This is one good opportunity, other than the Labour Day weekend, prior to resumption of Parliamentary sessions. Researchers, other than Canadians, are invited to assist with gathering signatures on approved petitions -- we have the NON-RESIDENT petition for their usage. There are four others, two in English and two in French, with one of each language for the Senate and one for the House of Commons. Does this not sound easier? If not, I have attachments! Signing on pages other than approved petitions is fine as long as the few lines on Page 3 are written or typed at the top of the page. Also, the committee approving petitions may toss out some I have received which do not have addresses of signers -- sorry about that - but it states addresses must be given. Also, mix up the colours of ink -- all black looks like photocopying. We need many more petitions for both Senate and House of Commons -- this is the PROOF we have to provide the census records are desired by all of us. Read your message today and thought I might reply in hopes our genealogical lines are related. You didnt mention any dates but I have been desperately searching for my ancestors for years. My great grandfathers name was William T. Atkins (wife Abbie Noonan of Ireland) That is ALL I know about them! Their oldest son Charles H. Atkins (b. 10-18-1864) was my grandfather.No I am not THAT old! When my father Charles H. Atkins Jr. was born my grandfather was 62 years old! Anyway I would love to find out anything I can about my greatgrandparents Charles and Abbie Atkins. You may e-mail me at WEED74@msn.com if you have any information about them. They also had two other sons, younger than my grandfather named Thomas and James. I do know that William and the three sons came to Portland Maine in the early 1880's and lived together in a boarding house there; so I would assume that Abbie Atkins had passed away by then. Greetings All. I spent the afternoon the other day in the library of Simon Fraser University going through Orders in Council and Statutes of Canada from 1871 on. I was looking to check out and verify something that I have had in the back of my mind for some time. In trying to justify their stand in refusing access to Post 1901 Census records, one of the major points that StatCan has made is that the difference between the 1906 and later Censuses, and those conducted earlier is that the 1906 Census and Statistics Act gave Instructions to Enumerators, and the clause therein relating to "Secrecy", the "Force of Law". They claim that while Instructions before 1906 had similar clauses relating to confidentiality of information given, those Instructions did not have the "Force of Law". They state this is the reason records up to 1901 are accessible while those after are not. To paraphrase, "They know not of what they speak!". I did not check every book of Orders in Council but every book that I did check had a cover page that stated that Orders in Council, Proclamations and Regulations, and/or Orders of the Governor General in Council have the "Force of Law". In addition, the Orders in Council for 1891 include a paragraph stating, in part; "[Note. -- The Orders in Council, having the force of law passed since Confederation, are now being revised and consolidated. ............]" A Proclamation included in the 1891 Orders in Council directing the taking of the 1891 Census included the following statement: "That the details of information and forms to be used should be as indicated by Schedules thereto appended, and by the instructions and blank forms issued by the Minister of Agriculture for the working thereof. Vide Canada Gazette, Vol. XX!V, p. 1198" A similar Proclamation for 1901 stated: "That the details of information and forms to be used shall be as indicated by the schedules following and by the instructions and blank forms issued by Our Minister of Agriculture for the working thereof. The schedules and forms are published in the Canada Gazette Vide Canada Gazette, vol. xxxiv., p. 1318" For 1906: ".......... the country was divided into census districts, forms and instructions were approved and directions were ordered to be observed, as set forth in full detail in the Canada Gazette of May 21st, 1906. Vide Canada Gazette, vol. xxxix., extra issue dated May 21st, 1906." And for 1911: "9. That the details of information and forms to be used shall be as indicated by the schedules following and by the instructions and blank forms issued by our said Minister of Agriculture for the working thereof. The Schedules and forms are published in the supplements to Canada Gazette, No. 2, July 9, 1910, and No. 5, July 30, 1910." "What is the point of all this?" you might ask. I am not a lawyer, but to me the point should be simple. It seems to me that if Orders in Council have "the force of law", and it is easily proved that they do, then any documents -- such as Instructions to Enumerators -- referred to by those Orders in Council, will have that same "force of law". The clause in the 1906 Census and Statistics Act giving the Instructions to Enumerators the "force of law" was not necessary because the Orders in Council referring to the "instructions and blank forms", having themselves the "force of law", already gave the Instructions that force. If I am correct in this then Dr. Fellegi and Statistics Canada are incorrect in their position that Instructions to Officers and Enumerators of Census prior to 1906 do not have the "force of law". As I have pointed out many times in the past, StatCan is very quick to state that the "Secrecy" clause in the Instructions to Enumerators has the "Force of Law". They willingly ignore other clauses in those same Instructions that state very clearly that records of Census "will have value as a record for historical use", that it "is intended to be a permanent record" and it will be "stored in the Archives of the Dominion". If one clause of those Instructions have the "force of law", then so do all other clauses in those same Instructions. Statistics Canada cannot pick and choose which clauses of the Instructions that they want to have the "force of law". I will be going to the Vancouver Public Library this morning to see what else I can find. I will keep you informed on anything pertinent to our efforts to regain the public access to Historic Census records that we are currently denied by StatCan. Happy Hunting. Gordon A. To all:- It seems IDENTITY THEFT is the "excuse" for possibly cutting off access to various