital statistics. "Existing law requires the Director of Health Services, as the State Registrar of Vital Statistics, to administer the registration of births, deaths, fetal deaths, and marriages. Existing law requires the State Registrar to arrange and permanently preserve the certificates in a systematic manner and to prepare and maintain a comprehensive and continuous index of all certificates registered. "This bill would declare the intent of Legislature to enact legislation to protect the confidentiality of birth and death record indices. "Vote: majority. Appropriation: no. Fiscal committee: no . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. It is the intent of the Legislature to enact legislation to protect the confidentiality of birth and death record indices." Margie Campbell of San Joaquin County commented that it was probably a combination of Senator Speier and others receiving opposition correspondence and the present state of California's budget deficit and further impending financial woes. While this might be true, the fact that the Bill was not pulled entirely by Senator Speier tends to make me believe, as Phil VanCamp noted to me, that we need continue to be vigilant. If not, they could slip this through packaged with something else that would pass before we know it. As I said, for the work that we do we use the vital statistics information to identify any family members who may be buried in unmarked graves in our over 200 historic cemeteries. The information often gives us another clue as to how to contact family descendants to advise them of the condition of the cemetery where their loved ones are at rest. In many respects, we have acted as ex-officio family genealogists for hundreds of our county's pioneer residents. PLEASE don't contact me with genealogy requests, the other half of our battle is to protect the unmarked graves in the cemeteries from being desecrated by current interments AND convincing our county of the vested (prescriptive) PUBLIC title to the vast majority of the cemeteries. We have recently received a free website hosted by US GenNet and will be producing pages about what is happening in our county. It is not a pretty tale... IF you have a genealogy inquiry, please us the US GenWeb site for El Dorado County. We frequently check those postings and respond with whatever information we may have. Let's stay vigilant on this access to public vital statistics. The internet is a valuable and powerful tool to use in order for our voices to be heard.     3. Greetings, SB 1614 which would have severely restricted access to birth and death records in California, appears to have to have been amended by Senator Jackie Speier. A brief review leads me to believe that Senator Speier may have received a large number of comments in opposition. To review the new text, go to: http://www.leginfo.ca.gov/cgi-bin/postquery?bill_number=sb_1614&sess=CUR&house=B&search_type=email It is important for genealogists everywhere to keep your eyes and ears open for potential future changes to this bill or the introduction of additional proposed legislation that may act to restrict access to public records. While I personally can understand the desire to stop identity theft, and I acknowledge that our new War on Terrorism may be dependent on stopping people who will steal the identities of others to commit egregious acts against our country and citizens, we cannot allow the acts of a few criminals to cause us the loss of freedom to these important documents of the past. If there are any professional genealogists out there who may have a reasonable solution the state could use to help prevent identity theft, I would hope you might contact Senator Speier's office and offer your recommendations or suggestions. Those who work at this craft by profession are going to be the ones who, by far, have the most vast and varied experiences that would lend itself to understanding the obstacles created by lack of record availability. He was born Aug. 14, 1911 in Oxnard, California. When he was five years old, in 1916, his parents bought a ranch in Winters where he lived for the next 85 years. Mr. Fulton went to Wolfskill Elementary and graduated from Winters High School. Upon graduation, he had several different careers, including: breaking mustangs, delivering mail, hauling dynamite, building roads and dams, and farming in Winters, Dixon and Sacramento. His wife of 69 years, Trudy Fulton, his four children, John Harold Fulton, Lawrence Fulton, Thomas Fulton and Leah Singleton. His seven grandchildren and 12 great-grandchildren also survive him. A memorial service was held at 8642 Tubbs Road on Saturday, May 11, for close friends and family. Mr. Fulton had a great love of life and was very active until a few short weeks ago. He had a sound body and mind up until the end, and will be greatly missed. He was a success to all of those that knew him. They answered a big question, who his parents were. Now I know where he fits in the Charlebois family. Paul must have been a colorful character and liked to embelish things because his bio is full of holes. For one