    1. [CAN-ONT-CARLETON] Post 1901 Census - "They know not of what they speak!"
    2. Muriel M. Davidson
    3. Greetings All. I spent the afternoon the other day in the library of Simon Fraser University going through Orders in Council and Statutes of Canada from 1871 on. I was looking to check out and verify something that I have had in the back of my mind for some time. In trying to justify their stand in refusing access to Post 1901 Census records, one of the major points that StatCan has made is that the difference between the 1906 and later Censuses, and those conducted earlier is that the 1906 Census and Statistics Act gave Instructions to Enumerators, and the clause therein relating to "Secrecy", the "Force of Law". They claim that while Instructions before 1906 had similar clauses relating to confidentiality of information given, those Instructions did not have the "Force of Law". They state this is the reason records up to 1901 are accessible while those after are not. To paraphrase, "They know not of what they speak!". I did not check every book of Orders in Council but every book that I did check had a cover page that stated that Orders in Council, Proclamations and Regulations, and/or Orders of the Governor General in Council have the "Force of Law". In addition, the Orders in Council for 1891 include a paragraph stating, in part; "[Note. -- The Orders in Council, having the force of law passed since Confederation, are now being revised and consolidated. ............]" A Proclamation included in the 1891 Orders in Council directing the taking of the 1891 Census included the following statement: "That the details of information and forms to be used should be as indicated by Schedules thereto appended, and by the instructions and blank forms issued by the Minister of Agriculture for the working thereof. Vide Canada Gazette, Vol. XX!V, p. 1198" A similar Proclamation for 1901 stated: "That the details of information and forms to be used shall be as indicated by the schedules following and by the instructions and blank forms issued by Our Minister of Agriculture for the working thereof. The schedules and forms are published in the Canada Gazette Vide Canada Gazette, vol. xxxiv., p. 1318" For 1906: ".......... the country was divided into census districts, forms and instructions were approved and directions were ordered to be observed, as set forth in full detail in the Canada Gazette of May 21st, 1906. Vide Canada Gazette, vol. xxxix., extra issue dated May 21st, 1906." And for 1911: "9. That the details of information and forms to be used shall be as indicated by the schedules following and by the instructions and blank forms issued by our said Minister of Agriculture for the working thereof. The Schedules and forms are published in the supplements to Canada Gazette, No. 2, July 9, 1910, and No. 5, July 30, 1910." "What is the point of all this?" you might ask. I am not a lawyer, but to me the point should be simple. It seems to me that if Orders in Council have "the force of law", and it is easily proved that they do, then any documents -- such as Instructions to Enumerators -- referred to by those Orders in Council, will have that same "force of law". The clause in the 1906 Census and Statistics Act giving the Instructions to Enumerators the "force of law" was not necessary because the Orders in Council referring to the "instructions and blank forms", having themselves the "force of law", already gave the Instructions that force. If I am correct in this then Dr. Fellegi and Statistics Canada are incorrect in their position that Instructions to Officers and Enumerators of Census prior to 1906 do not have the "force of law". As I have pointed out many times in the past, StatCan is very quick to state that the "Secrecy" clause in the Instructions to Enumerators has the "Force of Law". They willingly ignore other clauses in those same Instructions that state very clearly that records of Census "will have value as a record for historical use", that it "is intended to be a permanent record" and it will be "stored in the Archives of the Dominion". If one clause of those Instructions have the "force of law", then so do all other clauses in those same Instructions. Statistics Canada cannot pick and choose which clauses of the Instructions that they want to have the "force of law". I will be going to the Vancouver Public Library this morning to see what else I can find. I will keep you informed on anything pertinent to our efforts to regain the public access to Historic Census records that we are currently denied by StatCan. Happy Hunting. Gordon A. 1. [CAN-ONT-CARLETON] Post-1901 Census & Identity Theft!
