    1. [CCC] Post 1901 Census -- Complaints to Information Commissioner
    2. Gordon A. Watts
    3. Greetings All The expected rejection of our Access to Information requests to Statistics Canada have started coming in. The next step in our campaign is for those receiving these rejection notices to submit a letter of complaint to John Reid, the Information Commissioner. With this in mind I have posted to the Post 1901 Census Project website (at the URL following my signature) a new page containing a sample letter of complaint. Follow the first link on the home page of the website. Following through with complaints to the Information Commissioner is a very important phase of our campaign to regain public access to Historic Census records. We expect that Mr. Reid should be prepared to take the issue to the Federal Court, as he was prepared to do for the 1906 records that were released on 24 January 2003. We hope that his investigation of our complaints will be speedy and productive. Happy Hunting. Gordon A. Watts [email protected] Co-Chair, Canada Census Committee Port Coquitlam, BC http://globalgenealogy.com/Census en français http://globalgenealogy.com/Census/Index_f.htm Permission to forward without notice is granted.

    1. [CCC] Post 1901 Census - ATI requests rejected
    2. Gordon A. Watts
    3. Greetings All. My thanks to Norma Brown for forwarding to me a copy of her notice from Statistics Canada regarding the rejection of her request for access to the 1911 Census records. The response was dated 27 June 2003 so Canada Post would appear to have been on the job for the speedy delivery. Reasons given for the rejection stated that the records have not been transferred to the National Archives and 'remain under the care and control of Statistics Canada'. It mentions that Bill S-13 is currently waiting second reading in the House of Commons and that it is intended to 'remove any legal ambiguity in relation to historical census records, including those from the 1911 Census'. We all know that there is NO legal ambiguity regarding access to the 1911 records. The letter concludes "Accordingly, at this time, the schedules of the 1911 Census are being exempted from disclosure pursuant to section 24 of the Access to Information Act which reads as follows: '24(1) The head of a government institution shall refuse to disclose any record requested under this Act that contains information the disclosure of which is restricted by or pursuant to any provision set out in Schedule II.' Schedule II includes section 17 of the Statistics Act. Section 17 of the current Statistics Act replace similar provisions found in the Census and Statistics Act, R.S.C. 1906, c. 68 under which authourity the 1911 Census was taken and pursuant to which the 1911 Census Instructions were issued. Those Instructions were issued, assented to by the Governor in Council and published in the Canada Gazette on April 22, 1911. The Instructions had the force of law and continue to be in effect by virtue of the Interpretation Act." The letter advised of the entitlement to bring a complaint before the Information Commissioner. I will shortly post a copy of what I will be sending to the Information Commissioner as my complaint. Submitting these complaints is a very important part of our campaign and I urge all who submitted ATI requests for the 1911 Census, and have been refused, to submit such complaints. Happy Hunting. 1. [CCC] ATI Requests
    2. Gordon A. Watts
    3. Good morning Pamela. I am aware that there have been many ATI requests submitted for access to the schedules of the 1911 National Census of Canada, including one of my own. In accordance with the ATI Act, Statistics Canada is required to respond to such requests within 30 days of receipt of those requests. That period, for many of the submitted requests will expire this week. I am receiving inquiries from a number of people who submitted requests and who state they have received no acknowledgement of receipt for their requests. I have, myself, received no such acknowledgement for my own request mailed 2 June 2003. Would you be so kind as to advise me of the current status of the ATI requests for access to records of the 1911 National Census of Canada? Might we shortly expect to receive a response to our requests? I look forward to receiving your reply so that I might advise others who are asking me these questions. Have a great day! Gordon A. 3. Betty. You beat me to it. I was about to ask the same question. Has ANYONE received even an acknowledgement of receipt of their ATI request? In accordance with the Access to Information Act the receiving agency (i.e. StatsCan) is required to respond to an ATI request within 30 days of receipt of that request. I will check with my contact in StatCan to see if I can find out. You have to remember, Canada is a sovereign Country, with its own laws and regulations. What happens in some of the U.S. States (and not in all of them), does not necessarily apply to Canada. I know that not all Americans know that, but that is the case. Frankly, I think we could learn a few things from our American cousins. For some politicians, a barrel of hot tar, and a bag of feathers might be warranted. A recall process could become almost too popular an option! <G> There simply is no excuse for some of our rules today. They may have made sense before modern communication and travel But we no longer need to have any employee of the government that can not be fired. We no longer need to have our own version of the "House of Lords", an unelected Senate. We reap what we sow. We have elected this government, and given them such a majority in Parliament that they can do whatever they wish. They pay no attention to the needs of the people, they are more interested in building monuments to the politicians. Anyone for a new revolution? One to take back control of Canada from the elitists? 3. We are hopeful SOMEONE will learn something about others, including the one you mentioned. We cannot do it, we are mere citizens and voters. 3. Thanks, Betty:- I have used OFF TOPIC as this list is mainly for census or lack of, so it seems. I have had one complaint "this is a genealogy list" but it is not. As for the amounts, my husband's total pension income, a veteran at Sunnybrook in Toronto, was only $16,500 -- yet I was asked to pay $530.20 to Revenue Canada -- will know later if I was forgiven! The Members of Parliament, in an all-party committee, will be checking many accounts -- the gross indecency one does reflects on all of them, regardless of political party. There are many handicapped people, ones on very small disability pensions -- one fellow receives in one month what this gentleman spent on one lunch. Muriel M. I have been following the "Mr. Radwanski" ( I use the term "Mr. with tongue in cheek) saga. It has angered me greatly, as well, as many others, I am sure. I am sitting here giggling Muriel, because I am wondering if I needed to see the itemized list! I was taking deep breaths while reading, to prevent myself from hyper-ventilating! On his 5 day trip to London, UK and Ireland, he spent just around $2,000.00 less than what the Govt. gives my husband for a YEAR! How does this man have the gall to say he has done nothing wrong! It sets me to wondering what his idea of "right" is. I hope that he is ordered to pay back a huge amount of what he has spent, + the debt that was forgiven by the Revenue Dept. AND ON TOP OF IT ALL, I HOPE THAT THE 1911 CENSUS IS RELEASED TO US AS IT SHOULD HAVE BEEN IN THE FIRST PLACE, WITH NO RESTRICTIONS! I will continue reading the saga of this obnoxious man...waiting for the hammer to fall! Betty --- Outgoing mail is certified Virus Free. Checked by AVG anti-virus system (http://www.grisoft.com).
