William CARSON was indicted for Grand Larceny 10 FEB 1866. [Note: His case is #435, on a long list of 30 indictments brought the same day.] Parke County Indiana Complete Record, Circuit Court, Vol. 6, Page 274-276. [Note: The last paragraph at the bottom of this message is duplicated in Parke County Indiana Civil Order Book 7, Page 545.] At a Circuit Court within and for the Eighth Judicial Circuit in the State of Indiana begun and held at the Court House in the Town of Rockville, County of Parke and State aforesaid, on the first Monday, it being the fifth day of February in the year of Our Lord, One thousand eight hundred and sixty six, before the Hon. John M. COWAN, sole judge of said Court presiding. Comes now the following Grand Jurors, to wit: Cyrenius Pruett, Allen Edmunson, Daniel S. Kally, James M. Elder, Samuel Burnside, Riley Swaim, Barnabas Hayworth, Eli Beauchamp, John Priegar and John H. Weaver, and it appearing that said parcel of Grand Jurors is not full, it is ordered by the Court that the Sheriff fill the same from the bystanders, of the Townships unrepresented, as nearly as possible, whereupon, cause Andrew McClure and Amos Harvey, who with the regular panel aforesaid answering to their names complete said panel being twelve freeholders and householders of our said county, and the court appoints Amos Harvey, foreman of said Grand Jury, which being duly instructed by the Court, retire in charge of E. N. Burford, Esqr., their sworn bailiff to consider of Indictments and presentments ~ And afterwards, to wit: on Friday the fifth judicial day of said term of Court, it being the ninth day of said month ~ Comes now into open Court the Grand Jury and report that one of their number, to wit: Cyrenius Pruett, is so seriously indisposed as to unfit him to serve longer as one of said Grand Jury, and the Court being satisfied of the truth of said report, it is ordered by the Court that the said Cyrenius Pruett be discharged as Grand Juror. Thereupon it is further ordered by the Court that the Sheriff fill the vacancy on said Grand Jury occasioned by the discharge of the said Cyrenius Pruett from the bystanders and from the Township represented, if possible. Then comes into Court John Thomas who being duly sworn and instructed by the Court takes his place as a member of said Grand Jury and thereupon said Grand Jury retire in charge of their sworn bailiff to consider of Indictment and Presentments. Cowan And afterwards, to wit- on Saturday the sixth Judicial day of said term of Court, it being the tenth day of said month ~ Come now the Grand Jury and return into court the following indictment, to wit: State of Indiana Parke County, SS, Parke Circuit Court February Term, 18 ult. The State of Indiana vs William CARSON. Indictment for Grand Larceny. The Grand Jurors of Parke County in the State of Indiana, good and lawful men, duly and legally empaneled, sworn and charged in the Parke Circuit Court of said State at the February Term for the year 1866, to enquire into felonies and certain misdemeanors in and for the body of said county of Parke in the name and by the authority of the State of Indiana, on their oath do present, that one William CARSON late of said county, on the 15th day of September, A. D. 1865 at said county and State one buggy of the value of one hundred dollars, one pair of harness of the value of twenty five dollars of the personal goods and chattels of Samuel STROUSE, then and there being found did then and there feloniously steal, take and carry away, contrary to the for! m of the Statute, in such cases made and provided and against the peace and dignity of the State of Indiana. The State of Indiana vs. William Carson A true bill, Amos Harvey, foreman witnesses Samuel Strouse, James Green, James Glass, Esq. S. J. Wood, Prosecuting Atty Filed Feby 10th, 18 Ult. Samuel Magill, Clerk Read and signed in open court Signed John M. Cowan and afterwards to wit --Comes now the prosecutor prosecuting the pleas of the State, and also comes the defendant in person, and being duly arraigned says he is not guilty as charged in the indictment, And said defendant says he is in destitute circumstances, unable to employ counsel, whereupon the Court appoints T. N. Rice to defend said defendant, and said attorney accepts said appointment, and on motion and by agreement of the parties this cause is submitted to the Court for trial without the intervention of a Jury, and the Court having heard the evidence and being in all things fully advised in the premises, finds the defendant guilty as charged in said Indictment. And thereupon the Court asks said defendant if he has anything to say why sentence shall not be passed upon him, and defendant declines to allege any thing. It is therefore considered and adjudged by the Court that for such his offence, the defendant be confined at hard labor in the State Prison at Jeffersonvi! lle for a term of two years, that he be disfranchised and disqualified to hold an office of trust or profit for the space of two years, that he make his fine unto the State of Indiana in the sum of one cent and pay the costs of this prosecution, and that he stand committed till his fine & the costs are paid or replenied.