    2. Muriel M. Davidson
    3. To all:- It seems IDENTITY THEFT is the "excuse" for possibly cutting off access to various census records, possibly on both sides of the 49th Parallel. When one thinks about it -- various departments of government, credit card companies and others commit "identity theft" every time we use or access any of these known facilities. Has one been able to access many governmental departments without the well-known S.I.N. [Social Insurance Number]? If one does not have this, information is not procured. Credit Cards? Has anyone ever signed up for one without having to give your mother's MAIDEN name? With your name and your mother's maiden name, plus a bit of computer research, including Ancestry.com and any L.D.S. centre, the whole family is revealed. OBITUARIES are one of the greatest items a family researcher is able to use to complete a family. However, read the following and visualize HOW the information may be utilized:- SMITH, JOHN JAMES -- The family of John James Smith, age 17, are grief-stricken following his untimely death after a short illness. He was an honors student at Mytown Secondary School, Mytown, where his family had lived for more than 50 years. Surviving the well-liked young man are his parents, John James Smith Sr. and his mother, the former Mary Elizabeth Jones; grandparents William Jones and Maizie (Steel); James Smith and Catherine (Uphill). Just read over the above obituary -- not a real one -- and one can put together a family group sheet. A few phone calls in Mytown would ascertain place and occupations of survivors. IDENTITY THEFT often may begin with the proud announcement of a new baby -- parents are thrilled and include names of all grandparents with maiden names and places of residence, date of birth, hospital, even the weight -- often a photo. Political members will likely turn a blind eye to the IDENTITY THEFT which would continue even if the records were sealed. In Canada, we are hopeful our politicians will remember this vile type of theft would continue -- and also remember, many have had wallets (with identification) LIFTED while innocently waiting to pay for groceries. [This method of Identity Theft came from my husband's companion at Sunnybrook Veteran's Wing -- It happened to her -- I.D. and money stolen] Please visit your elected and appointed politicians -- let this not be a poor excuse for non-release of census records -- we need support of all -- many have never replied!!! 2. Al Lewis
    3. Gail: This is just a guess. It's possible that McTaggart Street was located in LeBreton Flats. In 1908 the Flats was a busy and active neighbourhood in Ottawa, within easy walking distance to the saw mills on the Ottawa River and also to the Parliament Hill / Centertown area. There are no streets there today. I'll try and find out for sure. (Another possibility would be around Billings Bridge where a sizable community existed near where the RA Center is today). ... 1. [CAN-ONT-CARLETON] 2003 -- Post-1901 Census -- SONS -- Brampton
    2. Muriel M. Davidson
    3. To all readers:- Next year, 2003 is a very busy year with many planned, plus other hopeful events. Here are several 2003 events:- Family researchers and genealogists are working for and hoping for the release of the 1911 Canadian census records. Many petitions have been sent, supporting Bill S-12 by Senator Lorna Milne -- plus letters sent to both Senators and Members of Parliament. Hard-copy letters are better -- FREE postage. Petitions: http://www.globalgenealogy.com/Census/Petition.htm Download, get signers and forward to Gordon or myself. http://www.globalgenealogy.com/Census/Index6.htm http://www.globalgenealogy.com/Census/Senscore1.htm ---------------- Way back when, ancestors of many of us arrived at Halifax in 1751 and then founded Lunenburg and vicinity in 1753. The year 2003 will mark the 250th anniversary with various celebrations planned, with reunions, a trip by ship from Halifax to Lunenburg, plus Down Home hospitality. One radio/internet program advertising the coming events is the Sail On Nova Scotia - SONS - by Bryan Keddy. There is only one small bad bit of luck -- Bryan now has to pay for the Live365 for our listening pleasure. Following is a note from Bryan:- "Just a short note to let you know that I spent all night recording (Roger Whitaker, The Whites, Paul Overstreet, Alberta Slim, Willie Forbes and many others) then uploaded over 175 new songs for this weeks SONS program" The SONS program is available at http://www3.ns.sympatico.ca/bryanfkeddy/SONS.html Once all the required bits are done like registration, the next time you would just have to click on the black arrow in the yellow circle, click on "Log In" -- make sure the speakers are on -- and ENJOY! Sail On Nova Scotia also has census announcements -- genealogists would like to see the release of the 1906 and 1911 records -- the theme song is "I'm My Own Grandpa" - who will do the family history! ---------------- The latest to join the 2003 list of celebrations is the City of Brampton, celebrating its sesquicentennial - 1853 - 2003. Events are planned for every month, including regaining the Flowertown of Canada title. See http://www.city.brampton.on.ca Muriel M. 1. [CAN-ONT-CARLETON] Post 1901 Census - A few days respite!