thing, he was older than he claimed to be. Both the census info and his obituary indicated he was born about 1850. His parents had a son named Pierre Paul that was born December 07, 1844. I think this is our Paul. Besides, he couldn't have been born in 1850 because his mother died March 14, 1848 four days after giving birth to his sister Julie Odile Charlebois. The part about his father dying at an early age is wrong too because his father died April 10, 1884. His father actually married twice more after Paul's mother died and had a total of 18 children between his three wives. The Bio also says his grandfather, Joseph, was born in France. He was actually born October 19, 1774 in Quebec and was a third generation Charlebois to be born in Quebec. It was actually Joseph's g-grandfather that was born in France Still it made for some interesting reading and I really appreciate your sending it. Dave

IN TRAIN-TRUCK CRASH ACCIDENT AT COLONIA ROAD INTERSECTION Truck Hurled 40 Feet By Impact of Espee Train At 3 o’clock this afternoon Earl Rodgers was still unconscious and his condition critical, according to the report from St. John’s hospital. Earl H. Rodgers, of 161 North G street, well known chicken rancher, was critically if not fatally injured Sunday afternoon at 6:42 o’clock, when his truck was struck by southbound Southern Pacific train No. 72, known as the “Daylight Limited,” at the Colonia road intersection, near the northern limits of Oxnard. With the track in full sight and clear view on either side of him, and with the locomotive whistling warning him of the approach of the train, Rodgers approaching Oxnard boulevard from Colonia Gardens, drove his truck on the tracks before he seamed to realize danger. Then, in an effort to avert the crash, he cramped the steering wheel to his left, but too late. The locomotive struck the truck with such force as to hurl it some 40-50 feet to the south and east, and turned it three-quarters way around. Rodgers was found pinned underneath the truck. He was unconscious and blood was oozing from various cuts about the face and head. Men from among the crowd that soon gathered lifted the truck and others called an ambulance. S. H. Diffenderffer & Son responding. The injured man was removed to St. John’s hospital and Dr. B. F. Korts was called. Today Rogers was still unconscious. Dr. Korts stated this afternoon that Rodgers suffered concussion of the brain and bad cuts and contusions. He said X-ray pictures had not been taken and the full extent of the injuries could not be determined until Rodgers regained consciousness. Train No. 72 was in charge of Conductor Pat Mahoney with Engineer D. J. Purcell in charge of the engine. Purcell was quoted as saying that he saw the truck approaching the track, that it was moving slowly, and that the whistle was blown. He thought that the driver would stop, of course. Then seeing that he did not stop, he applied the air, but too late to stop. The train was brought to a stop near Magnolia, the next intersection. Mel Bastien of the Railway Express, among the first in the huge crown that gathered after the crash, picked up Rodgers’ watch in the intersection of Magnolia avenue and Oxnard boulevard, some 400 feet from the scene of the acident. The waten case was badly bent, the crystal gone and only the hour hand remaining on the face. This morning Dr. A. L. Matz, near whose animal hospital the accident occurred, picked up Rodgers’ glasses, unbroken, near the accident. “Bud” Yargan and Special Officer George Champlin maintained order among the large crowd of curious spectators that gathered at the scene of the wreck. The identity of Rodgers was not established until he reached St. John’s hospital and after the blood was washed off his face. The truck was registered to Rodgers Bros., 225 F street. Rodgers, 57, injured Sunday evening at the Colonia road intersection when his truck was hit by the Southern Pacific Daylight limited coming into Oxnard, died this morning at 4:20 o’clock at St. John’s hospital. Rodgers never regained consciousness. Funeral services have been set tentatively for Friday. Definite arrangements are dependent upon relatives, his brother, J. G. Rodgers, stated this morning. The deceased was a member of Oxnard Lodge No. 341, F. & A. M., and also of Oxnard Chapter No. 86, Royal Arch Masons. He had served two years as high priest of the chapter. A year ago he was a write-in candidate for the Oxnard city council and served a year as president of the Oxnard Indoor ball league. For the past 12 years he had been associated with his brother in the chicken business, previous to that being connected with the Southern California Edison company. He had lived in this section for 16 years, spending some of that period in Los Angeles and Santa Barbara. Besides his wife [Sue Haworth], Rodgers leaves three brothers, J. G. of Oxnard, Charles of Broomfield [Bloomfield], N. J., Dolph of Wellsberg, West Va,; two sisters, Mrs. Monde Dodd of West Virginia and Mrs. Willadda Noble of Noble Penn. The accident occurred when the train hit Rodgers’ truck as it was coming west from Colonia Gardens.
