This latest legislative watch update is in regards to obtaining vital records from the California Dept of Health Services. ----- Original Message ----- Callifornia DHS UPDATE: Department of Health Services Public Count will be closed as of November 25, 2003 due to Budget Cuts. Officially, last Friday, the administrative order was announced that the Counter will be closed to walk-in applications for vital records and six Department employees will be reassigned. Budget 'cuts to the bone' are cited as the reason the Department of Health Services management has decided that the Public Counter should be closed, in spite of the fact that this is one of the operations that brings revenue into the Department. The reasons, we can all speculate upon, but the fact is that this move will not only affect genealogist and researchers, but the public in general. This includes those who need to obtain birth certificates for children beginning school, college registration, and passports. The one light at the end of the tunnel is that most California County offices will continue to be open for walk-in requests for birth, death, marriage, divorce documents. The Department states that the turn-around time will be four weeks. What, if anything, can be done about this remains to be seen. It is hopeful that with the change of Administration in the Governor's office and new appointees, we may see changes in policy. At this point we can only wait and see. We will continue to monitor the situation. If and when efforts on our part could make a difference, I will let you know. I will stay on top of this problem. Greetings, On the eve of Veterans Day I've been reflecting on the many historic cemeteries in which a vast number of our nation's veterans are still buried. Many, many of those cemeteries are in sad states of repair and care with our civil representatives having ignored their plight and condition for many decades now. As you spend your Tuesday with your co-workers, family or friends, please remember your ancestors who fought for our nation. If you are able, please go to a local historic cemetery and see if the cemeteries where our veterans now rest in peace are in the kind of condition you believe they deserve. If they are not in a well maintained cemetery, take the time to call your local representative and ask that some attention be paid to the neglected cemeteries where these veterans now lie for eternity. Ask them if they would want their ancestors to rest in a place that looks so bad or if they believe the resting places of our veterans should be so disrespected. If you are having trouble finding funding to help care for the historic cemeteries of your communities, perhaps you will appreciate my message. It focused on cemeteries based upon the most costly, prestigious, and well maintained. While this is all well and fine for the current rich and famous, we have to wonder why it is that Forbes has not discovered that in our own country there are literally thousands of abandoned and neglected historic cemeteries. These are the cemeteries of the people who built this great nation and the states and cities of this union. Yet, in a tragic turn of moral neglect, they are wasting away from lack of care, being bulldozed to make way for new generations of Americans, and being ignored by elected civil authorities. It says a lot about America that we will expend billions of dollars to help reconstruct Iraq but spend nothing on the care of the graves of our own forefathers. Greetings, As originally written SB 1059 included a provision that requires the county tax assessors to utilize a postcard method to contact cemetery authorities who file Cemetery Exemption Forms to receive tax exemption on cemetery properties. After the Bill was introduced I contacted the Senate Revenue and Taxation Committee to inquire about adding something that might help prevent the historic cemeteries from being sold for delinquent taxes. Three years ago I had contacted Dean Andal of the Board of Equalization with the same request. With his help, we had started to work on developing some language that could be added to the Revenue and Tax Code. Someone at BOE dropped the ball and we never completed it. This time, however, the committee's consultant, Martin Helmke, and an attorney with the BOE, Rose Marie Kinnee, responded, and we were finally able to have something added that I hope will help, even if a little. It is not perfect, but it is a start. Since we did not have an existing definition for "historic cemetery", we chose to have this apply to cemeteries that began to be used previous to 1900. This, of course, includes a great many of the historic cemeteries in the state so that this new code section could feasibly apply to thousands of cemeteries. The sections within SB 1059 applicable to the cemeteries are 256.6 and 256.7, which reads as follows: 256.7. (a) Notwithstanding Sections 254, 256.5, and 256.6, an affidavit claiming the cemetery exemption, as provided for in subdivision (g) of Section 3 of Article XIII of the California Constitution and Section 204, is not required to be filed in order to receive the exemption for any cemetery that exists, or is discovered to exist, in the unincorporated area of a county for which the assessor is unable to identify the legal cemetery authority, as defined in Section 7018 of the Health and Safety Code, that may by law claim the exemption for that cemetery, if both of the following apply: (1) The cemetery was used by residents of the state prior to the year 1900. (2) The cemetery is no longer used for current or future interments. (b) Any tax, penalty, or interest imposed upon a cemetery subject to this section shall be canceled pursuant to Article 1 (commencing with Section 4985) of Chapter 4 of Part 9, as if it had been levied or charged erroneously. Only time will tell if Sec. 256.7 will be of any benefit, but had it been in place in 1998 when the Cold Springs Cemetery in El Dorado County was about to be sold for delinquent taxes, perhaps the El Dorado County Pioneer Cemeteries Commission would not have had to claim "ownership" of that historic public cemetery through acceptance of a Quit Claim deed. In the past other historic cemeteries have been sold to satisfy delinquent property taxes. By law, the public acquired title to those cemeteries even though the boards of supervisors of the counties where they were situated did not officially claim the public's property. If your county has any "abandoned" cemeteries or cemeteries that may have no legal cemetery authority in attendance of it, you may want to contact your county tax assessor to advise