    2. Muriel M. Davidson
    3. To all:- Sounds like Gordon will have a great weekend -- no computer! He will be back -- and should there be questions, just ask! Muriel M. Davidson [email protected] Co-Chair, Canada Census Committee ------------------------------------ Greetings All. For the past six days I have had the pleasure of having my son and two of my grand-daughters (aged 6 and 9) visiting me. On Friday morning I am taking them camping in my trailer for the weekend and on Monday morning they will start on their way home back to Calgary while I will return home. For the first time in the past five years I will not be taking my laptop computer with me and will be out of touch with the internet and my volumes of email. I will, however, be thinking about our efforts to regain public access to the Census records (in between swimming in the pool with my grand-daughters) and will try to catch up with my email on Monday. I am waiting for an article to appear in one of my own community newspapers and have just been contacted by another reporter for a paper in Enderby, BC. It is gratifying that some media people are starting to pay attention to our efforts. This is a result of our supporters contacting their local papers and reporters and writing letters to the media. Keep up the good work. With the help of you all, we will succeed. Thank you all for your support. Happy Hunting. Gordon A. 1. [CAN-ONT-CARLETON] Census allows a peek at our future.

    3. Greetings All. FYI. [Reply to Globe & Mail article July 17, 2002] Gordon A. Watts [email protected] Sent: Wednesday, July 17, 2002 2:28 PM Subject: Re: Census allows a peek at our future. Editor, Globe and Mail. Margaret Wente's article, "Census allows a peek at our future" (G&M 17 July 2002) asks the question "How many grandchildren are you going to have?" While today's Census may allow a non-identifying peek at our statistical future, if Ivan P. Fellegi, Chief Statistician of Canada, has his way, millions of Canadians and others from around the world will never again be allowed to use Canada's Historic Census records to seek information about their ancestors. Nor will our grandchildren, and their children and grandchildren be able to use these invaluable records to find out about us. 235 years of Census records, from the first census of New France, up to and including those for the 1901 National Census of Canada, currently reside in the National Archives of Canada and are available for research by any person or body. The Privacy Act and Regulations attached thereto specifically permit the original schedules of Census to be made available 92 years after collection. Dr. Fellegi has refused to allow Post-1901 records to be transferred to the control of the National Archivist for eventual release to the public. In this refusal he is in contravention of the National Archives of Canada Act, the Access to Information Act, the Privacy Act and the Statistics Act. After five years and more than 50,000 signatures sent to the government, MPs and Senators, we have finally applied to the Federal Courts to seek a Writ of Mandamus that would force Statistics Canada to release the 1906 Census of the Western Provinces. They should have been available in 1998. We seek to regain the same public access to Census records after 1901 that we have had for those records up to then. We have gone through two governments, and three Ministers of Industry (responsible for Statistics Canada). A Report of an Expert Panel appointed in 1999 and a series of Town Hall meetings held this past December and January, all support allowing public access to Census records 92 years after collection. How much longer must we wait? And how many more surveys must be endured before Statistics Canada will finally allow the access to Historic Census records that we seek, and that at least three applicable statutes state that we are entitled to? 2. Muriel M. Davidson
