    3. Hi Everyone, It occured to me that our 'beloved' Mr. Bruce Phillips is set to retire from the Privacy Commissioner office. I did a search and at www.newswire.ca/government/federal do a search of privacy and you will find the news release that has George Radwanski as our interm Commissioner until Parliment sits and they appoint a new guy. I look at it this way when a new pernament commissioner is appointed he or she can't be any worse than Phillips. Things just might be looking up. Jacquie Nex jacnex@home.com

Davidson Canadian Census Committee 25 Crestview Avenue Brampton, ON L6W 2R8 Dear Mrs. Davidson:- Please accept my thanks for your recent inquiry into the release of post-1901 census records. I am delighted to respond to you, and I am hopeful that this letter can serve to alleviate your concerns. In recent months a number of genealogists and historians have articulated their collective disappointment that the 1911 census records will not be available for review in the public domain in the year 2003. These individuals had previously expected the 1911 census records to be made available for research purposes in the year 2003 because census records have been, up to this point, accessible to the public after 92 years. However, censuses administered after 1901 fall subject to the Statistics Act that explicitly prohibits the release of all census records. This prohibition does not allow anyone to access census records for any reason; the only exception is that an individual may access his or her own personal records – but that is the only current exception. An individual may not access the census records of anyone else, not even those belonging to his or her immediate family members, nor even those records belonging to members of his ancestral family tree. Many have argued that the release of census records is crucial to furthering the knowledge Canadians hold of the past, of their communities, of their families, and of themselves. Of course, access to census records is what enables individuals, scholars, researchers, and historians alike to trace their respective histories and to answer questions about their past: from questions as simple, yet so personally important, as when exactly one’s ancestry arrived in Canada, to questions as drawn and as nationally significant as the face of the brave men who fought and defended Canada in the first World War. Today – nearly 100 years since the Laurier government instituted the change to the accessibility of census records – it is true that times have changed dramatically, and so have cultural values. While today we place the utmost importance on personal issues, back then, as archival information indicates, the reason for keeping census records forever confidential was that Canadians feared the information would leak to tax collectors and military personnel – not because Canadians wanted to keep the information confidential forever. The goal wasn’t to keep valuable census information from historians. At a time when Canadians are increasingly interested in their past, and when private foundations such as the newly created HISTORICA are allocating millions to improve the teaching and dissemination of Canadian history, it does not make sense that we would be barred from access to our own history. While I certainly do appreciate the concern for statutory integrity and privacy interests, I do not believe that releasing the census records 92 years after the administration of the census would pose and infringement on either of these principles. This would not be an infringement of statutory integrity, neither an invasion of privacy, since after 92 years those who complete the census as adults are likely deceased, at which point the concern for privacy is moot. Furthermore, Canadians today have been quite vocal in their support for releasing census Records for research purposes. Given the overwhelming support for the release of the Records, we surely cannot ignore the call of Canadians. This is an instance where the sensibilities of Canadians – what they feel is right and justifiable – must be recognized. If Canadians of today do not feel that the release of census records is an infringement Upon the privacy rights of Canadians of yesterday, then we as legislators have no choice but to acknowledge their call.     3. To all:- I dared to ask one Ontario Member of Parliament if he would be supportive of any Bills and Motions re release of