that office that the cemetery may not be subject to taxation. Hello, Since 2000 I have been involved in trying to get California legislation enacted that will help the plight of our state's historic cemeteries. In 2000 a Bill was introduced and passed both houses of the legislature (only 5 NOE votes) that would have created the California Historic Cemetery Commission. That commission would have cost almost nothing but would have contributed greatly to the review and assessment of the status of our historic graveyards. In the Fall of 2000, GOVERNOR GRAY DAVIS vetoed the Bill even though his office had been consulted as to the Governor's preferences on how the Bill should have been framed. Lately I have been working on portions of existing Bills to ensure that the needs of the historic cemeteries that could be addressed through such Bills are considered. I will be sending out information on a couple of items once they are signed by Governor Davis - if they are not also vetoed by him.... If there are any of you who see a need that may need additional legislation in order to assist the historic cemeteries, please contact me direct at [email protected] I will try to advise you or otherwise determine if or how such legislation might be addressed. I'd like to thank those who in the past have sent me emails of support. Our California ancestors all repose in California cemeteries. The vast majority of the cemeteries in the state are historic and pre-date the 20th century. It is important that we provide protection and preservation of these places of rest. Some suggestions, in general, for people requesting obit or other newspaper look-ups. . . There are currently at least eight cities/towns/communities in Placer County that publish newspapers. The chances of finding an obit increase dramatically if you can provide the name of the community where the decedent lived, because a local researcher could then determine which newspapers are most likely to carry the obit. Back issues of some newspapers are available at the local libraries. For example, the Roseville Library has the *Roseville Press-Tribune*, the Auburn Library has the *Auburn Journal*, and I think the Colfax Library has the Colfax newspaper. Back issues of some of the smaller, local newspapers are available only at the newspaper offices and sometimes those are kept in storage. At no place in the county are all the newspapers available for research in one location. For a small fee, the Roseville Genealogical Society will do look-ups in the Roseville newspapers at the Roseville Library. Peter Dolgenos, Sutro Library (Branch of the California State Library) tells us: 'The California State Library will be affected by the cuts in the governor's proposed budget, but not as badly as was originally thought. 'As you may know, the Sutro has had to eliminate Saturday hours, but we are still open Monday through Friday, 10 AM to 5 PM. 'Our staff has been cut (without layoffs), but we are still able to perform essential tasks such as reshelving books. 'Our acquisitions budget has been cut, but not to zero. We continue to be grateful for material that is donated to us. . . . We do not plan to charge user fees.' In my early reports there was some confusion regarding the planned move of the Sutro Library into the J. Paul Leonard Library on the San Francisco State University campus. This move has been planned for some time and had nothing to do with the budget cuts. The move is scheduled in about four years. Sutro will remain under the control of the State Library, it will continue to be run and managed as it is presently. The move is being made to this up-graded facility for the safety and preservation of the collection. We will learn more about this as plans are worked out. Genealogists can rest assured that Sutro is alive and well according to Dolgenos. The second item I need to report on is the Federal Social Security Misuse Prevention Act, S228 and HR637. Neither bill as had any action since I last reported on them in May. I have not heard any news about the possibility of the author(s) taking amendments to included only living person. I will get back to you with any news on these bills. Just as a reminder, Public Notices are being issued in newspapers throughout the state to explain the July 1, 2003 changes in the law governing requests for California birth and death records: Beginning July 1, 2003 California Health and Safety Code Section 103526 permits only specific individuals to receive an AUTHORIZED CERTIFIED COPY of a birth or death record. An AUTHORIZED CERTIFIED COPY of a birth record is required to obtain a driver's license, passport, social security card and other services related to an individual's identity. An AUTHORIZED CERTIFIED COPY of a death record may be required to obtain death benefits, claim insurance proceeds, notify social security and obtain other services related to an individual's identity. Please see below for a list of authorized individuals. Those who do not meet the criteria for an AUTHORIZED CERTIFIED COPY may receive an INFORMATIONAL CERTIFIED COPY with the words "INFORMATIONAL, NOT A VALID DOCUMENT TO ESTABLISH IDENTITY" imprinted across the face of the copy. When ordering in person: an authorized individual must complete an approved application, including a signed statement sworn under penalty of perjury to receive an AUTHORIZED CERTIFIED COPY. When ordering by mail: a notarized Certificate of Identity and completed application form, signed under penalty of perjury by the authorized requestor are required. Applications and Certificate of Identity forms are available on county web sites. Individuals permitted to receive an AUTHORIZED CERTIFIED COPY: * The registrant or a parent or legal guardian of the registrant. * A party entitled to receive the record as a result of a court order, or an attorney or a licensed adoption agency seeking the birth record in order to comply with the requirements of Section 3140 or 7603 of the Family Code. * A member of a law enforcement agency or a representative of another government agency, as provided by law, who is conducting official business. * A child, grandparent, grandchild, sibling, spouse or domestic partner of the registrant. * An attorney representing the registrant or the registrant's estate, or any person or agency empowered by statute or appointed by a court to act on behalf of the registrant or the registrant's estate. * Any funeral director that orders certified copies of a death certificate on behalf of any individual specified in paragraphs (1) to (5), inclusive, or subdivision (a) of Section 7100 of the Health and Safety Code.