    3. Mr. Scott Reid, M.P. (Lanark-Carleton):- First of all, I know the House of Commons is not in session, but many family researchers keep hoping for the day the 1906 and 1911 census records will be released. The 1906 one should have been released in 1998, the 1911 is supposed to be released in 2003 --- if the 92-year waiting period is followed. We believe we know the reason Dr. Ivan Fellegi has given a very definite NO to release -- hence the federal lawsuit to gain access to very important records of a high immigration period to three prairie provinces. The Toronto Star recently did an excellent interview:- http://homepages.rootsweb.com/~downhome/1906census.html Senator Lorna Milne, also of Brampton, ON is a personal friend, and at present her Bill S-12 is slowly wending its way towards a vote and then House of Commons. The wording of the bill is the same as the one by Murray Calder which was declared non-votable by a committee. However, many family researchers still look forward to census release. We sincerely hope you will lend your support to this important issue as many search for lost family members. Muriel M. 1. [CAN-ONT-CARLETON] Post 1901 Census
    2. Muriel M. Davidson
    3. Greetings All. In my last posting I indicated that I had attended a town hall meeting put on by my MP, James Moore, and reaffirmed his support for access to Historic Census records. I was unaware at the time that a reporter for one of our local freebie newspapers was in attendence and heard my questions to Mr. Moore. This afternoon I was contacted by her and she has made an appointment with me for Monday morning to obtain information on our campaign and our legal action. She is bringing a photographer with her so in my own area at least we will have a little more publicity for our efforts. This reporter did another article on me and our campaign about two years ago. Community newspapers are a good means of exposing the Census problem and our efforts to seek a resolution to it. While they are primarily sources of commercial advertising, they cover local issues as well. It may well be easier to get a letter to the editor printed in a community newspaper than one of the larger publications. Calling one of the columnists and explaining the problem to them could well result in them writing an article that further exposes our efforts. This could work especially well for someone already known in their community for their genealogical or historical research. Should you manage to interest a columnist in the Census issue, and they want information you feel unable to provide them, do not hesitate to refer them to me by email, fax or telephone. My contact information is copied below. Feel free also to refer them to the Post 1901 Census Project Website at the URL following my signature. I would appreciate receiving copies of any articles that might result from your contact with these community newspapers. Happy Hunting. Gordon A. Should any reader follow Gordon's example, please let us know. Muriel M. Davidson [email protected] ------------------------------------------- Greetings All. I have just returned home from a town hall meeting held by my MP, James Moore. During his question period I asked for and received confirmation of his support for access to Historic Census Records. This is but one means by which we can find out our MPs position on access while Parliament is in summer recess. Another is to make an appointment with them and meet with them at their constituency office. Check the Scoreboard for their position before making an appointment so that you know what to ask them. He mentioned one thing that I have hopes he was in error. Parliament is due to resume sitting in September. Mr. Moore said there is a rumour that Chretien may delay resumption until some time in October when the Queen is due to visit Canada, so that she could give the Speech from the Throne. Happy Hunting. 3. Margaret; Your local library has a book which lists all the publishers in Canada. If I remember correctly it is entitled, "List of Periodic Publications." It will have the correct address for the publisher if they are still in business. 1. [CAN-ONT-CARLETON] Offer to photograph sites in Carleton, Lanark, Leeds area
    2. Thomas Rooney
    3. Hi to all Listers, I've been on the digest mode List for sometime, but just subscribed to the main List. It just ocurred to me that since my hobby is photographing heritage buildings, such as Churches, etc. I should offer my services to anyone living elsewhere, who might want PHOTOS of where their relatives in CARLETON, or LANARK lived, were Christened, Married, Buried or anything else. I might have some Grenville, Leeds, Arnprior photos also, or be willing to take them. I even have some eastern Quebec ones. I could scan or mail them to you. Depending how far the place requested is from where I live in Kanata, it might take some time to fill a request or I might already have the photo. Regards, Joan Ottawa
