These confidentiality provisions are timeless and remain in effect even after the person is deceased. The Census Pension Searches Unit was set up to provide information, to the person named in the record, from historical census records and the National Registration File of 1940 in support of applications for pensions, citizenship, passports and similar situations, where other preferred administrative records are required but no longer exist or were never issued. In light of the numerous requests like your own, the Honourable John Manley, Minister of Industry and Minister responsible for Statistics Canada, has announced the creation of the Expert Panel on Access to Historical Census Records. This matter has been a subject of concern for family history researchers for some time. As you know, Statistics Canada is prohibiting from disclosing census returns filed in 1906 and later. A Private Members Bill is in the system to amend the privacy legislation, but Statistics Canada has undertaken its own study to ascertain the support among Canadians for incorporating the researchers and historians request in government legislation. Although the study has not yet been officially released, early indications are that the study found people objected to retroactively changing legislation to allow disclosure of individual answers. There is in fact little support for releasing the historical data. Most participants felt that the government made a promise of confidentiality and that this should be respected. People who answered those censuses believed their answers would be confidential, and thus it would be a breach to release the information. However, there are yet arguments to be studied on both sides, and I will ensure that your request is seen by Mrs. Carroll for her consideration. June 27, 2000 Ms. Muriel M. Davidson I would like to thank you for your letter regarding the post 1901 census. I have been following the development of this issue for some time, and agree that historians, genealogists, and others researching their family histories gain valuable information from census data. I have communicated with the Minister Responsible for Statistics Canada, the Honourable John Manley, and expressed my hope, and that of many Canadians, that there will soon be a resolution of this issue. To date, the Minister has been considering two options: amending the law to allow future census data to be released, or retroactive changes to the confidentiality provisions of the Statistics Canada Act to release the post 1901 census information. In light of the considerable public debate on this issue, the Minister announced the creation of an Expert Panel on Access to Historical Census Records, which will be active over the next few months. I look forward to seeing the report of the Expert Panel in order to make an informed decision. There are clearly competing interests in this situation. The commitment to privacy that was made when the data was collected from individuals is against the legitimate desire of historians, genealogists and others to have access to this information. Dear Sir As one of those actively campaigning to obtain access to Historic Census records after 92 years as per Regulations attached to the Privacy Act of Canada, I am understandably upset with the report of Jim Bronskill. ( NP 20 June 2000, p. A11) Having received thousands of email and letters in the past few years from those who support access to Historic Census, I dispute the findings of the Environics Research Group survey. I have grave concerns that the questions in that survey were skewed so as to obtain a pre-determined response. The fact that this article refers to "census data ..... gathered under promises of confidentiality", and "breaking a promise" is proof of that skewing of questions. Any mention of a promise, or of breaking such a promise, contained in questions of the survey would show a bias towards the answers sought by Statistics Canada. In preparation for my submission to the Expert Panel on Access to Historic Census records I spent several months of dedicated research seeking the "promise" upon which Statistics Canada bases their position of non-disclosure of Historic Census. My submission, titled "The Myths of Census" proves conclusively that the "promise" does not exist. Statistics Canada, and Privacy Commissioner have been asked to "show me the promise." I have asked them to prove me wrong in saying "the promise does not exist." To date they have been unable to do so. On 2 June 2000, Liberal MP Murray Calder presented to the House of Commons our petition containing more than 6000 signatures. Numerous other petitions containing untold thousands of signature have been presented in both the House of Commons, and the Senate. Thousands, perhaps millions, of Canadians anxiously await the report of the Expert Panel.