census records. It seems the voting public elect the Members of Parliament, are supposed to forget we pay their salaries when representing us, but dare not ask HOW the Member would vote on a certain issue. Knowing me, I did ask -- the Member of Parliament and his assistant(s) discussed the issue THOROUGHLY, as I was reprimanded in a phone call. The caller left no name, I believe he thought he was talking to someone with half a mind or a giddy teenager!!! I was not impressed! One remark: "Do you honestly believe YOU have a right to know how Mr. ####### will vote? That is his personal business!" [We are VOTERS] I did send a one-sided apology to clear the air -- the person already has a cute little piece of green fence -- which means NOTHING!!! All members of a certain party must vote as ordered!! Generally when an assistant sends the message, we know the name of the person -- we do not expect to deal with the Member of Parliament (we hope they are busy) -- but assistants have names. The following is the answer received -- I directed him to THE MYTHS OF CENSUS -- "they had thoroughly researched the matter":- ---------------------------- Dear Mrs. Davidson Thank you for your letter. To all Members of Parliament clinging to pieces of FENCE:- ANYONE WILLING TO WRITE TO ABOVE ELECTED MEMBERS OF PARLIAMENT? -------------------------------------------------------- To all Members of Parliament (and Office Assistants):- The answer to the Subject Line question is bluntly this:- When the Member of Parliament hangs onto the little piece of YES/NO green fence, being Non-Committal -- he/she could say YES, or could say NO. Also, some answers have been received from office assistants (we do not know if the Member of Parliament saw the memo) telling us "THEY" do not answer SURVEYS. [Assistants are not elected]. The question re Post-1901 census records release is very definitely NOT a survey --- the voters across Canada who like to do family history and need the 1906 and 1911 census want to know if their elected member will be SUPPORTIVE of census records release. Many Members of Parliament are being guided by incorrect, out-of-date publicity handouts, of which I already have received about 75!! Voters in Canada hope their elected Member will be able to answer FOR THEM -- not as the Party Caucus dictates. A vote on census release should be a FREE vote -- I will believe that when I hear it!! We have become accustomed to listening to House proceedings on CPAC -- we now recognize those in attendance and sincerely hope the Member of Parliament remembers WHO elected him or her. When the vote is taken on Jason Kenney's Motion M-160, many of us will be taking note of WHO votes HOW!!! However, with a needed legislation change, Members may feel they represent only a handful of the Canadian public -- BUT they represent ALL citizens of Canada on this important vote. There are more than 7.5 million family researchers in Canada -- found in every riding. To all:- The August 10, 2000 Canadian Census Scoreboard is as follows:- GOLD Ticks- YES --Support = 89 [David Iftody, Manitoba Liberal MP] RED X----- NO -- Against = 7 [Paul DeVillers, Ontario Liberal MP] FENCE-SITTERS [Yes/No]-- = 55 [Too many!] DECIDED NOT TO ANSWER--- = 150 [No Reply - I Have Been Elected Club] Of the 89 Gold ticks, subtract 2 - Jim Hart and Scott Brison -- a note will be added to the Scoreboard as both have resigned. The 150 BLUE ???? are mainly in Quebec, with only about 11 of their 75 Members of Parliament having the courtesy to answer. One of the Canadian Census Committee members, Jeannine Ouellet is president of one large group, vice-president of a larger group --there is no way the Quebec politicians do not know about the huge struggle to obtain release of the post-1901 census records. At one time I belonged to the QC-ETANGLO list, mainly Eastern Townships,but was unsubscribed as the listers felt census had nothing to do with genealogy -- instead, it is one of the basics. I learned the listers, believe it or not, were mainly Americans with Canadian roots -- so I got DUMPED! It has been reported to Rootsweb.com. In my way of thinking,contrary to what Members of Parliament are telling us, each elected member has an obligation to reply to ANY Canadian, not just his/her own riding. Should any writer be getting this "line", please let either Gordon Watts or I know -- he writes forceful letters!!     1. [CCC-L] A Story We Hear All Too Often!!!

