O Good....so far I am not seeing a follow-up in the Tribune that might reveal the outcome, but I'll look a little further. I might add, though, for historical context, that 1964 was a rather hot year regarding abortion. There are articles about Sherry Finkbind and the Thalidomide babies....numerous stings were being carried out through this summer in the East Bay, employing women undercover agents, one noted to be from Stockton, but unnamed, beyond this trial...as well there is much legislation in the works in Sacramento and it is being debated by the legislators, academics, and clergy. OAKLAND TRIBUNE Mistrial Declared Martinez--In an unusual court action yesterday, the district attorney's office obtained a mistrial because a prosecution witness refused to testify about her personal life. Most mistrials are granted to the defense. It occurred in an abortion trial involving two former Richmond chiropractors, Dr Joseph D Sieff, 51, now of San Leandro, and his former partner, Dr Lawrence Giubbini, 60, who resides in San Anselmo. District Attorney John A Nejedlly strode into the courtroom of Superior Judge Martin E Rothenberg to make the motion for mistrial following the third refusal of a key witness to answer questions put by the defense and the judge. Judge Rothenberg held Mrs Patricia Huff of Oakland in contempt of court for her refusal to answer a question put to her by one of the defense attorneys, Irving Sugarman of Richmaond. The question concerned the history of her marriages. Sentencing was put off until Monday at 9:30 am on Mrs Huff's refusal to heed Judge Rothenberg's directions to answer. The indictment against the two defendants still stands, Nejedly said and, following a review of all the evidence, a new trial can be held. "There is a cloud on the evidence when the state's witness refuses to testify," Nejedly explained. "When the witness refused to testify, we could not logically proceed with dignity." "It takes a lot of courage to do this sort of thing and to do it under these circumstances when so much work has gone into the case," said Judge Rothenberg. The jury had heard eight days of testimony in the trial before its abrupt end. To the jury Rotheberg said, "This is a case you will long remember from many standpoints. It is a case in which justice has been done because this is an action a district attorney ought to take under such circumstances." Dear Pat, I haven't seen anyone mention my all girl Catholic school, Notre Dame de Namur. It was on Dolores Street at 16th Street, across from the old Mission Dolores. It was a 12 year school and some of the girls were from rural areas. They boarded at the convent school. The same nuns also taught at the boys school, Mission Dolores, which is on 16th Street between Dolores and Church Sts. It is still a school. Notre Dame closed down many years ago. This is the same order of nuns who have other schools in the Bay Area and the Notre Dame de Namur University in Belmont, Ca., a suburb south of The City. Hi Trina, I am wondering if in your research you may have came across anything about a boy, probably in this teens, who committed suicide by jumping off a cliff somewhere near or in Holy Cross Cemetery? There is a story in my family that my grandmother's brother was sent to live with an aunt after their parents death around 1890 and was so unhappy living there that he killed himself near to his parents graves. My grandmother was younger and was adopted by family friends named Ott. My grandmother's birth surname was Ward and that is really all that I know about her natural family.