census records, possibly on both sides of the 49th Parallel. When one thinks about it -- various departments of government, credit card companies and others commit "identity theft" every time we use or access any of these known facilities. Has one been able to access many governmental departments without the well-known S.I.N. [Social Insurance Number]? If one does not have this, information is not procured. Credit Cards? Has anyone ever signed up for one without having to give your mother's MAIDEN name? With your name and your mother's maiden name, plus a bit of computer research, including Ancestry.com and any L.D.S. centre, the whole family is revealed. OBITUARIES are one of the greatest items a family researcher is able to use to complete a family. However, read the following and visualize HOW the information may be utilized:- SMITH, JOHN JAMES -- The family of John James Smith, age 17, are grief-stricken following his untimely death after a short illness. He was an honors student at Mytown Secondary School, Mytown, where his family had lived for more than 50 years. Surviving the well-liked young man are his parents, John James Smith Sr. and his mother, the former Mary Elizabeth Jones; grandparents William Jones and Maizie (Steel); James Smith and Catherine (Uphill). Just read over the above obituary -- not a real one -- and one can put together a family group sheet. A few phone calls in Mytown would ascertain place and occupations of survivors. IDENTITY THEFT often may begin with the proud announcement of a new baby -- parents are thrilled and include names of all grandparents with maiden names and places of residence, date of birth, hospital, even the weight -- often a photo. Political members will likely turn a blind eye to the IDENTITY THEFT which would continue even if the records were sealed. In Canada, we are hopeful our politicians will remember this vile type of theft would continue -- and also remember, many have had wallets (with identification) LIFTED while innocently waiting to pay for groceries. [This method of Identity Theft came from my husband's companion at Sunnybrook Veteran's Wing -- It happened to her -- I.D. and money stolen] Please visit your elected and appointed politicians -- let this not be a poor excuse for non-release of census records -- we need support of all -- many have never replied!!! In the United East Cemetery on College Street in Liverpool, Nova Scotia is a grave marker with four sides containing inscriptions... Side 1: In Memory of Charlotte M Shand Born Jany 1,1861 Died Mar 25,1943 Side 2: In Memory Of Donald H. Shand Born Sept. 18,1892 Died Dec. 1,1924 Side 3: William H. Shand 1859-1950 Side 4: In Memory of Jacob Whittemore Born 1829 Died 1891 His wife Matilda Born 1836 Died 1894 **From research that I've done, William Henry Shand was the son of Alex and Jane Shand. Donald Shand was the son of William Henry Shand and Charlotte Whittemore Charlotte Shand was a daughter of Jacob Whittemore and Matilda Latham Also I believe I have a photo of the old Shand house which was in Mersey Point and was demolished many years ago. For the past six days I have had the pleasure of having my son and two of my grand-daughters (aged 6 and 9) visiting me. On Friday morning I am taking them camping in my trailer for the weekend and on Monday morning they will start on their way home back to Calgary while I will return home. For the first time in the past five years I will not be taking my laptop computer with me and will be out of touch with the internet and my volumes of email. I will, however, be thinking about our efforts to regain public access to the Census records (in between swimming in the pool with my grand-daughters) and will try to catch up with my email on Monday. I am waiting for an article to appear in one of my own community newspapers and have just been contacted by another reporter for a paper in Enderby, BC. It is gratifying that some media people are starting to pay attention to our efforts. This is a result of our supporters contacting their local papers and reporters and writing letters to the media. Editor, Globe and Mail. Margaret Wente's article, "Census allows a peek at our future" (G&M 17 July 2002) asks the question "How many grandchildren are you going to have?" While today's Census may allow a non-identifying peek at our statistical future, if Ivan P. Fellegi, Chief Statistician of Canada, has his way, millions of Canadians and others from around the world will never again be allowed to use Canada's Historic Census records to seek information about their ancestors. Nor will our grandchildren, and their children and grandchildren be able to use these invaluable records to find out about us. 235 years of Census records, from the first census of New France, up to and including those for the 1901 National Census of Canada, currently reside in the National Archives of Canada and are available for research by any person or body. The Privacy Act and Regulations attached thereto specifically permit the original schedules of Census to be made available 92 years after collection. Dr. Fellegi has refused to allow Post-1901 records to be transferred to the control of the National Archivist for eventual release to the public. In this refusal he is in contravention of the National Archives of Canada Act, the Access to Information Act, the Privacy Act and the Statistics Act. After five years and more than 50,000 signatures sent to the government, MPs and Senators, we have finally applied to the Federal Courts to seek a Writ of Mandamus that would force Statistics Canada to release the 1906 Census of the Western Provinces. They should have been available in 1998. We seek to regain the same public access to Census records after 1901 that we have had for those records up to then. We have gone through two governments, and three Ministers of Industry (responsible for Statistics Canada). A Report of an Expert Panel appointed in 1999 and a series of Town Hall meetings held this past December and January, all support allowing public access to Census records 92 years after collection. How much longer must we wait? And how many more surveys must be endured before Statistics Canada will finally allow the access to Historic Census records that we seek, and that at least three applicable statutes state that we are entitled to? All lived in Port Medway, Nova Scotia. Jean was born about 1893 so Adelbert probably in the same general time frame. Sorry I don't have anything more.