To all:- One story we hear over and over again, is of people HOPING to be able to trace family members, learn names of family members, ages, WHEN and IF we are allowed to view the 1911 Canadian census. The 1901 census was the first one that included dates of birth -- often family members guessed prior to this, and why tombstone inscriptions are not always as they should be. Personally, I have ONE aunt, 98 years young, resident of Queen's Manor, Liverpool, Nova Scotia. She is hoping to learn of the release of census records because the 1911 census would be her FIRST Canadian census. My Aunt Iva, born in 1902 in Bucksport, Maine, came to Liverpool as a child, as did my mother, born in 1904. The parents, George Warren Adams of Dedham, Maine and his wife, Jane Maria Conrad (Davis) brought their family "home" to live. My grandmother was born in West Berlin, at one time called Blueberry, d.o. Eliza Conrad and James MacKenzie Davis. Many know the above -- my personal reason for wanting the Canadian census records released. Aunt Iva told me "the politicians have it all wrong -- my parents told me what they wrote on their first enumeration papers." She is an educated lady -- knows the "secrecy" never existed -- except for enumerators not to run to the next house and tell what they had already learned. [We call it GOSSIP!] There are many "Aunt Iva people" -- she wants to know she is included on a Canadian census -- others want to find family members. So -- let's stop procrastinating -- when you are shopping buy some colored No. 10 envelopes -- hot pink would be noticeable!!!! To all:- The August 10, 2000 Canadian Census Scoreboard is as follows:- GOLD Ticks -- YES -- in Support = 89 [David Iftody, Manitoba Liberal MP] RED X----------- NO -- Against--- = 7 [Paul DeVillers, Ontario Liberal MP] FENCE-SITTERS [Yes/No]-------- = 55 [Too many!] DECIDED NOT TO ANSWER--- = 150 [No Reply - I Have Been Elected Club] Of the 89 Gold ticks, subtract 2 - Jim Hart and Scott Brison -- a note will be added to the Scoreboard as both have resigned. The 150 BLUE ???? are mainly in Quebec, with only about 11 of their 75 Members of Parliament having the courtesy to answer. One of the Canadian Census Committee members, Jeannine Ouellet is president of one large group, vice-president of a larger group --there is no way the Quebec politicians do not know about the struggle to obtain release of the post-1901 census records. At one time I belonged to the QC-ETANGLO list, mainly Eastern Townships, but was unsubscribed as the listers felt census had nothing to do with genealogy -- instead, it is one of the basics. I learned the listers, believe it or not, were mainly Americans with Canadian roots -- so I got DUMPED! It has been reported to Rootsweb.com. In my way of thinking, and contrary to what Members of Parliament are telling us, each elected member has an obligation to reply to ANY Canadian, not just his/her own riding. Should any writer be getting this "line", please let either Gordon Watts or I know -- he writes forceful letters!! Paul DeVillers, MP included several lines re the Expert Panel report having been given to John Manley at the end of June. The residents of Quebec have an enthralling heritage and a marvellous history. This could be lost for the present generations and future. The last census of Quebec accessible to the researchers is that of 1901. Several Canadians, from one ocean to another, hope to obtain the possibility of carrying out search in the later censuses at 1901, (post-1901) which could be accessible in 2003. However, that will not occur without you taking part in this fight. As in the remainder of Canada, the researchers will find it very difficult to learn from the information relating to the members of their family if the censuses are not accessible. The registers of the religious parishes are significant but do not contain a grouping of the families. Let us work all together on this project. We need the censuses for our search. Recognizing the importance of historical research but also taking into account the privacy concerns of Canadians, the Honourable John Manley, Minister Responsible for Statistics Canada, created a few months ago an Expert Panel on Access to Historical Census Records. The Panel's objective is to provide independent, expert advice on the legal, privacy and archival implications of releasing historical census records. The Expert Panel has presented its report to the Minister at the end of June, but the Minister has not yet had a chance to properly review it. The Panel reviewed all relevant documents received to date, and met with key stakeholders to get their views. The Panel also accepted commentaries that cover areas of concern not previously submitted. I personally tend to support the view that since post 1906 census data has been collected under the authority of various Statistics Acts, and that this legislative framework contains strict confidentiality provisions, to permit disclosure of post 1906 census records could be viewed as a betrayal of past statutory guarantees. Of concern to many voters, who also just happen to be family researchers is HOW will you vote, after elected, on a Motion (M-160 by Jason Kenney), Bill C-484 by Liberal Member Murray Calder, or S-15 by Senator Lorna Milne? Will you SUPPORT the release of Post-1901 Canadian Census Records to the National Archives -- so researchers may view these in 2003? Will you SUPPORT the release of the 1906 census records of the three prairie provinces -- their first Canadian census? Do you SUPPORT the 92-year waiting period -- or do you feel this could be shorter, for example, 75 years, without harming privacy of people?
