Since retirement from Canada's Regular Army he had lived in the summer at Melmerby Beach, in the spring and fall in Halifax, and in winter in Florida. Born in 1918, he was the oldest of the children of Col. D. C. Sinclair QC, for many years New Glasgow's magistrate, and wife Norma MacKay, a granddaughter of Squire John MacKay, a pioneer and magistrate in the East River settlement that grew into the town of New Glasgow. On Col. Sinclair's paternal side he was a great-grandson of the shipbuilder and the first of the county's MPs, the Hon. Senator James W. Carmichael and grandson of Guysborough MP John H. Sinclair. John Sinclair's education was in New Glasgow's schools, followed by the Royal Mili! tary College, graduating in 1939. His military career began as a boy piper in the pipe band of the Cumberland Highlanders under the late Pipe-Major Fraser Holmes. The young piper formed the New Glasgow High School Cadet Corps pipe band and was appointed its first pipe-major; his first instructor Pipe-Major Holmes was on the record as saying of him that he "took easily to the pipes, it was born in him". His mother's family tradition held that he was a descendant of the storied Blind Piper MacKay, a legendary figure in piping lore a century before the Ship Hector carried the first Highlander immigrants into Pictou. For all of his life John Sinclair played the pipes. In the RMC at graduation he was the winner of the Artillery Prize and the Prize for Military Subjects. He was commissioned in the Permanent Force and posted to "C" Battery of the Royal Canadian Horse Artillery. Overseas he covered off numerous wartime appointments, among them chief instructor of gunnery at t! he Canadian Artillery School of Artillery at Seaford, and later the officer commanding the 8th Battery of the Second Field Regiment RCA in Italy. Following the war he was in turn on the directing staff of the Canadian Army Staff College, second in command of the 1-2 Field Regiment RCA and chief gunnery instructor at the Artillery School at Camp Shilo. After staff college training in Canada and England he was promoted to lieutenant colonel in 1950, and thereafter until retirement served in staff appointments in Ottawa, Halifax, England and New Brunswick. When in England during the war he married Barbara Young, a native of Ireland, who survives him, with three children: a daughter, Susan (Mrs. David Mitchell) in Kelowna, B.C. and two sons, Dr. Michael, a scientist, and Donald, an insurance broker, both of Halifax. Surviving also are five grandchildren, a sister, Mrs. Janet Hunt in Toronto, and a brother Norman C. Sinclair CA, in Saint John, N.B. A memorial service will be! held in Bradenton, Fla. At a date to be announced there will be a memorial service in the Little Harbour Presbyterian Church followed by interment of the cremated remains in the Little Harbour cemetery. Donald Maclean Sinclair, 88, of 6296 Jennings St., Halifax, died Saturday, Mar. 12 in Camp Hill Hospital, Halifax. Born in Prince Edward Island, he was a son of the late Rev. Alexander Maclean and Mary Ann Sinclair. He was minister at Fort Massey Church for many years and subsequently minister emeritus at that church. Educated in Pictou County schools, he received a BA from Dalhousie University in 1921 and an MA in 1924. He graduated from Pine Hill Divinity College and did graduate work in New College, Edinburgh. He was ordained in 1924 in Linden Presbyterian Church and served the Linden-Northport charge. He retired in 1969. From 1940-45, he served as chaplain in the Royal Canadian Navy. In 1958, he was awarded the Canadian Forces Decoration. He was past president of the Maritime Conference of the United Church of Canada, Royal Nova Scotia Historical Society and North British Society. He was a former member of t! he board of governors of Dalhousie University and the alumni board. He became a master mason in 1926. He was a member of the Royal Canadian Legion and Royal United Services Institute of Nova Scotia. He is survived by his wife, the former Mary Baird Jones; three daughters; three sons; 14 grandchildren; two great-grandchildren. Funeral service was Tuesday, Mar. 15 in Fort Massey United Church. On Friday 10 May 2002 our lawyer, Lois Sparling was in Ottawa to cross-examine representatives of Chief Statistician Ivan Fellegi (Mary Ledoux) and National Archivist Ian Wilson (Greg Eamon). It would appear that our expectations of a straight forward question and answer period dealing with the issues was not to be. Lois indicates that Justice Canada lawyers stone-walled much of her line of questioning and refused to allow the witnesses to answer many of her questions. Simple questions such as when the 1906 Census returns were micro-filmed, and by whom, were not allowed to be answered. The witnesses had obviously been coached on what they could or could not say and were prevented from answering many of the questions posed by Lois. A possible surprize in these cross-examinations was the lack of response from the witness representing Ian Wilson who, we know from personal conversations with him, supports our efforts to regain public access to the Post 1901 Census records. It is presumed that a reluctance to cooperate by this witness was once again directed by the Justice Canada lawyers. Professor Bill Waiser of the University of Saskatchewan, and myself were cross-examined Tuesday 14 May 2002, in Lois Sparling's Calgary offices. As we were questioned separately, I cannot say what Professor Waiser was questioned on. My own questioning was a surprize, and not what I had expected. I had thought to be questioned on some of the legal points of our arguments but such was not the case. The thrust of the questions asked of me had to do with whether or not I was a professional genealogist, and whether or not I had personally made an Access to Information Request for access to the 1901 Census records. While Lois made no objection to any of the questions asked of me by the Justice lawyers, they refused to allow me to answer some questions she asked in re-examination. My impression, from their line of questioning, is that they expect anyone seeking information from the 1906 Census to submit an Access to Information Request for that information, and when that is refused, to submit a complaint with the Informations Commissioner. It would appear that their line of thought is that if we did not follow this route, then we have not availed ourselves of alternate methods of obtaining information from Census. My own response to their question on this was that I had not personally made an ATI Request for access to the 1906 Census Record. I had not done so because I was aware of Professor Waiser's application, and refusal thereof, and that it was well known that Statistics Canada would not honour such a request. I noted also, that while the intent of the Access to Information Act was to enable easier access to information, it was more often than not used by the governement to exclude or exempt the information requested. Professor Waiser and myself were the only plaintiffs to be personally cross-examined by Justice Canada. The remaining plaintiffs were sent written interogatories, the thrust of which were also questioning whether or not they had personally made ATI Requests for the 1906 Census Records to either Statistics Canada or the National Archives. Lois indicates that she will likely have to bring an application in Federal Court to compel answers to her questions, and may have to bring another court application to compel timely compliance with the undertakings they did give. She may also have to make more court applications to get answers to the next set of questions and timely compliance with the next set of undertakings. All in all it would appear that the main objective of the Justice Canada lawyers is further delay. It is well known that the positions of Chief Statistician Ivan Fellegi and National Archivist Ian Wilson are diametrically opposed. Dr. Fellegi opposes access to the records while Ian Wilson supports it. We do not see how lawyers from Justice Canada can represent the positions of both defendants. In our opinion this is a clear case of conflict of interest. There are set time limits for each stage of our application. This has been only one stage of the proceedings and we will keep you informed of our progress though each stage. Happy Hunting. Gordon A. There is a B. H. Norton buried in the Central Caribou Cemetery (near Pictou), but the dates are not quite the same as you have. The stone shows born 1866 and died April 19 1887, age 21 years.
